An administrator will be allowed up to 3 discretionary days to be used at Spring Break or any other non teacher/student day with pre approval of the Superintendent of Schools. If an administrator is required or mandated to attend a workshop or meeting on Saturday then they will be allowed 1 discretionary day to replace that day with pre approval of the Superintendent of Schools. The discretionary day must be taken within six weeks and will not accumulate from year to year.
C. An administrator who is unable to work because of personal illness or disability and who has exhausted all sick leave available shall be granted a leave of absence without pay for the duration of such illness or disability, up to one year and the leave may be renewed each year upon written request by the administrator.
D. An administrator called for jury duty shall be compensated for the difference between administrative pay and the pay received for the performance of such obligation.
E. An administrator subpoenaed to give testimony as a witness before any judicial or administrative tribunal, or is a participant in a mediation, fact-finding or arbitration proceeding shall be compensated for the difference between the administrative pay and the pay received for the performance of such obligation.

LEAVE PAY. A. At 8.1 Any teacher absent from duty on account of personal illness or any other approved reason shall be allowed full pay for a total of fourteen (14) days per year, accumulative to one hundred eighty (180).
8.2 Any teacher entering the beginning of each school year each administrator system shall be credited with ten (10) days of sick leave, the unused portion of which shall accumulate from year to year, not to exceed sixty-five (65) days. An administrator may be compensated for up to five (5) unused days sick or personal days at leave on the first day he/she reports for duty and one (1) additional day the first day of each month through June 1 of his/her daily per diem rate. 8.3 A teacher who has exhausted his/her bank sick leave during the first year in the system shall forfeit one day's salary for each subsequent day of absence due to qualify illness.
8.4 A teacher shall be repaid for salary deductions made as per paragraph 8.3 (above) in the following manner: One day's salary for each day of sick leave accumulated by the end of the school year.
8.5 Any teacher who has sick leave time accumulated from the previous year or who had taught the previous year and may not fall below 50 used up his/her sick leave shall be credited with fourteen (14) days as a result. The leave on the first day he reports for duty.
8.6 Any teacher absent more than five (5) consecutive days because of illness may be taken by an administrator required to submit a statement from a doctor certifying such illness.
8.7 The provisions of this Article shall apply to absence due to surgery when the surgeon certifies that such surgery must be performed immediately.
8.8 The Board shall provide each bargaining unit member with a written statement at the beginning of the school year setting forth the total accumulated sick leave credit, if any.
8.9 An employee, upon severing employment with the Harbor Springs Public Schools, shall receive fifty dollars ($50.00) for the following reasons and subject each unused sick day provided a letter of retirement/resignation is submitted to the following conditions.

LEAVE PAY. A. C. A sick leave bank shall be established and maintained for the use of teachers. (As defined in Sick Leave Policy – Article XVI).
D. A yearly audit of the number of leave days used by the teacher shall be taken. One copy shall be issued to the teacher and the other placed in the teacher’s permanent file. This audit shall be performed by the first day must of the succeeding school year.
E. No teacher shall be taken within six weeks granted a personal leave day to earn money at another job. The Memphis Education Association and the Board will not accumulate from year tolerate abuse of leave policy. In cases where abuse is suspected, an investigation will be made by the Board and the Association.
F. H. The Board of Education reserves the right to require a physical examination at the expense of the Board when in the judgment of the Board such evidence will serve the best interest of either the teacher or the district. When the Board of Education believes that a surgical leave request is for a non-essential surgical procedure, the board may withhold approval pending submission of a physician's assurance that such surgery is a necessary procedure at the requested time. The Board of Education reserves the right to request a second opinion from a physician of the Board's choice.
I. Duty days shall mean those days when pupils are in attendance, teacher orientation days, conference and curriculum days and record days which may occur at mid year and the close of the school year.
J. There shall be deducted 1/x (x=total teacher work days scheduled for school year) of the amount of the teacher's contract for each duty day of unauthorized leave. Furthermore, any teacher who takes unauthorized leave may be subject to additional disciplinary action by the Board of Education, if, in the Board's opinion, such action is warranted.
K. The Board shall provide the teachers with an accounting of leave day balances at the bottom of each paycheck.
L. If a teacher requests a leave day and school is subsequently closed due to an emergency or a personal situation that can only be addressed during work time“Act of God” day, these additional personal days may be granted by the Superintendent. LEAVE PAY. The parties to this Agreement accept the philosophy that paid for leave is provided for the purpose of protecting the administrator's income during illness or accident and to assist during time of bereavement, religious holidays, professional growth and achievement, pressing personal business, and/or emergencies within the limits of accumulated leave time. It is understood that administrators who violate this principle will be subject to loss of leave compensation.
A. At An administrator will be granted leave days annually on the beginning basis of each the length of their work year in the amount of one fourth (1/4) day per work week plus one (1) day per semester.
