LEGAL PERSONALITY. This Agreement or the cooperation contemplated herein shall not constitute or be deemed to constitute a legal entity or partnership between the Parties.
LEGAL PERSONALITY. The OPCW shall possess full legal personality. In particular, it shall have the capacity:
(a) to contract;
(b) to acquire and dispose of movable and immovable property;
(c) to institute and act in legal proceedings.
LEGAL PERSONALITY. 7.1 The ASSOCIATION is a legal persona and may exercise all the powers of a corporate body including the owning of assets, contracting and the right to conduct legal proceedings in its own name.
7.2 The ASSOCIATION shall xxx and be sued in the name of the ASSOCIATION and the domicilium citandi et executandi will be 00 Xxxxxx Xxxxxx Street, Windhoek.
7.3 Members of the ASSOCIATION, including all Trustees, are not personally liable for any decisions taken by the ASSOCIATION or in the name of the ASSOCIATION.
7.4 All assets and liabilities of the ASSOCIATION belong to the ASSOCIATION independent of its Members. Thus, no asset of the ASSOCIATION can be claimed as a private asset by any of its Members, nor can the ASSOCIATION claim any of the assets of a Member as an ASSOCIATION asset.
7.5 The ASSOCIATION is not permitted to distribute any of its profits or gains to any person and is required to utilize its funds solely for investment or the objects for which it has been established or otherwise deal with it in terms of clause 17 infra.
LEGAL PERSONALITY. 1. The EU-LAC Foundation shall enjoy international legal personality and the necessary legal capacity for the fulfilment of its objectives and activities, in the territory of each of its Members, in accordance with their domestic laws.
2. The Foundation shall also have the capacity to contract, to acquire and dispose of movable and immovable property and to institute legal proceedings.
LEGAL PERSONALITY. The Republic of Austria recognizes the international juridical personality of the Organization, deriving from the Constitution, and its legal capacity within Austria, in particular its capacity:
(a) to contract;
(b) to acquire and dispose of immovable and movable property;
(c) to institute and respond to legal proceedings; and
(d) to take such other action as may be necessary or useful for its purpose and activities.
LEGAL PERSONALITY. Any entity established in accordance with the laws in force in any contracting party and recognized by the law under which its legal personality is established.
LEGAL PERSONALITY. The AHA Centre shall have, in the territory of its Host Country, the legal capacity necessary to do the following: to enter into contracts; to acquire and dispose of movable and immovable properties; and to institute and defend itself in legal proceedings. In the exercise of these capacities, the AHA Centre shall be represented by the Executive Director who shall comply with the relevant financial rules and procedures approved by the Governing Board.
LEGAL PERSONALITY. The Republic of Austria recognizes the international juridical personality of the Energy Community, deriving from the Treaty Establishing the Energy Community, and its legal capacity within Austria, in particular its capacity:
(a) to contract;
(b) to acquire and dispose of immovable and movable property;
(c) to institute and respond to legal proceedings; and
(d) to take such other action as may be necessary or useful for its purpose and activities.
LEGAL PERSONALITY. 1. The ITER Organization shall have international legal personality, including the capacity to conclude agreements with States and/or international organizations.
2. The ITER Organization shall have legal personality and enjoy, in the territories of the Members, the legal capacity it requires, including to:
(a) conclude contracts;
(b) acquire, hold and dispose of property;
(c) obtain licenses; and
(d) institute legal proceedings.
LEGAL PERSONALITY. Subject to the approval of the Governing Council, the Secretariat shall have the legal capacity necessary to do the following: conclude agreements with other countries, and local or international organisations; enter into contracts; acquire and dispose of movable and immovable properties; and be a party to legal proceedings. In the exercise of these capacities, the Secretariat shall be represented by the Executive Director, who shall comply with the relevant financial rules and procedures approved by the Governing Council.
