LIBERTIES. The vessel shall have the liberty to sail with or without pilots, to tow and to be towed, to assist vessels in distress, and to deviate for the purpose of saving life and property.
LIBERTIES. 9.1 SFC shall have the following liberties in connection with the Carriage of Cargo under this Tariff and SFC shall not be liable in damages or otherwise as a consequence of the exercise, neglect, non-exercise, or attempted exercise of any other of the following liberties:
(a) The Carriage may be performed by any Vessel;
(b) SFC may discharge, land, store, transship, and forward Cargo in the case of accident, should the Vessel put into a port of refuge, or for any cause including but not limited to circumstances where the Vessel is prevented from entering any port or place or is likely to be delayed or threatened owing to labour disputes, disturbances, riots, civil commotion, war or the consequences of war (declared or undeclared), terrorism or the consequences of terrorism, insurrections, requisitions, or the threat of requisition, priorities or any other action, direction, regulation or order of any competent authority or agency, acts of God, perils of the sea and of other waters, dangers of navigation, fire, ice, public enemies, storms, floods, tides, or any other matter or thing beyond the direct control of SFC or any other cause deemed fit as determined by SFC in its sole discretion. In such a case, SFC shall be at liberty to proceed to the nearest convenient port or place and there lighter, discharge into craft, land the Cargo or any part thereof, to store afloat in the Ship, ashore, or otherwise with or without watchmen, or transship or forward the Cargo to destination by land, water or air, all at the risk of the Shipper who shall pay all extra freight charges and expenses incurred under this clause in lightering, discharging, landing, storing, transshipping, or forwarding Cargo;
(c) It is further understood SFC may sail Vessels with or without pilots, tow or assist Vessels, sail Vessels which may be towed, call at any ports in any order, for any purpose, and convey Cargo in lighters to and from any Vessel or other ship at the sole risk of the Shipper of the Cargo;
(d) In case the whole or any part of any Cargo is prevented by any cause from loading, is overcarried, or landed at any intermediate port, SFC is only required to forward the Cargo by another SFC Vessel or other means of its choosing and incurs no further liability;
(e) SFC may postpone a shipment or delivery date if SFC determines that in any particular case that it is not possible, practicable, or convenient to ship or deliver Cargo and of which impossibility, impracticability, or inco...
LIBERTIES. The Vessels shall have liberty to sail with or without pilots, tow or be towed, and to deviate for the purpose of assisting vessels in distress, saving life or property at sea, landing any ill or injured person on board or taking on fuel, supplies or other necessaries, or for repair, provided that if it is necessary for the Tug to leave the Barge during any such deviation, the Barge shall be left in a position of safety and the service shall be resumed immediately upon completion of the deviation, except Carrier may at any time without penalty take such reasonable action as necessary for the saving of life at sea. Shipper shall not be responsible for any charge, cost or expense incurred by Carrier, the Vessels and/or the Cargo during the period of any such deviation.
LIBERTIES. (A) The Carrier shall make commercially reasonable efforts to carry the Goods expeditiously to the place of delivery, but the Carrier does not warrant any specific route, Vessel, method of transport or delivery date, and shall have liberty to perform the carriage in any commercially reasonable manner and by any reasonable means, methods and routes including the right to transship Goods using other Carriers, conveyances or containers. The Carrier shall always have liberty to comply with orders, directions, recommendations or suggestions, howsoever given, of any government, national or local authority.
(B) At any stage in the carriage, the Goods may, at the Carrier's absolute discretion, be carried as a single shipment or as several shipments on any means of transport, whether owned or operated by the Carrier or not.
(C) The Carrier shall make commercially reasonable efforts to complete the carriage and to deliver the Goods at the place designated for delivery, but does not guarantee such delivery and shall be excused from all consequences of nondelivery at such place, (and shall remain entitled to full freight and charges and his lien,) if such delivery is commercially unfeasible, or would delay or imperil the interests of the Carrier or the Goods, the Goods of others or the general enterprise.
(D) In particular, the Carrier is excused from full performance of the contract of carriage by the existence or apprehension of war, declared or undeclared, hostilities, warlike or belligerent acts or operations, riots, civil commotions, boycotts or other disturbances; epidemics or diseases, quarantine, sanitary or similar regulations or restrictions; shortage, absence or obstacles of labor or facilities for loading, discharging, delivery or handling of the Goods; strikes, lockouts or other labor troubles, whether partial or general, and whether or not involving employees of the Carrier, his agents or sub-contractors; congestion of ports, berths, freight stations or terminals; closure of, obstacle in or danger to any canal, waterway, land route or railroad; ice, landslide, earthquake or other natural effects creating obstacles to carriage. This list is descriptive and not exhaustive, and the existence of any of these similar conditions prior to receipt of the Goods shall not constitute waiver of the Carrier's rights.
(E) If, in the Carrier's opinion, good cause exists to fear danger, injury, loss, delay or disadvantage to the Carrier, the Goods, the Goods of others o...
LIBERTIES. 1) Carrier shall be at liberty to: make interim stops for fuel, supplies, repairs and to receive and discharge cargo for others; utilize the payload on positioning and depositioning flights and any available payload not utilized by Charterer, and the revenue generated from the transportation of such items, shall be retained by Carrier and shall not reduce or offset the charter price; take whatever steps and do whatever actions it deems necessary for the protection of itself, the aircraft, pilots and passengers, including, without limitation, the substitution of another aircraft, making collect communications, disposing of cargo without instruction and/or tendering transportation of the cargo to other carrier(s). Carrier shall also be excused from delay or inability to perform caused by circumstances beyond its reasonable control.
2) Due to Carrier’s unique aircraft and its capability to provide air dispersant services, it is understood and agreed that this charter is subject to Xxxxxxx’s prior commitment to an emergency response entity requiring that the aircraft be available to such response entity within a limited time frame. In the event of receipt of notice of activation for such emergency response, Carrier shall immediately notify Charterer and this charter may be delayed or terminated.

LIBERTIES. Any vessel provided or intended to be provided hereunder shall have liberty to bunker en route, to call at any ports in any order for any reasonable purpose, to tow or assist vessels in all situations, and to deviate for the purpose of saving life or property. Such vessel shall have the liberty to comply with any directions or recommendations, whether as to departure, arrival, routes, ports of call, stoppages, destinations, loading, discharging or otherwise, given by any governmental authority or by any person or body acting or purporting to act as or with the authority of any government. If in complying with such directions or recommendations anything is done or is not done, it shall not be deemed a deviation. If a vessel puts into any port in distress or there is an interruption of the voyage, CARRIER shall immediately notify SHIPPERS of same. SHIPPERS may name an agent at such port to whom the cargo shall be consigned, if it is to be discharged at such port. CARRIER shall likewise immediately notify SHIPPERS if cargo or any part thereof must be jettisoned.
