YOU MUST DETERMINE WHETHER THE SOFTWARE PRODUCT SUFFICIENTLY MEETS YOUR REQUIREMENTS FOR SECURITY AND UNINTERRUPTABILITY. YOU BEAR SOLE RESPONSIBILITY AND ALL LIABILITY FOR ANY LOSS INCURRED DUE TO FAILURE OF THE SOFTWARE PRODUCT TO MEET YOUR REQUIREMENTS. Limited Software Product Warranty. Promium warrants, for a period of ninety (90) days after access is first provided to you, that the Software will operate in conformance with the documentation supplied with the Software. Promium's sole obligation under this warranty is to, at Promium's sole option, correct or replace the Software so that it will perform as above warranted or refund a prorated portion of the related service fee. This warranty is void if any unauthorized modifications are made to the Software or if the Software is not used in compliance with its documentation.
Limited Software Product Warranty. For thirty (30) days from the date of purchase of the license to the Synapse Software, Synapse warrants that the media on which the Synapse Software and the Portal Software is contained will be free from defects in materials and workmanship. This warranty does not cover damage caused by improper use or neglect of the media. Synapse does not warrant the contents of the Synapse Software and the Portal Software or that the Synapse Software and the Portal Software will be error free. The Synapse Software and the Portal Software are furnished “AS IS” and without warranty or indemnity of any kind. The entire risk as to the results and performance of the Synapse Software and the Portal Software is assumed by you.
Limited Software Product Warranty. Unless otherwise specified in an ------------------------------------- applicable Product Schedule, Viaquo warrants that for a period of ninety (90) calendar days from the dare of delivery to SiVault:
(a) each Software Product shall materially perform in accordance with the relevant Documentation therefor; and
(b) the media on which Software Products are furnished shall be free of defects in material and workmanship under normal use, In case of breach of the above warranties, Viaquo shall use commercially reasonable efforts to:
(c) repair or replace the Software Products failing to perform according to the published specifications under (a) above, in accordance with Viaquo's then-current RMA procedures; or
(d) repair or replace a copy of the Software Products haying defective media within thirty (30) calendar days after return of the defective product in accordance with Viaquo's then-current RMA procedures. Except for the foregoing to the full extent allowed by applicable law, Software Products are provided "AS IS." SiVault's exclusive remedy and Viaquo's entire flability under this limited warranty will be, at Viaquo's option, to repair or replace the Software Products.
Limited Software Product Warranty. For a period of 60 days from the date of shipment, configuration, installation or from the date that you first log in to the Software Product, as applicable, ACSI warrants that when properly installed and used under normal conditions, the Software Product will perform substantially as advertised. ACSI does guarantee the use of secure coding practices to maintain the controlled use of database access to those users who have been expressly given use of the system either by contract or by the limited extension of that contract within the organization of the contracted user. This extension of the contract includes up to 6 additional users who do not have permission to further extend the use of the system by creating additional administrative logins. ACSI further guarantees to make periodic backup copies of all data in the Software Product for reinstallation in case of system failure and to provide for information security between each of the contracted users. ACSI retains the right to alter this agreement as necessary to protect the Software Package and the financial and human resource interests of ACSI.

Disclaimer of Warranties and Limitation of Liability Unless otherwise explicitly agreed to in writing by Original Code Consulting, Original Code Consulting makes no other warranties, express or implied, in fact or in law, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose other than as set forth in this agreement. Original Code Consulting makes no warranty that the Software Product will meet your requirements or operate under your specific conditions of use. Original Code Consulting makes no warranty that the operation of the Software Product will be secure, error free, or free from interruption. You must determine whether the Software Product sufficiently meets your requirements for security and uninterruptability. You bear sole responsibility and liability for any loss incurred due to failure of the Software Product to meet your requirements. Original Code Consulting will not, under any circumstances, be responsible or liable for the loss of data on any computer or information storage device, or for damage to any hardware related to the use of the Software Product. Under no circumstances shall Original Code Consulting, its directors, officers, employees, or agents be liable to you or any other party for indirect, consequential, special, incidental, punitive, or exemplary damages of any kind (including lost revenues or profits or loss of business) resulting from this agreement, or from the furnishing, performance, installation, or use of the software product, whether due to a breach of contract, breach of warranty, or the negligence of Original Code Consulting or any other party, even if Original Code Consulting is advised beforehand of the possibility of such damages. To the extent that the applicable jurisdiction limits Original Code Consulting's ability to disclaim any implied warranties, this disclaimer shall be effective to the maximum extent possible.
Limited Software Product Warranty. Compaq warrants that for ninety (90) days after delivery, the Software will perform in accordance with specifications published by Compaq. Compaqdoes not warrant that the Software is free from all bugs, errors and omissions. Your exclusive remedy and the sole liability of Compaq in connection with the Software is replacement of defective software with a copy of the same version and revision level.
