Maintain Site Records. The Engineer agrees to perform daily observation of the construction as follows:  The Engineer’s daily observation will cover all work under contract to the project’s selected Construction Contractor(s).  The Engineer shall immediately and verbally notify the Contractor and the City if the Engineer believes the work does not conform to the contract documents. Any oral communication will be documented in writing within twenty-four (24) hours of such communication.  The Engineer shall maintain a log of daily reports. The daily reports will record all pertinent information, including weather conditions, the nature and location of the work, non-conforming work, period (weekly) check of manpower, equipment and materials, and all other pertinent information.  The Engineer shall maintain a copy, on the Project site, of all contract documents and other pertinent documents in an orderly manner. These documents include drawings, specifications, addenda, requests for information, ASI/ESI, declaration of discrepancy and nonconformance reports, approved shop drawings, approved submittals, approved samples, correspondence, accepted schedules, construction change orders, amendments, logs, meeting minute, and a Contractor directory.  The Engineer shall be present at the construction site when work is proceeding and shall provide daily observation of the quality of construction.  The Engineer is not responsible for the discovery, presence, handling, removal or disposal of hazardous materials in any form at the construction site. If the Engineer has actual notice of such hazardous materials, the Engineer shall notify the Contractor and the City immediately of the discovery.  The Engineer is called upon to observe the work of City’s construction contractor(s) for the detection of defects or deficiencies in such work. The Engineer will not bear any responsibility or liability for such defects or deficiencies. The Engineer shall not review or manage the means, methods, techniques, sequences or procedures utilized by any construction contractor. The Engineer shall not make inspections or reviews of the safety programs or procedures of the construction contractor(s), and shall not review their work for the purpose of ensuring their compliance with safety standards.  Upon reviewing submittals from construction contractors, Engineer shall review and approve or take other appropriate action upon construction contractor(s)’ submittals such as shop drawings, product data and ...
