Maintenance of Accessible Features a. Within seventy-five (75) days of the effective date of this Agreement, the District will submit its proposed accessibility maintenance procedure for OCR’s review and approval. b. Within thirty (30) days of OCR’s approval of the procedure, the District will provide OCR with a report demonstrating that the approved procedure has been adopted at the District that is applicable to XXXXXXXXXXXXXXX, including the inspection and maintenance of its accessible exterior routes and accessible play surfaces.
Maintenance of Accessible Features. Throughout the term of this Agreement, consistent with 28 C.F.R. § 35.133(a), the School District will maintain the accessibility of its outdoor play areas. Vehicle operators shall immediately report any failure of a wheelchair lift to operate while in service (49 CFR 37.163(c)). 3. Repairs to access features shall be made promptly. a) The vehicle shall be removed from service before the beginning of the next service day and repairs shall be made before the vehicle is returned to service (49 CFR 37.163(d)). b) The vehicle may remain in service only if there is no spare available, and, in no case, more than five days with an inoperative access feature (49 CFR 37.163(e)). 4. Preventive maintenance inspection of access features shall be performed every three thousand (3,000) miles or forty-five days, whichever occurs first; and preventive maintenance servicing shall be performed in accordance with manufacturer recommendations.

  • Maintenance of Listing The Company will use commercially reasonable efforts to effect and maintain the listing of (x) the Units and Warrants on the NYSE (or another national securities exchange) until the consummation of the Business Combination or until such earlier time at which the Liquidation occurs, and (y) the Common Stock on the NYSE (or another national securities exchange) until five years from the date of the consummation of the Business Combination or until such earlier time at which Liquidation occurs.

  • MAINTENANCE OF CONDITIONS Conditions of employment in effect at the execution of this Agreement shall, except as improved herein, be maintained during the term of this Agreement.

  • Maintenance Manual No later than 60 (sixty) days prior to the Project Completion Date, the Contractor shall, in consultation with the Authority’s Engineer, evolve a maintenance manual (the “Maintenance Manual”) for the regular and preventive maintenance of the Project Highway in conformity with the Specifications and Standards, safety requirements and Good Industry Practice, and shall provide 5 (five) copies thereof to the Authority’s Engineer. The Authority’s Engineer shall review the Maintenance Manual within 15 (fifteen) days of its receipt and communicate its comments to the Contractor for necessary modifications, if any.

  • Routine Maintenance (i) CRC shall be responsible for Routine Maintenance when necessary or desirable to maintain the Shared Assets in a safe operating condition, and to permit and facilitate (A) the performance by CRC of its obligations pursuant to this Agreement, and (B) the use of Shared Assets by the Operators in accordance with this Agreement. (ii) CSXT or NSR, directly or through their respective affiliates, may perform the work which CRC performed prior to the date of this Agreement when (A) CRC does not possess the skills needed for such work, (B) CRC lacks the necessary employees to do such work in a timely fashion, or (C) CRC does not possess the equipment needed to do such work. CRC and the party performing the work shall agree to a reasonable fee for such work prior to performance. CRC, CSXT and NSR may agree to have additional work performed either by CSXT, NSR or their affiliates.

  • System Maintenance The Trust understands that USBFS will perform periodic maintenance to the System(s), which may cause temporary service interruptions. To the extent possible, USBFS shall notify the Trust of all planned outages and will perform any necessary maintenance during non-business hours.
