Maintenance of Revenues. The Authority will promptly collect all rents and charges due for the occupancy or use of the Facilities as the same become due, and will promptly and vigorously enforce its rights against any tenant or other person who does not pay such rents or charges as they become due. Pursuant to Section 5.02 and the Facilities Lease, the County is to pay all Base Rental Payments directly to the Trustee. The Authority will at all times maintain and vigorously enforce all of its rights under the Facilities Lease.

Maintenance of Revenues. The Participant shall promptly collect all charges due for electric utility services supplied by it as the same become due. The Participant shall at all times maintain and shall exercise Commercially Reasonable Efforts to enforce its rights against any person, customer or other entity that does not pay such charges when due.

Maintenance of Revenues. (a) The City will at all times: (1) faithfully and punctually perform all duties with reference to the System required by the Constitution and Laws of the State; and (2) comply with all terms, covenants and provisions, express and implied, of all contracts and agreements entered into by it for System use and services and all other contracts or agreements affecting or involving the System or the business of the City with respect thereto. To the extent permitted by law the City will bill each customer receiving both water and sewer service in a single bill, will refuse to accept payment for either service unless payment for the other service is also made, and if payment for either service is permitted to become delinquent and remain so for a period of one hundred and twenty (120) days, will, if practicable, discontinue the service of water to any premises the owner, tenant or occupant of which shall be so delinquent, and will not recommence the supply of water to such premises until all delinquent charges with penalties shall have been paid in full. This paragraph shall not be construed as requiring the City to refuse partial payment of any bill for water and sewer services, so long as such payment is applied proportionately to charges for each of such services. (b) The City will do, execute, acknowledge and deliver, or cause to be done, executed, acknowledged and delivered, such Supplemental Indentures and such further accounts, instruments and transfers as the Trustee may reasonably require for the better assuring, pledging and confirming to the Trustee all and singular the Revenues and the other amounts pledged hereby to the payment of the principal of, Redemption Price and interest on the Bonds. The City will not sell, convey, mortgage, encumber or otherwise dispose of any part of the Revenues, except as otherwise permitted hereunder. (c) Except under contractual arrangements in effect on the date of the execution and delivery of the Indenture, the City will not permit service to be supplied by the System to the City or any department thereof, or to any person, firm, corporation, public or private, or to any public agency or instrumentality without due consideration to be received in exchange. Maintenance of Revenues. The Local Agency will use its best efforts to comply with all provisions of law and any regulations issued thereunder relating to the Revenues, including, but not limited to, the Measure A Ordinance, Sections 2119 and 2151 through 2155 of the California Streets and Highways Code and Sections 65089.3 and 65089.4 of the California Government Code relating to conformance with the congestion management program relating to the Local Agency, and will take any and all reasonable actions required in order to maintain the Local Agency’s ability to receive the Revenues and apply the same as provided herein including, without limitation, to oppose any action by the Riverside County Transportation Commission to impair the timely receipt of Measure A Receipts and any proposed amendment of the Measure A Ordinance, the Measure A Expenditure Plan [and the Growth Management Program described therein], and the Policies and Project Descriptions which would (i) reduce the amount of Measure A Receipts that may be received by the Local Agency or (ii) reduce the period during which the Local Agency may collect Measure A Receipts; provided, that nothing herein shall require the Local Agency to take any action or expend any Local Agency funds to comply with any such requirements deemed unreasonable in the sole discretion of the Local Agency, so long as failure to take such action or expend such funds will not cause the amount of estimated Revenues to be received by the Local Agency in the next Fiscal Year to be less than 150% of the Maximum Annual Debt Service as of the date of calculation.
Maintenance of Revenues iCAD shall not take any action, or fail to take any action or enforce any right, that is intended to, or would have the effect of, shifting Revenues from a period included in the Revenue Participation Term to a period after the Revenue Participation Term has expired.
