MBE and WBE Participation. The actual services provided by the MBE or WBE must be essential in the performance of the scope of work for the applicable contract. Utilization of a certified MBE or WBE as a conduit or pass through for participation credit is strictly prohibited. It is the discretion of University-wide MWBE Program to determine whether services are essential in the performance of the scope of work and offer a determination of the appropriateness of work allowed for lower tier Sub-consulting in accordance with practices generally accepted in the construction industry. The services the MBE or WBE will provide must be among those explicitly identified in the profile (codes) of firm as listed in the NYS Empire State Development Directory of Certified MWBEs. Firms submitted or who participate in the project outside of these conditions and without specific prior approval by SUNY will not be credited toward the MWBE Utilization Plan and goals for the contract.

MBE and WBE Participation. The DESIGN-BUILDER agrees to make a good faith effort to provide that eighteen percent (18%) of the dollar amount of the AGREEMENT is performed by MBEs and six percent (6%) of the dollar amount of the AGREEMENT is performed by WBEs. DESIGN-BUILDER shall utilize the MBEs and WBEs for the Services and in the amounts identified in Exhibits A and/or C attached hereto. Should the scope of Services herein be increased, the DESIGN-BUILDER agrees to make a good faith effort to include MBE and WBE participation in the increased Services. Such participation shall be in accordance with the MBE and WBE percentages stated above.
MBE and WBE Participation. All contractors, subcontractors, sub-subcontractors, material suppliers and the like agree to use their best efforts to meet the commitments and obligations outlined below. On this Contract, the Contractor(s) shall use best efforts to enter into contracts and subcontracts including contracts with suppliers, distributors and manufacturers who are Women/Minority Business Enterprise. Contractors shall use best efforts to enter into contracts worth 5% of the Total Contract Sum with MBE firms and 5% of the total contract price with WBE firms. MBE and WBE Participation. To achieve greater participation of MBEs and WBEs in contracts administered directly or indirectly by the Authority pursuant to Executive Orders 11625 and 12138, the Developer agrees to use its good faith best efforts to: (1) place qualified MBEs and WBEs and small business concerns on solicitation lists; (2) divide the Development Services into smaller tasks or quantities to permit maximum participation by MBEs and WBEs and small business concerns; (3) use the services and assistance of the U.S. Small Business Administration, the Minority Business Development Agency of the U.S. Department of Commerce, any local minority assistance organizations and various state and local government small business agencies; (4) comply with such additional requirements relating to MBEs, WBEs, and Section 3 as set forth in the hiring and training plans developed by the Owner Entity, and approved by the Authority (the “Hiring and Training Plans”)
MBE and WBE Participation. The Availability Percentages for this Agreement for MBEs is 12% and WBEs is 15%. The Availability Percentages shall apply to the Subcontracted portion of services to be performed under this Agreement. Such Availability Percentages for MBEs and WBEs is the level of MBE and the level of WBE subcontractor participation that is expected for this Agreement in the absence of discrimination on the basis of race, national origin, color, ethnicity, or gender.
MBE and WBE Participation. 1. MBE and WBE participation includes agreements (other than employee contracts) between MBEs and WBEs and the Franchisee for services specifically required for the completion of the services to be performed under this Agreement except for subagreements for goods and supplies. The Franchisee assumes responsibility for accurately identifying the first- tier status of MBE and WBE firms proposed in the Designation of Subcontractors and MBE/WBE Participation Form.

  • L/C Participations (a) The Issuing Lender irrevocably agrees to grant and hereby grants to each L/C Participant, and, to induce the Issuing Lender to issue Letters of Credit hereunder, each L/C Participant irrevocably agrees to accept and purchase and hereby accepts and purchases from the Issuing Lender, on the terms and conditions hereinafter stated, for such L/C Participant’s own account and risk an undivided interest equal to such L/C Participant’s Revolving Credit Commitment Percentage in the Issuing Lender’s obligations and rights under and in respect of each Letter of Credit issued hereunder and the amount of each draft paid by the Issuing Lender thereunder. Each L/C Participant unconditionally and irrevocably agrees with the Issuing Lender that, if a draft is paid under any Letter of Credit for which the Issuing Lender is not reimbursed in full by the Borrower through a Revolving Credit Loan or otherwise in accordance with the terms of this Agreement, such L/C Participant shall pay to the Issuing Lender upon demand at the Issuing Lender’s address for notices specified herein an amount equal to such L/C Participant’s Revolving Credit Commitment Percentage of the amount of such draft, or any part thereof, which is not so reimbursed.
