SCHEDULING OF THE WORK. The number of working days stipulated for this Contract is 2. These working days shall be consecutive. The Contractor is not required to submit a schedule for this project. Liquidated damages will be assessed beyond the number of working days specified above as well as the completion date as noted in this tender form and agreement. The detour (road closure) shall not be in-place until this date. The bridge/roadway (entire width) complete with guardrails must be opened to traffic no later than 27 November 2020, with no interruption to traffic after this date. The overall project must be completed no later than 27 November 2020. All bidders shall supply a Preliminary Construction Schedule with his Tender Documents for review by the Department. Note that the Department’s evaluation of submitted bids shall include reviewing the Preliminary Schedule including but not limited to the benefit(s) of earlier completion, bridge/roadway open to traffic (entire width), and overall project completion date. Note that the tender deadline dates indicated for any Phase(s), bridge/roadway open to traffic (entire width), and/or overall project completion are the latest acceptable dates, with earlier dates acceptable. Prior to Contract award, the selected Bidder shall submit a detailed Final Construction Schedule to the Department for review. The Final Construction Schedule shall identify all primary work activities (eg: excavation, demolition, rock placement, earthwork backfill, road work, guardrails, etc). The Final Schedule shall indicate applicable time lines and milestones for all work activities and Phases. Throughout the project the Contractor shall notify the Department of any situations that may negatively affect the project’s Final Construction Schedule. The Contractor shall, upon the Department’s request at any time throughout the project, update and submit to the Department an updated Construction Schedule as deems required to reflect any circumstances that may cause the need for an updated Schedule.
SCHEDULING OF THE WORK. (a) The Contract Schedule shall represent a practical plan to achieve Mechanical Completion and Substantial Completion on or before the Guaranteed Substantial Completion Date. The Guaranteed Substantial Completion Date, not the Contract Schedule, shall control in the determination of any Delay Liquidated Damages. Contractor shall prepare and keep current a schedule of submittals as required by this Agreement and that is coordinated with the Contract Schedule.
(b) The Contract Schedule shall meet the following requirements: (i) all schedules, must be suitable for monitoring the progress of the Work, (ii) all schedules must provide necessary data about the timing for Owner decisions and all Owner milestones and (iii) all schedules must be in sufficient detail to demonstrate adequate planning for and completion of the Work.
(c) Acceptance or review of comments about any schedule shall not transfer responsibility for any schedule to Owner, nor imply its agreement with (i) any assumption upon which such schedule is based or (ii) any matter underlying or contained in such schedule.
(d) Time is of the essence in the performance of each provision of this Agreement.
