Meal Breaks. (a) An employee who works in excess of five hours will be entitled to an unpaid meal break of not less than 30 minutes and not more than 60 minutes. (b) Where an employee is required to remain available for duty during a meal break, the employee will be paid an ‘on call during meal break allowance’ as provided for in Item 41 in Table 2, provided such that only one allowance shall be payable in any period of 24 hours. If an employee is recalled to work during the meal break, then overtime will be paid for all time worked during such meal break. (c) Where a home care employee is required by the employer to have a meal with a client or clients as part of the normal work routine or client program, they will be paid for the duration of the meal period at the ordinary rate of pay and Clause 36.1(a) does not apply.

Meal Breaks. The meal break will be taken at a time so as not more than 60 minutes.

Notwithstanding the above, where the employee is required to remain available for duty during a meal break, the employee will be paid an ‘on call during meal break allowance’ as provided for in Item 41 in Table 2, provided such that only one allowance shall be payable in any period of 24 hours. If an employee is recalled to work during the meal break, then overtime will be paid for all time worked during such meal break.
(c) Where a home care employee is required by the employer to have a their meal with a the client or clients in a community setting as part of the normal work routine or client program, they program then the employee will be paid for the duration of at ordinary time or they may elect to take an unpaid meal after the meal period time. In residential aged care facilities where an employee is required to work during a meal break and continuously thereafter they shall be paid at the ordinary rate of pay and Clause 36.1(a) does not applydouble time until released from duty for a meal break.
