Medical Reassignment Clause Samples

A medical reassignment clause allows an employee to be transferred to a different position or role within an organization if they are unable to perform the essential duties of their current job due to a medical condition. Typically, this clause outlines the process for evaluating the employee’s abilities, identifying suitable alternative positions, and implementing the reassignment, often in consultation with medical professionals and in accordance with applicable laws. Its core function is to provide a structured way to accommodate employees with medical limitations, helping both the employer and employee navigate workplace adjustments while maintaining compliance with disability and employment regulations.
Medical Reassignment. The Superintendent may give alternate work, if the same is available, to an employee who has become medically unable to satisfactorily perform his/her regularduties. The alternate work may constitute promotion, demotion, or lateral reassignment to a related class/position title.
Medical Reassignment. If an employee is permanently unable to perform all or part of their assigned duties they may voluntarily request permanent lateral reassignment or change to lower grade to a vacant position, that has not yet been advertised, which they are qualified for. However, the employee must be medically qualified to remain in the Kansas Air National Guard as a dual status excepted technician and meets the medical requirements for any required retraining or tasking.
Medical Reassignment. (A) When an employee becomes permanently unable due to sickness or injury to perform the duties of his job classification, he shall be assigned to another job which he is able and qualified to fill, by mutual consent between the Company and the Union. In such cases the posting procedure will be waived. This assignment shall appear on the next posting notice on the main contract and posted at the CCCS. (B) When an employee with ten (10) years or more service with the Company becomes permanently unable to perform the duties of his job classification, due to on-the-job injury or illness (excluding alcohol or drug related illnesses), he will be assigned to another job which he is able and qualified to fill by mutual consent between the Company and the Union, with no reduction in pay. Once the rate for his assignment has been determined, it shall not be subject to any general wage increase until such time as the regular rate for his new classification reaches or exceeds the rate so determined above.
Medical Reassignment. If an employee is permanently unable to perform all or part of their assigned duties they may voluntarily request permanent reassignment to another position. The request will be accompanied by a medical certificate, giving full evidence of physical/mental condition of the employee, the need for reassignment and the current abilities and qualifications of the employee to perform other duties. The request for medical reassignment will not be used as the sole justification for downgrade or separation from civilian employment. However, the employee must be medically qualified to remain in the Kansas Air National Guard as a dual status excepted technician and meets the medical requirements for any required retraining or tasking.
