Minimal Staffing Requirements for CONTRACTOR. 13.1. CONTRACTOR shall maintain a minimum of one (1) paid staff person in the primary facilities at all times (that is 24 hours a day for Residential Providers). Such personnel shall be qualified, holding appropriate licenses and/or certification in accordance with the Health and Safety Code, Sections 11215 through 11997, the requirements set forth in Title 9 of the California Code of Regulations, DHCS policy letters and any amendments thereto. Clients of the program may not substitute for paid personnel. Sufficient staff members will be certified in Cardiopulmonary Resuscitation (CPR) and Basic First Aid to provide coverage at all times. Professional staff members must have a minimum of 6 months sobriety. Volunteer or paid staffs with less sobriety time are allowable, but should NOT take the place of, or maintain the sole leadership role at any time of business operations. CONTRACTOR is responsible to have policies and practices in place to ensure a safe environment that ensures the sobriety of staff and residents.

Minimal Staffing Requirements for CONTRACTOR. 14.1 CONTRACTOR must maintain an updated personnel file for each staff member (including subcontractors, as approved by COUNTY and volunteers) that includes a minimum of the following: a) Application for employment and/or resume, b) Signed employment confirmation statement/duty statement, c) Job description, d) Performance evaluations, e) Health records/status as required by the CONTRACTOR, AOD Certification or Title 9, f) Other personnel actions (e.g., commendations, discipline, status change, employment incidents and/or injuries), g) Training documentation relative to substance use disorders and treatment, h) Current registration, certification, intern status, or licensure, i) Proof of continuing education required by licensing or certifying agency and program, j) CONTRACTOR’S Code of Conduct and for registered, certified, and licensed staff, a copy of the certifying/licensing body’s code of conduct as well.

Registered Sex Offender Restrictions: For work to be performed at schools, Vendor agrees that no employee of Vendor or a subcontractor who has been adjudicated to be a registered sex offender will perform work at any time when students are, or reasonably expected to be, present unless otherwise agreed by the TIPS Member. Vendor agrees that a violation of this condition shall be considered a material breach and may result in the cancellation of the TIPS Sale at the TIPS Member’s discretion. Vendor must identify any additional costs associated with compliance of this term. If no costs are specified, compliance with this term will be provided at no additional charge. Safety Measures: Vendor shall take all reasonable precautions for the safety of employees on the worksite, and shall erect and properly maintain all necessary safeguards for protection of workers and the public. Vendor shall post warning signs against all hazards created by the operation and work in progress. Proper precautions shall be taken pursuant to state law and standard practices to protect workers, general public and existing structures from injury or damage. Smoking: Persons working under Agreement shall adhere to the TIPS Member’s or local smoking statutes, codes, ordinances, and policies.

  • Minimum Customer Support Requirements for TIPS Sales Vendor shall provide timely and commercially reasonable support for TIPS Sales or as agreed to in the applicable Supplemental Agreement.
