Minimum Standards of Performance. A. All grounds shall, at all times, be clean, neat and apparently well-tended. All grounds shall be brought up to minimum standard within one (1) month of the contract award date. Plants and turf shall be green, healthy and weed free. B. Grounds shall be mowed or machine trimmed to the water’s edge. C. Wet ground areas may be omitted from a mowing service to prevent turf damage upon approval of the Performance Administrator (Park Site Supervisor or designee). D. At no time shall leaves, trash, clippings or other debris be allowed to accumulate. E. All organic and inorganic trash, including grass clippings from mowing and edging, shall be blown or vacuumed from all sidewalks, entryways, steps, plazas and parking lots within two (2) hours of mowing or at same day of service. F. If any plant or turf area dies or becomes weak or unsightly due to negligence or improper maintenance procedures on the part of the Contractor or any sub- contractor the Contractor shall replace such plant or turf area at the expense of the Contractor. Replacement shall be completed within two (2) weeks from notification by the Contract Administrator. G. All areas shall be inspected and documented weekly by the Contractor on the Daily Vendor Service Report for detection of disease, pest control, irrigation and all other potential landscape problems. Proper and effective remedial action shall be taken immediately upon discovery. The Contractor shall submit the Daily Vendor Service Report to the Performance Administrator (Park Site Supervisor or designee) at the end of every service explaining the inspection results, problems encountered and the corrective action taken. H. No work shall be performed on weekends. I. All pesticide, fertilizer, and herbicide applications will be monitored by the Performance Administrator (Park Site Supervisor or designee). The Performance Administrator (Park Site Supervisor or designee) shall be notified two (2) days in advance, via email communications, of applications. Performance Administrator (Park Site Supervisor or designee) shall be notified upon the Contractor's arrival and will monitor mixing, spreading, spraying, and any other application performed. Spent packaging shall then be surrendered to the Performance Administrator (Park Site Supervisor or designee) for verification of application rates and products. J. No fertilizers shall be applied within fifteen (15) feet of water bodies, wetlands or where there is no irrigation.

String trimmers (weed eaters) can be used to trim around trees or other plants. E. If any plant or lawn area dies or becomes weak or unsightly due to the negligence or improper maintenance procedures on the part of the Contractor or any sub-contractor, based upon generally accepted landscape maintenance practices and not withstanding any section of these specifications, the Contractor shall replace such plant or lawn area at the expense of the Contractor. F. The Contractor will not be responsible for acts of God such as freeze damage or heavy storms that create unusual cleanup, pruning or replacements in excess of the normal scope of these services. G. All areas shall be inspected weekly for detection of disease, pest control, irrigation and all other potential landscape problems. Minimum Standards of Performance. The contractor's performance will be evaluated in accordance with the approved IPM Plan. If pests appear between scheduled treatment, the contractor may be called back to treat the room(s), or building where the problem occurred. If the contractor fails to arrive at the area of installation within one (1) workday after the request for call-back service, ERE shall have the right to obtain the service elsewhere and the contractor agrees that the actual cost of such service shall be deducted from the contractor's invoice covering the period for which the outside service was obtained. This deduction will be supported by a copy of the invoice covering the emergency service obtained elsewhere. Contractor must describe past experience with providing vermin and rodent control for large property management organizations and include references.

The lack of inspections by the County or any error or omission in these specifications shall not relieve the Contractor of its obligation to perform landscape management services in accordance with generally accepted industry standards. B. The minimum staffing is as follows: 1. Minimum of six (6) working employees (not including sub-contractors) will be required at all times to perform the tasks specified for this contract for each scheduled service. 2. Supervisors shall not be counted as workers unless they are actively onsite participating in performing work assignments on a full-time basis for each scheduled service. 3. All Contractor maintenance personnel, including sub-contractors, shall identify themselves at the guard shack by showing their vendor ID badge before beginning work. A valid Florida driver’s license or ID card may be used for admittance to the facility for employees waiting on their vendor ID badges to be issued. Contractor employees shall be wearing a company issued uniform. One lead shall remain onsite while services are being performed and shall communicate in English with the County Representative or designee. Note: Additional employees may be required if contract is amended to include additional work or sites. C. The following is a list of the minimum equipment the Contractor shall have to be compliant with the work specified in this contract.

  • Standards of Performance Provider must perform all Services required of it under this Agreement with that degree of skill, care, and diligence normally shown by a Provider performing services of a scope, purpose, and magnitude comparable with the nature of the Services to be provided under this Agreement. Provider acknowledges that, if in the course of providing Services hereunder, it is entrusted with or has access to valuable and confidential information and records of the Board, Provider agrees to be held to the standard of care of a fiduciary with respect to that information. Any review, approval, acceptance of Services or deliverables, or payment by the Board for any Services does not relieve Provider of its responsibility for the professional skill and care and technical accuracy of its Services and deliverables. This provision in no way limits the Board’s rights against Provider under this Agreement, at law or in equity. When and where applicable, all members of Provider’s staff must hold and maintain throughout the Term and any Renewal Term, valid certificates and/or licenses from the State of Illinois or such other relevant jurisdiction that authorize those individuals to perform the Services. Provider agrees to promptly furnish a copy of the license(s) of any and all direct service providers to the Board on request. Throughout the Term and any Renewal Term, Provider must maintain and use sufficient staff to assure the effective and efficient operation of its programs. Provider must cause its staff to devote such time, attention, skill, knowledge, and professional ability as necessary to effectively and efficiently fulfill Provider’s obligations under this Agreement.

  • Review of Performance The Board of Directors shall periodically review and evaluate the performance of Employee under this Employment Agreement with Employee.

  • Standard of Performance Consultant represents and warrants that it has the qualifications, experience and facilities necessary to properly perform the services required under this Agreement in a thorough, competent and professional manner. Consultant shall at all times faithfully, competently and to the best of its ability, experience and talent, perform all services described herein. In meeting its obligations under this Agreement, Consultant shall employ, at a minimum, generally accepted standards and practices utilized by persons engaged in providing services similar to those required of Consultant under this Agreement.

  • PERIOD OF PERFORMANCE The period of performance for this contract begins , and ends .

  • Excuse of Performance Seller shall not be liable for delays in performance or for non-performance due to failure or interruption of computer or telecommunication systems, acts of God, war, riot, fire, terrorism, labor trouble, unavailability of materials or components, explosion, accident, compliance with governmental requests, laws, regulations, orders or actions, or other unforeseen circumstances or causes beyond Seller's reasonable control. In the event of such delay, the time for performance or delivery shall be extended by a period of time reasonably necessary to overcome the effect of the delay.

  • Term and Time of Performance The effective date of this Agreement shall begin November 1, 2020 and will continue through June 30, 2025, subject to appropriation of funds, notwithstanding any other provision in this agreement.

  • Commencement of Performance This Agreement is of no force and effect until signed by both parties and all JBE-required approvals are secured. Any commencement of performance prior to Agreement approval shall be at Contractor's own risk.

  • Continuity of Performance In the event of a dispute between the Party and the State, each party will continue to perform its obligations under this Agreement during the resolution of the dispute until this Agreement is terminated in accordance with its terms.

  • Monitoring of Performance Vendor shall continuously monitor and record its performance to ensure that all of Vendor's responsibilities and obligations hereunder are being met and fulfilled. Citizens may conduct programmatic and other administrative contract monitoring during the term of this Agreement. The purpose of this monitoring is to ensure that all of Vendor's responsibilities and obligations are being met and fulfilled. Such monitoring may include on-site visits, report reviews, invoice reviews, compliance reviews, and a review of any other areas reasonably necessary. Vendor acknowledges and agrees that Citizens may also monitor and record Vendor Staff communications to the extent they occur within or are connected to any Citizens’ resource, such as electronic or telecommunications systems.

  • Standard and Manner of Performance Contractor shall perform its obligations under this Agreement in accordance with the highest standards of care, skill and diligence in Contractor’s industry, trade, or profession. Not Exclusive. Contractor is not guaranteed any work except as expressly stated herein, and this Agreement does not create an exclusive contract for the Work.
