More than Thirty Days. Nurses returning from an authorized 10 leave of absence of more than thirty (30) days or non FMLA/OFLA 11 medical leave of sixty (60) calendar days or more duration, shall be 12 returned to the same position and/or shift if still available. Return to 13 work from FMLA/OFLA shall be in accordance with provisions of 14 FMLA/OFLA.

More than Thirty Days. Nurses returning from an authorized 12 leave of absence of more than thirty (30) days will be required to re-apply for the 13 next available position if their position is no longer available. Nurses returning 14 from a protected leave shall be returned to the same position and/or shift if still 15 available in accordance with applicable law if such position still exists and the 16 employee was not subject to lay off/reduction in force.
