New Buildings. In Grantor's sole discretion, Grantor shall provide all electric power service to all New Buildings and to all Grantee's Space in the Grantor's retail service territory. Grantor shall perform and be responsible for site preparation and shall prepare foundations and fencing for all New Buildings on Grantor's property.

New Buildings. The Lessee shall not erect or permit to be erected on the premises any new buildings or make or permit to be made any addition to the building to be erected upon the premises, except in accordance with plans and specifications approved in writing by the Lessor.

New Buildings. Developer shall build 600,000 to 860,000 square feet of new employment buildings, with approximately 216,000 square feet to be built in the IL LUA. Developer may build up to 1200 residential units, throughout the Property. New Buildings. In NU's sole discretion, NU shall provide all electric power service to all New Buildings and to all NECOM's Space in NU's retail service territory. NU shall perform and be responsible for site preparation and shall prepare foundations and fencing for all New Buildings on NU's property. NECOM shall install all New Buildings and Equipment used in equipping NEON and in cooperation with NU when such installation is on NU's property. NECOM shall Confidential Materials omitted and filed separately with the Securities and Exchange Commission. Asterisks denote omissions.

New Buildings. (a) Party Responsible-- The Party responsible for the engineering and design of New Buildings is specified for each Route Segment constructed after the Restatement Date in the Route Segment Exhibits. (b) Scope-- The Party responsible for engineering and design of New Buildings on a Route Segment shall, in consultation with the other Party, engineer and provide detailed specifications, construction working prints and other data as necessary to permit construction of such New Buildings on such Route Segment as required to provide sufficient space and support for all Equipment to be used initially and, unless otherwise agreed, for a reasonably foreseeable future period, to provide the Capacity on such Route Segment at a total cost consistent with the budget for such Route Segment.

New Buildings. The following has been agreed to by the Employer and the Union with regard to facilities subject to Article I of this Agreement and within the geographical area of this Agreement not currently covered by a collective bargaining agreement with the Union: 1. The Employer agrees to recognize the Union as the bargaining agent for the employees at the facility from the first day of its operation of the facility. 2. The Employer agrees that all terms of the Phase-In Agreement listed in Appendix D-1 with the Union will be applicable. 3. Excluded are guards, supervisors, clerical employees, management employees, and sales personnel as defined in the National Labor Relations Act. 4. Supervisors shall not perform bargaining unit work except in emergencies. Building Forepersons may perform work as long as they are members of the bargaining unit and in good standing. 5. The Employer agrees that all employees who are not, or who hereafter may become employed in any of the classifications listed hereunder, or any related janitorial classifications, shall, as condition of employment, become and remain members and be subject to the jurisdiction of the Union as provided in Article II hereof. 6. A list of all accounts in effect on May 1, 2008 as defined in Article I of this Agreement shall be furnished to the Union. Any new locations coming under the jurisdiction of this Agreement shall be added to the list. Locations lost will be dropped off the list.

New Buildings. All new commercial office buildings, completed after November 15, 2023, in excess of 300,000 square feet in the City of Boston and in Cambridge, shall be staffed with full-time employees in compliance with the building owner's requirement. In all such buildings, the employer will be able to keep one (1) part-time employee.

New Buildings. Provided that Tenant is not then in default under the Lease, and subject to the relocation and expansion rights of now existing tenants in the Project, Tenant shall have the right, at any time during the Term of the Lease, to elect for Landlord to construct a new "shell" office building ("New Building") on any of the then unoccupied "Building Pads" designated as such in Exhibit "B" to the Form Lease. Tenant may exercise this right by notifying Landlord in writing of its election and such notice shall specifically designate the Building Pad on which Tenant desires the New Building to be constructed. Any election by Tenant to have Landlord construct a New Building shall be subject to the approval of Landlord, in Landlord's sole discretion. Within thirty (30) days of receiving Tenant's notice exercising its rights under this Section 1, Landlord shall notify Tenant in writing of its decision to construct the New Building or not. If Tenant exercises its rights under this Section 1 and Landlord elects to construct the New Building, then prior to Landlord being obligated to commence design and/or construction of such new building, Landlord and Tenant shall promptly enter into a new and separate lease for the New Building, with a minimum term of sixty (60) months, based upon then market-rate business terms ("Market Rate Business Terms"), as determined by Landlord and Tenant pursuant to the provisions set forth in Section 5 of this Rider, and otherwise on the terms and conditions set forth in the Form Lease.
