New Releases. 8.1 Bosch will make available to Customer new Releases of the Software as and when they are made “generally available” by Bosch to similarly situated customers. New Releases are made available to Customers with valid Maintenance Agreements at no additional cost.
8.2 Implementation (e.g. installation, license activation, and configuration) of new Releases is not included in the Maintenance Services. If Customer wants to receive such implementation services, they need to be ordered separately.
8.3 ALTHOUGH BOSCH WILL USE COMMERCIALLY REASONABLE EFFORTS TO ENSURE BACKWARDS COMPATIBILITY BETWEEN RELEASES, BOSCH DOES NOT GUARANTEE FULL BACKWARDS COMPATIBILITY, AND THE IMPLEMENTATION OF A NEW RELEASE MAY CAUSE SOME DATA LOSS. CUSTOMER SHOULD MAKE A FULL BACK-UP OF ALL DATA THAT CUSTOMER WISHES TO RETAIN PRIOR TO THE IMPLEMENTATION OF A NEW RELEASE.
New Releases. During any period in which You are current on Maintenance, Parasoft shall provide You with any new release of the Software, which may include generally available error corrections, modifications, maintenance patch releases, enhancements (unless priced sepa- rately by Parasoft and generally not included with new licenses for the Software at that time), and the revised User Documentation, if applicable. Notwithstanding the foregoing, stand-alone error corrections that are not part of a new release will not be independently supported but will be incorporated into the next release of the Software. If You install a new release of the Soft- ware, You may continue to use the previous version of the Software for up to ninety (90) days in order to assist You in the transition to the new release. Once You complete its transition to the new release of the Software, You must discontinue use of the previous version of the Soft- ware.
New Releases. 4.1 As a part of the Customer Support Services, Ventiv will provide to Customer new Releases of the Software as and when developed, except for new products or modules for which Ventiv generally charges a separate license or subscription fee. Ventiv is not obligated to develop new Releases of the Software.
4.2 Ventiv will provide Customer, as part of the Customer Support Services, with new Releases created by Ventiv as a result of a change in law or new law that directly applies to existing functionality within the Software currently offered by Ventiv. As an accommodation and not as provision of legal advice, Ventiv will take commercially reasonable efforts to promptly notify Customer in writing upon becoming aware of any material changes to any applicable law or governmental regulations that may cause the current Release of the Software not to conform to such law or regulations. Notwithstanding the foregoing, in the event that the required modifications to the Software (i) would require a material re-architecture or other significant product re-design, (ii) would require Ventiv to obtain data which is either unavailable, or, which is only available at a material cost, or (iii) would otherwise require Ventiv to incur material expenditures (as measured against the fees charged under this Agreement), and Ventiv is not otherwise making such modifications for its other customers, then Ventiv may cease providing the affected Software in the affected jurisdiction. Customer is strongly encouraged to consult with its own attorneys and other advisors as to legal requirements in effect from time to time.
4.3 In the event that Ventiv intends to withdraw any Software from general availability for any reason whatsoever, Ventiv will provide Customer at least six (6) months prior written notice of such withdrawal.
New Releases. During a current Maintenance period, Serena shall provide Customer with one copy of any new release of the Software, which may include generally available error corrections, modifications, maintenance patch releases, enhancements (unless priced separately by Serena and generally not included with new licenses for the Software at that time), and revised User Documentation, if applicable. Notwithstanding the foregoing, stand-alone error corrections that are not part of a new release will not be independently supported but will be incorporated into the next release of the Software. If Customer installs a new release of the Software, Customer may continue to use the previous version of the Software for up to ninety (90) days in order to assist Customer in the transition to the new release. Once Customer completes its transition to the new release of the Software, Customer shall discontinue use of the previous version of the Software.
New Releases. Each New Release which Paragon releases to its customers during the Support Period shall be provided to Licensee [*]. Licensee understands and acknowledges that New Releases may be cumulative, and if Licensee fails to implement any New Release delivered by Paragon, subsequent New Releases may not be effective. Paragon shall deliver such New Release or Corrected Version to Licensee at each Licensed Facility authorized to use the Product underlying the New Release. Each New Release delivered to Licensee shall be subject to all of the rights, obligations, terms and conditions of the License Agreement upon delivery.
New Releases. Licensor shall deliver to Creative, promptly upon the availability thereof, Masters for any Updates and Upgrades of the Licensed Products during the Term of this Agreement, and such Updates and Upgrades shall be deemed part of the Licensed Products. In addition, Licensor agrees to upgrade the Restricted Product to maintain the relatively same difference in functionality between the Restricted Product and the Activated Product. Licensor shall make commercially reasonable efforts to notify Creative at least ninety (90) days prior to the date of introduction of any such Updates and Upgrades.

New Releases. After the initial installation of a System, CTS will provide all New Releases for such System to Customer [*] so long as Customer continuously purchases for such System the software subscription services described in the Support Services Agreement and Customer is not in breach or default under this Agreement or the Support Services Agreement. Otherwise, CTS will provide New Releases for such System to Customer on such terms and conditions and for such Fees as the parties may mutually agree to in writing. CTS agrees to give Customer reasonable prior notice in the event that any New Release requires the purchase of new or additional hardware or software.
New Releases. (1) You acknowledge and agree that any obligation the Licensor may have to support the previous version of the Product may be ended upon availability of the New Release.
(2) Nothing in the Agreement shall be construed as to grant you any rights or licenses with regard to the New Releases.
