No Strike or Lockout, Picket Lines. A. CEA agrees that during the life of this Agreement, CEA, its agents or its bargaining unit members shall not authorize, instigate, aid or engage in any work stoppage, slowdown, sick-out, refusal to work, picketing or strike against the Employer. B. The Employer agrees that during the life of this Agreement there shall be no lockout. C. Any violation of this Section by CEA or the Employer is not subject to the grievance-arbitration procedure and either party may pursue such legal remedies as provided by law. D. Disciplinary action taken against an employee for violation of this Section is subject to the grievance-arbitration procedure.

If a picket line is established and sanctioned by CEA and officially announced by the CEA President, it shall not be a violation of this Agreement and it shall not be cause for discipline or discharge in the event an employee refuses to enter upon any property involved in such a primary labor dispute or refuses to go through or work behind any such primary line, including primary picket lines at the Employer's place of operation. The provisions of this paragraph do not apply to those class one employees described under AS 23.40.200 or to class two employees if enjoined pursuant to AS23.40.200. C. The Employer agrees that during the life of this Agreement there shall be no lockout. D. Any violation of this Section by CEA or the Employer is not subject to the grievance- arbitration procedure and either party may pursue such legal remedies as provided by law. E.
