Picket Line. It shall not be considered a violation of this Agreement for an employee to refuse to cross a picket line which has been legally established as a result of a bona fide labour dispute between a recognized Trade Union and an Employer with whom the picketing Union has a dispute.
Picket Line. It shall not be a violation of this Agreement and it shall not be cause for discharge or disciplinary action (including but not limited to the temporary or permanent replacement of any employee) in the event an employee refuses to enter upon any property involved in a pri- xxxx labor dispute, or refuses to go through or work behind any primary picket line, including the primary picket line of Unions party to this Agreement, and including primary picket lines at the Employer’s place of business, and the Employer shall not direct any employee to cross a primary picket line.
Picket Line. No employee shall be required to cross a legal picket line which has been recognized by the Union.
Picket Line. It shall not be a violation of this Agreement or cause for discharge of any employee, in the performance of her duties, to refuse to cross a legal picket line. The Union shall notify the Employer as soon as possible of the existence of such recognized picket lines.
Picket Line. It shall not be a violation of this Agreement and shall not be cause for discharge or disciplinary action in the event an employee refuses to enter upon any property involved in a lawful primary dispute or refuses to go through or work behind any lawful primary picket line, including lawful primary picket lines of the Union and including primary picket lines at the Employer’s place of business.
Picket Line. No employee covered by this Agreement shall be required to cross any legally constituted picket line established at any work location. It is further agreed that where an emergent condition or emergency situation exists, an employee may deal with such emergency situation where the Employer and the Union agree that such a situation does, in fact, exist.
Picket Line. It shall not be a violation of this Agreement and it shall not be cause for discharge or disciplinary action in the event an Employee refuses to enter upon any property involved in a lawful primary labor dispute or refuses to go through or work behind any lawful primary picket line including the primary picket line of the Union party to this Agreement and including the primary picket lines at the Employer’s places of business. It shall not be a violation of this Agreement and it shall not be cause for discharge or disciplinary action if any Employee refuses to perform any services which the Employer undertakes to perform as an ally of the Employer or person whose Employees are on lawful strike and which service, but for such strike, would be performed by the Employees of the Employer or persons on strike.
Picket Line. No employee shall be disciplined for refusing to cross a recognized and sanctioned picket line.
Picket Line. The Commission acknowledges the Union’s philosophy of solidarity for those unionized workers engaged in legal strike action. In recognition of this, members covered by the Collective Agreement will not be required to cross legal picket lines. The Commission will attempt to temporarily relocate bus service where necessary to comply with this article.
Picket Line. 1. All employees covered under this Agreement have the right to refuse to cross or work behind a trade union picket line unless the same is declared illegal by the Labour Relations Board. Any employee failing to report for duty for this reason shall be deducted full salary for each day so involved.
2. Refusal to cross a union picket line encountered in carrying out Board business shall not be considered a violation of the Agreement nor shall it be grounds for disciplinary action by the Board.
3. Employees shall not be required to do work or carry out duties normally performed by persons engaged in a strike, or locked out, nor shall employees be required to request, require, or direct pupils to carry out such duties.
4. Employees shall not be required to work with persons who volunteer or are hired to perform the duties which would normally be performed by those who are on strike or locked out. Those who choose to absent themselves will be deducted full salary for each day so involved.
5. In cases where the labour dispute in question involves a place of work for the employee which is other than School Board property, the Superintendent may reassign such employee for each day the picket line remains.
