Nodal Officer. 5.4.1 Authority shall nominate a Nodal Officer, who shall co-ordinate with the Facility Manager, MOR and/ or Railway Administration and oversee the SFM Project. Any notice to, consent, concurrence and/ or approval of the Authority, required to be provided / obtained hereunder, may be given to and/ or granted by, such Nodal Officer.
Nodal Officer. ANERT would assign one nodal officer for the CLIENT to manage the client queries and requirements. ANERT shall inform by E-mail the name and contact details of the nodal officer so assigned to the CLIENT.
Nodal Officer. The Authority shall within thirty (30) days of the date of execution of this Agreement nominate a Person who shall have the overall responsibility, to oversee the Project, coordinate with all relevant agencies of the Authority, approve all development schemes/proposals/plans, prepared as per Specification & Standards, in relevant to the Project and to monitor the implementation of the Project by the Concessionaire for compliance with the provisions of this Concession Agreement (herein the “Nodal Officer”); provided that the Authority shall not be liable in any manner for such monitoring undertaken by it or the Nodal Officer or his representative and the Concessionaire shall remain liable for performing its obligations, duties and liabilities under this Concession Agreement as well as conformity of all development schemes/ proposals/plans with the Specification & Standards. The Nodal Officer shall be appointed/nominated by the Board of Directors, ISCL. The qualifications and Job Responsibilities of the incumbent shall be decided by the Board and he/she shall work in liaison with the Independent Engineer Provided further that any failure on the part of the Nodal Officer or his representative in respect of such monitoring shall not amount to any consent or approval by the Authority of the Concessionaire’s activities and shall not amount to a certification of the compliance, by the Authority that the Concessionaire has complied with Applicable Law.
Nodal Officer a) The Authority shall designate Nodal Officer to the aforesaid process for the entire Agreement Period. The scope of work of the Nodal Officer shall be substantially as set out in Appendix 7. Work of certification of Performance Parameters as stipulated in this Agreement shall be done by Indian Ports Association during the remaining Agreement Period (During the Operations period).
b) If either Party disputes any advice, instruction or decision of the Nodal officer, the dispute shall be resolved in accordance with the dispute resolution procedure set out in Article 18.
Nodal Officer. 12.1 The Institute and the Hospital shall designate at least one Nodal Officer from their side and share their details (Name, Designation, Email ID and Mobile Number, etc.) to each other immediately after the Agreement.
12.2 Any change in the Nodal Officer or details of the Nodal Officer shall be intimated to the other party at the earliest and within a week of such change.
Nodal Officer. 5.4.1 IRSDC shall nominate a Nodal Officer, who shall co-ordinate with the MoR and/ or Railway Administration and oversee the Project. Any notice to, consent, concurrence and/ or approval of the IRSDC, required to be provided / obtained hereunder, may be given to and/ or granted by, such Nodal Officer.
Nodal Officer. ANERT would assign one nodal officer for the CLIENT to manage the client queries and requirements. ANERT shall inform by E-mail the name and contact details of the nodal officer so assigned to the CLIENT. It is hereby agreed by ANERT that by virtue of this agreement no relationship would be created between the drivers of the E-Cars and the CLIENT. It will be the sole responsibility of ANERT to pay the salary and other statutory benefits to its drivers meeting all the statutory obligations and no complaints in this regard would be entertained by the CLIENT. However it is also undertaken by the CLIENT that it shall not engage the drivers allotted by ANERT for their personal use by driving other cars (not supplied by ANERT) and any infringement or damages in this regard would be deemed to be violation of the terms of this agreement and would also render the CLIENT liable for any the monetary damages as assessed by ANERT.
Nodal Officer. If required by the SC, the Consultant shall ensure that at all times during the Consultant’s performance of the Services a Nodal officer, acceptable to the “Authority”, shall take charge of the performance of such Services.
Nodal Officer. In order to perform its obligations, inter alia, the Nodal Officer, designated by the State Level Project Committee, will be responsible for supervision, monitoring, regulatory facilitation and interacting with the PE in relation to all matters concerning the Parties’ mutual rights and obligations hereunder (the “Nodal Officer”) as described in Schedule 14. The Nodal Officer shall be the ‘single point of contact’ for the PE for all matters concerning this Agreement. The Nodal Officer would meet at least quarterly, inter alia, with representatives of the PE and conduct a joint review of emerging issues and concerns and keep an oversight of the development of the MTM.
Nodal Officer. The BSHB shall within 30 days of the Effective Date nominate a competent individual who shall have the overall responsibility, to oversee the Project, coordinate with all relevant agencies of Government, approve all development schemes/proposals/plans in relation to the Project and to monitor the implementation of the Project by the Developer for compliance with the provisions of this Agreement (the “Nodal Officer”); provided that the BSHB shall not be liable in any manner for such monitoring undertaken by it or the Nodal Officer and the Developer shall remain liable for performing its obligations, duties and liabilities under this Agreement. Provided further that any failure on the part of the Nodal Officer in respect of such monitoring shall not amount to any consent or approval by BSHB of the Developer’s activities and shall not amount to a certification of the compliance, by BSHB that the Developer has complied with Applicable Law.
