Non-Discrimination Covenants. Developer covenants by and for itself, its successors and assigns, and all persons claiming under or through them that there shall be no discrimination against or segregation of, any person or group of persons on account of any basis listed in subdivision (a) or (d) of Section 12955 of the Government Code, as those bases are defined in Sections 12926, 12926.1, subdivision (m) and paragraph (1) of subdivision (p) of Section 12955, and Section 12955.2 of the Government Code, in the sale, lease, sublease, transfer, use, occupancy, tenure, or enjoyment of the Site, nor shall the grantee or any person claiming under or through him or her, establish or permit any practice or practices of discrimination or segregation with reference to the selection, location, number, use or occupancy of tenants, lessees, subtenants, sublessees, or vendees in the Site. The foregoing covenants shall run with the land. Developer shall refrain from restricting the rental or lease of the Site on any of the bases listed above. All leases or contracts relating to the Site shall contain or be subject to substantially the following nondiscrimination or nonsegregation clauses:

Developer shall also comply with the equal opportunity and fair housing requirements set forth in Section 92.350 of the HOME Regulations. The covenants established in this Section 311 shall, without regard to technical classification and designation, be binding for the benefit and in favor of the City and Authority and their successors and assigns, and shall remain in effect in perpetuity. 312. Regulatory Agreement. The requirements of this Agreement which are applicable after the disbursement of the City Loans are set forth in the “Regulatory Agreement” which is attached hereto as Exhibit D and incorporated herein by reference. The execution and recordation of the Regulatory Agreement is a condition precedent to the disbursement of the City Loans.

Non-Discrimination Covenants. In accordance with Chapter 17-400 of The Philadelphia Code, the Contractor’s payment or reimbursement of membership fees or other expenses associated with participation by its employees in an exclusionary private organization, insofar as much participation confers an employment advantage or constitutes or results in discrimination with regard to hiring, tenure of employment, promotions, terms, privileges or conditions of employment on the basis of race, color, sex, sexual orientation, religion, national origin or ancestry, constitutes a default under the Agreement entitling Owner to all rights and remedies provided in the Agreement or otherwise available at law or in equity.
