Notification of Data Breach. 9.1 The Processor shall notify the Controller without undue delay after becoming aware of (and in any event within 72 hours of discovering) any accidental or unlawful destruction, loss, alteration or unauthorised disclosure or access to any Personal Data (“Data Breach”).
9.2 The Processor will take all commercially reasonable measures to secure the Personal Data, to limit the effects of any Data Breach, and to assist the Controller in meeting the Controller’s obligations under applicable law.
Notification of Data Breach. The Processor shall notify the Controller without undue delay after becoming aware of (and in any event within 72 hours of discovering) any accidental or unlawful destruction, loss, alteration or unauthorised disclosure or access to any Personal Data (“Data Breach”). The Processor will take all commercially reasonable measures to secure the Personal Data, to limit the effects of any Data Breach and to assist the Controller in meeting the Controller’s obligations under applicable law. The Processor’s notification of, or response to, a Data Breach under this Section 10 will not be construed as an acknowledgement by the Processor of any fault or liability with respect to the Data Breach. The Processor will not assess the content of the Controller’s data in order to identify information subject to any specific Controller data breach. Controller is solely responsible for complying with data breach notification laws applicable to the Controller and fulfilling any third party notification obligations related to any Data Breach(es).
Notification of Data Breach. Provider shall, to the extent permitted by law, notify Client without undue delay upon Provider or any Sub-processor becoming aware of a Personal Data Breach affecting Client Personal Data, providing Client with sufficient information to allow Client to meet any obligations to report or inform Data Subjects of the Personal Data Breach under the Data Protection Laws.
Notification of Data Breach. A. When Provider becomes aware of a disclosure or security breach concerning any Data covered by this Agreement, Provider shall immediately notify the District and take immediate steps to limit and mitigate the damage of such security breach to the greatest extent possible.
B. The Parties agree that any breach of the privacy and/or confidentiality obligation set forth in the Agreement may, at the District’s discretion, result in the District immediately terminating this Agreement and refusing to enter into a contract with Provider or otherwise allow Provider access to any District Data for a period of not less than five (5) years.
C. In addition to and notwithstanding any termination provision set forth in the underlying agreement(s), in which the District shares Data with Provider, this Agreement and such underlying agreement(s) may be terminated by the District if Provider fails to cure such breach within thirty (30) days of receiving written notice from the District of such breach (or such longer time necessary to cure such breach if the breach cannot be cured in 30 days). The Party in breach shall identify to the non-breaching Party all steps taken to cure such breach and the estimated timeframe for such cure.
Notification of Data Breach. Data Processor shall notify Data Controller without undue delay of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to Data Controller's Personal Data or any accidental or unauthorised access or any other event affecting the integrity, availability or confidentiality of Data Controller’s Personal Data.
Notification of Data Breach. The CONTRACTOR must notify the One thousand ($1,000) DEPARTMENT Program Manager and Privacy Officer within one (1) dollars per BUSINESS BUSINESS DAY of discovering that the PHI and/or PII of one (1) or more DAY for which the PARTICIPANTS may have been breached or has been breached. The standard is not met CONTRACTOR is required to report using the form provided by the DEPARTMENT. (See Department Terms and Conditions.)

When Vendor becomes aware of a disclosure or security breach concerning any Data, Vendor shall immediately notify the District and take immediate steps to limit and mitigate the damage of such security breach to the greatest extent possible and to satisfy legal requirements relating to or arising from such breach.
B. The Parties agree any breach of the privacy and/or confidentiality obligation set forth in the Agreement may, at the District’s discretion, result in the District immediately terminating this Agreement.

Furthermore, the Processor shall assist the Controller in ensuring compliance with the Controller's obligations to (i) document any personal data breach, (ii) notify the applicable supervisory authority of any personal data breach and (iii) communicate such personal data breach to the data subjects, in accordance with Applicable Legislation.
Notification of Data Breach. To the extent that ARINC experiences a Personal Data Breach with respect to the Personal Data ARINC Processes as part of its performance of the Services, ARINC will notify Customer promptly upon becoming aware of such Personal Data Breach, to the extent required under applicable law. ARINC will mitigate, to the extent practicable, any harmful effect of such Personal Data Breach.
