Off-Site Public improvements. Where applicable, the Subdivider agrees to construct and install off-site public improvements pursuant to plans and specifications approved by the City of Avon. The financial guarantees for said off-site public improvements have been included in the Performance Bond and Maintenance Bond set forth in this Agreement.

Where applicable, the Developer agrees to comply with plans and off-site storm drainage approved by the City Engineer and shall perform the clearing and cleaning of ditches and land reasonably necessary at its expense. The City will provide the Developer with access to land owned and controlled by the City for this purpose and the Developer shall be responsible for obtaining licenses or easements on all private lands necessary to satisfy the drainage plans approved by the City Engineer. Any off-site storm drainage must comply with ACO §1050.111 and any other applicable sections of the Avon Codified Ordinances.
Off-Site Public improvements. 5.1 The Developer shall be responsible for the cost of making all off -site improvements along Lowell Boulevard as required per concept and construction plans prepaxxx xx conjunction with the Lowell Boulevard Enhancement Project, with the exception of undergrouxxxxx of overhead utility lines along the street frontages which shall be improved as provided for in Section 5.3 below.
Off-Site Public improvements. Developer has agreed, if requested by the Authority to design and construct certain designated public facilities and improvements referred to as Authority’s Off-Site Improvements consisting of a public parking lot, a skate park and senior park. Developer shall construct all Off-Site improvements in accordance with Authority and City approved plans. Developer will submit the final construction plans to the Executive Director for review and approval prior to commencement of construction in conformance with the Schedule of Performance. Off-Site Public improvements. Any off-site improvements required to be funded, designed, developed, constructed or contributed by any Applicable Laws as a result of Tenant’s development of the Demised Property (all of which may be considered as part of the Public Infrastructure) shall be funded, designed, developed, constructed or contributed at no cost to the City. Notwithstanding any other provision in this Lease to the contrary, City shall assist Tenant in obtaining impact fee credits for such Public Infrastructure as completed by Tenant that otherwise qualify for impact fee credits or reimbursements under the applicable Codes of the City and Miami- Dade County.

The financial guarantees for said off-site public improvements have been included in the Performance Bond and Maintenance Bond set forth in this Agreement. Prior to acceptance of improvements, Subdivider shall provide the City with an Assignment of Easement for purposes of allowing the City to accept and then maintain a waterline being constructed by the Subdivider over lands owned by Xxxx X. Xxxx for purposes of servicing Xxxxx 00 of this subdivision. A copy is attached hereto and incorporated herein as Exhibit 1.
