Our Responsibility for Processing Transactions. Regardless of anything to the contrary in this Agreement, or any other agreement, unless otherwise required by law, we will not be liable for untimely or incorrect transfers, including but not limited to the following scenarios: you fail to provide us with timely, complete and accurate information for any transactions; through no fault of ours, you do not have enough money in your account to make the payment or transfer requested; the payment or transfer would exceed any permitted overdraft line of credit or overdraft privileges you have with us; circumstances beyond our control (such as fire, flood, water damage, power failure, strike, labor dispute, computer malfunction, interruption of telephone, Internet service, or telecommunications facilities or a natural disaster) prevent or postpone the transfer, despite reasonable precautions taken by us; the funds in your Account were subject to legal process, an uncollected funds hold or otherwise not available; your account is closed, dormant, frozen or blocked; you did not properly follow Service instructions on how to make the transfer (this includes incorrect date, amount, or untimely completion of the transfer to meet the cut-off time); your operating system, Internet connection and/or software malfunctioned for any reason; or the transaction could not be completed due to inability to access the service during maintenance. In addition may be other liability exclusions stated in our Account Agreement.

However, we will not be liable for direct or consequential damages in the following events: (a) If, through no fault of ours, there is not enough money in your accounts to complete the transaction, if any funds in your accounts necessary to complete the transaction are held as uncollected funds pursuant to our Funds Availability Policy Disclosure, or if the transaction involves a loan request exceeding your credit limit. (b) If the money in your account is subject to legal process or other claim.; (c) If circumstances beyond our control such as interruption of telephone service or telecommunication facilities, or natural disaster prevent the transaction (d) If funds in your account are pledged as collateral or frozen because of a delinquent loan (e) If the electronic transfer is not completed as a result of your willful or negligent use of your card, access code, or any EFT facility for making such transfers (f) If the systems were not working properly and you knew or should have known about the breakdown when you started the transaction; (g) If circumstances beyond our control such as interruption of telephone service or telecommunication facilities, or natural disaster prevent the transfer, despite reasonable precautions that we have taken; (h) If you have not provided us with complete and correct payment information; (i) If your browser, operating system, Internet service or any equipment you may use to access Digital Banking Services is misapplied or malfunctions; (j) If you do not exercise care to safeguard your system and prevent its misuse by other persons (for example, use of your Login credentials); (k) If you have not properly followed the instructions for using our Digital Banking Services; (l) If you have xxxx payment services, we can only confirm the amount, the participating merchant, and date of the xxxx payment transfer made by the Credit Union. For any other error or question you have involving the billing statement of the participating merchant, you must contact the merchant directly. We are not responsible for investigating such errors. You will take reasonable actions to protect NCR Voyix’s intellectual property rights. 7.4 You are responsible for complying with all rules, bylaws, programs, and regulations of the payment card networks in connection with your use of the Service, Software and Hardware, as applicable. You will defend and indemnify NCR Voyix against any claim or loss resulting from your failure to fulfill your responsibilities under this Section. 7.5 Certain Services may perform analysis of transaction records designed to identify transaction patterns and activity that may be indicative of fraud. You acknowledge that the indicia reported by such Services may not necessarily be the result of fraudulent activity. You are responsible for performing its own evaluation of any results. NCR Voyix does not guarantee the detection of fraudulent transactions. 7.6 You are responsible for all data, information, materials and instructions (“Customer Instructions”) provided to NCR Voyix by you or on your behalf. NCR Voyix is entitled to rely upon Customer Instructions. In no event will NCR Voyix be liable with respect to any loss, liability, cost, damage, or expense arising out of a claim by you or any third party to the extent that claim arises as a result of NCR Voyix’s compliance with Customer Instructions.

Users shall adopt a clear desk policy for papers and removable storage media and a clear screen policy for information processing facilities.

  • Client’s Responsibilities (a) Client agrees to advise Consultant regarding Client's Project requirements and to provide all relevant information, surveys, data and previous reports accessible to Client which Consultant may reasonably require. The above periods of presumed reasonableness shall be extended where information reasonably required is not within the custody or control of Client but must be procured from others.
