Common use of Overtime Work and Pay Clause in Contracts

Overtime Work and Pay. Employees may be required to work a reasonable amount of overtime as assigned by the Employer. All overtime work must be approved in advance. When authorized by departmental policy and approved in advance by an eligible employee's supervisor, compensatory time may be granted to employees in lieu of overtime pay. In no case shall overtime pay or compensatory time be granted to employees in grades twelve (12) and above. The overtime pay/compensatory time status codes set forth in Appendix "A" of this Agreement (OTC 1, 2, 3, or 4) shall be applicable to bargaining unit employees as defined below: a. OTC Code 1. Employees are not eligible for overtime pay or compensatory time. b. OTC Codes 2. Overtime pay or compensatory time shall be granted to employees at the rate of one and one-half (1½) times their regular hourly rate of pay for all time worked in excess of eight (8) hours per day or for all time worked in excess of forty (40) hours per week and at the rate of two (2) times their regular hourly rate of pay for all time worked on the seventh (7th) consecutive day of actual work, notwithstanding the timing of pay periods or unscheduled shift changes, except where specifically exempted within other negotiated agreements. Compressed work week arrangements, voluntarily agreed upon by employees and their supervisors, shall be exempt from the daily overtime provisions of this paragraph. c. OTC Code 3. Overtime pay or compensatory time shall be granted to employees at the rate of one and one-half (1½) times their regular hourly rate of pay for all time worked in excess of forty (40) hours in any work week. d. OTC Code 4. Compensatory time shall be granted for all time worked in excess of the normal work week at the rate of one (1) hour of compensatory time for each hour so worked. A maximum of one-hundred (100) hours of compensatory time may be accumulated unless the City Council has authorized up to one hundred twenty (120) hours for employees assigned to work on a special project basis or has authorized pay for compensatory time on a special project basis when funds are available for such purposes. Compensatory time, when used, must be scheduled and approved in advance in the same manner as the scheduling and approval of vacation under this Agreement.

All work performed by an employee on the seventh (7th) consecutive day of work shall be compensated at two (2) times the employee's regular hourly rate of pay, except that employees in the classifications of Water Distribution Operator and Senior Water Distribution Operator will only receive the seventh (7th) day premium if the seventh (7th) consecutive day of work is a result of unscheduled work, emergency, or overtime work.. c. Overtime pay or compensatory time shall be granted to employees at the rate of one and one-half (1½) times their regular hourly rate of pay for all time worked in excess of forty (40) hours in any work week. d. OTC Code 4. Compensatory time shall be granted for all time worked in excess of the normal work week at the rate of one (1) hour of compensatory time for each hour so worked. A maximum Non-exempt employees, with the advance approval of one-hundred (100) their immediate supervisors, may elect to be compensated for overtime work at the rates specified in this subdivision in compensatory time rather than pay. Employees shall be allowed to accumulate up to 32 hours of compensatory time may be accumulated unless the City Council has authorized up to one hundred twenty (120) hours for employees assigned to work on a special project basis or has authorized pay for in lieu of overtime. This compensatory time on balance shall be refreshed at the employee’s discretion; however, it shall not exceed 32 hours. In December of each year, the Employer shall compensate each employee for all hours remaining in the compensatory time bank, and the employee shall begin each year with a special project basis when funds are available for such purposeszero balance. Compensatory time, when used, must time off shall be scheduled and approved in advance in the same manner as vacation leave or as may otherwise be agreed upon by the scheduling affected employees and approval their immediate supervisor. Employees and their supervisors shall diligently work together to schedule accumulated compensatory time off when the impact on the Employer's operation will be minimized. The Employer shall not unilaterally assign compensatory time off to employees at times of vacation under this Agreementits own choosing.

Compressed work week arrangements, voluntarily agreed upon by employees and their supervisors, shall be exempt from the daily overtime provisions of this the above paragraph. c. OTC Code 3. Overtime , but will grant overtime pay or compensatory time shall be granted to employees at the rate of one and one-half (1½1 ½) times their regular hourly rate of pay for all time worked in excess of forty ten (4010) hours in any work week. d. OTC Code 4. Compensatory time shall be granted per day, or for all time worked in excess of the normal work forty (40) hours per week and at the rate of one two (12) hour times their regular hourly rate of compensatory pay for all time worked on shifts that start on the sixth (6th) and seventh (7th) consecutive day of work. The Employer shall schedule three (3) consecutive days off, based upon a seven (7) day workweek, as part of a compressed work schedule. c. If the Employer has a need to establish work schedules that are more than eight (8) hours duration and no employee volunteers for a compressed work week, as sited above in “b”, the schedules shall be filled by first requesting volunteers in order of seniority from among the qualified employees. If there are an insufficient number of volunteers, the Employer may assign qualified employees in reverse seniority order. d. Such schedules and employees in “c” and “d” above shall be subject to the following: i. The affected employees will be provided with fourteen (14) or more calendar days of notice before the effective date of the schedule. ii. The notice will clearly identify the days to be worked, and the schedule will consist of consecutive days of work. iii. The notice will project the duration of the schedule. iv. If the project is to end prior to the projected duration, employees will be provided with at least fourteen (14) calendar days’ notice. v. Employees will be required to use ten (10) hours of accrued leave time for each hour so workedday of sick or vacation used. vi. Employees will be granted eight (8) hours of pay of each paid holiday; however, the employee may use up to two (2) hours of vacation or compensatory time to supplement the eight (8) hours of holiday pay. A maximum of one-one hundred (100) hours of compensatory time may be accumulated unless the City Council has authorized up to one hundred twenty (120) hours for employees assigned to work on a special project basis or has authorized pay for compensatory time on a special project basis when funds are available for such purposes.
