Pay Upon Demotion. The salary of an employee who voluntarily demotes shall be placed on the salary step on which they would be if they had remained in the position. The salary of an employee who is demoted for disciplinary reasons from one classification to another which provides for a lower maximum salary, shall be the same step which the employee had before the demotion; however, the employee shall not be placed on a step which provides for a lower salary than the employee had prior to the promotion. Thereafter, the employee shall increase in accordance with Section 9.02 (Pay Progressions) of this article.
Pay Upon Demotion. The salary of an employee who voluntarily demotes or who is demoted for disciplinary reasons shall be at the salary step at which he/she would have been in the lower job classification if he/she had been serving in such lower classification during the period he/she served in the higher classification.
Pay Upon Demotion. The salary of an employee who demotes to a classification that provides for a lower maximum salary shall be determined as follows:
Pay Upon Demotion. When an Employee is demoted, his/her rate of pay shall be reduced to the rate of pay in the new classification which is next below the Employee’s present rate of pay.
Pay Upon Demotion. Employees who accept a voluntary demotion, or who are 27 involuntarily demoted, or for those who are demoted to a classification the employee formerly 28 occupied, shall be placed at the highest step in the new pay range that does not exceed the pay rate 1 that the employee received before the demotion. If the employee is receiving above-Step-10 merit 2 pay, such pay shall be considered when determining the new pay and the new pay may not exceed 3 5% above Step 10.
Pay Upon Demotion. Upon demotion, the base salary of the employee will be placed within the range of the assigned lower Pay Grade at a rate determined by the Employer. If the employee is promoted again within a twelve (12)- month period following the demotion, he/she will receive a promotional increase of five percent (5%) upon promotion, but will not receive an end of probation increase unless approved by the Director of Employee Services.
Pay Upon Demotion. (a) When an employee is voluntarily demoted, his/her pay will be established at a rate which does not exceed the present rate. If the rate falls between two steps, the salary will be adjusted to the lower of the two.
(b) When an employee is involuntarily demoted, the rate of pay shall not be reduced.
(c) The provision of this Article shall not apply in respect of demotion for disciplinary reasons.
Pay Upon Demotion. An employee who is demoted for disciplinary reasons shall be paid at a lower rate that is consistent with state regulations. No demotion may result in a decrease in a rate of pay greater than seventeen (17) percent. An employee who was promoted and is voluntarily or involuntarily demoted to their former class of employment shall be paid no less than the same rate of pay the employee was receiving one day prior to the promotion date plus any change in cost-of-living adjustments implemented by the employer during the probationary period.
Pay Upon Demotion a. An employee involuntarily demoted without personal cause shall maintain his/her rate of pay.
b. An employee demoted without personal cause but at his/her request shall maintain his/her rate of pay up to the maximum of the new pay band.
c. An employee demoted for cause (conduct and/or performance) shall have his/her pay reduced to the comparable point in the lower pay band. If an employee is demoted from one pay band to another, the Agency retains responsibility for ensuring assignments are commensurate with the new job description and classification.
Pay Upon Demotion. In the event an employee is demoted from a position in a higher pay grade to a position in a lower pay grade, either as a result of the posting and bidding provisions of this Agreement at Article 16 (New Regular Jobs and Vacancies) or the discipline provisions of this Agreement at Article 19 (Discipline and Discharge), the employee’s new rate of pay shall be the same relative distance between the lower pay grade’s minimum and maximum rates as the employee’s rate was in the higher classification. The provisions of this Section will become effective on the first day of the pay period immediately upon final approval of this Agreement by both Parties.
