Common use of PAID HOLIDAYS Clause in Contracts

PAID HOLIDAYS. (Articles 15.01 to 15.07 apply to full-time nurses only) 15.01 A nurse who otherwise qualifies under Article 15.02 hereunder shall receive twelve (12) paid holidays as designated in the Appendix of Local Provisions. In the event that the Provincial Government declares an additional holiday (such as Heritage Day) during the term of this Agreement, such holiday will be substituted for one of the above-mentioned holidays. The designation of the additional holiday for an existing holiday shall be subject to local determination and such designation shall not add to the present number of holidays. 15.02 In order to qualify for pay for a holiday, a nurse shall complete her or his full scheduled shift on each of the working days immediately preceding and following the holiday concerned unless excused by the Hospital or the nurse was absent due to: (a) legitimate illness or accident which commenced within a month of the date of the holiday; (b) vacation granted by the Hospital; (c) the nurse's regular scheduled day off; (d) a paid leave of absence provided the nurse is not otherwise compensated for the holiday. A nurse entitled to holiday pay hereunder shall not receive sick leave pay to which she or he may otherwise have been entitled unless she or he was scheduled to work that day. A nurse receiving WSIB benefits for the day of the holiday shall, subject to the above provisions, be entitled to the difference between the amount of the Workers' Compensation Benefits and the holiday pay. 15.03 Holiday pay will be computed on the basis of the nurse's regular straight time hourly rate of pay times the number of hours for a normal daily tour as set out in Article 13.01 (a). 15.04 Subject to Article 15.02: (a) Where a holiday falls during a nurse's scheduled vacation period, the nurse's vacation shall be extended by one (1) day unless the nurse and the Hospital agree to schedule a different day off with pay. (b) Where a holiday falls on a nurse's scheduled day off an additional day off with pay will be scheduled. 15.05 A nurse required to work on any of the foregoing holidays shall be paid at the rate of time and one-half (1-1/2) the nurse's regular straight time hourly rate of pay for all hours worked on such holiday subject to Article 14.04. In addition, the nurse will receive a lieu day off with pay in the amount of her or his regular straight time hourly rate of pay times the number of hours in a normal daily tour as set out in Article 13.01 (a).

(b) Where a nurse's birthday falls on another paid holiday, another day will be substituted as the birthday holiday. 19.08 (Article 19.08 applies to part-time nurses only) If a regular part-time nurse works on any of the holidays listed below, she shall be paid at the rate of time and one-half her regular straight time hourly rate (as set out in the Wage Schedule) for all hours worked on such holiday, subject to the application of Article 17.04 regarding hours worked in addition to her full shift. OPTIONS recognizes the following days as paid holidays: New Year's Day Labour Day Family Day (3rd Monday in February) Thanksgiving Day Good Friday Remembrance Day Victoria Day Christmas Day Canada Day (July 1st) Boxing Day (December 26th) Civic Holiday (1st Monday in August) Nurse’s Birthday 19.09 A shift that begins or ends during the twenty-four (24) hour period of the paid holiday, where the majority of hours worked falls within the holiday, shall be deemed to be work performed on the holiday for the full period of the shift.

If the day is not scheduled by that date, it will be assigned by the Supervisor. i) To qualify to be paid for a scheduled Paid Holiday a nurse must work her/his regular shift before and after such holiday unless she/he is on vacation, sick leave, or regularly scheduled day off. ii) A nurse normally scheduled to work may be paid for the nurse and Paid Holiday listed above for which they qualify that fall within the Hospital agree to schedule a different day off with payfirst week of an unpaid leave of absence. If the period of leave exceeds one (1) week, there will be no payment for any Paid Holidays falling during that leave. PAID HOLIDAYS. I For the purposes of this Agreement, the following shall be recognized as paid holidays: January 2nd Monday in February Good Friday Easter Monday Queen's Birthday Second Mon. in June July Civic Holiday Labour Day Thanksgiving Day December December In the event the Government of the Province of Ontario proclaims Heritage Day or some other day as a holiday, such holiday will replace the second Monday in February holiday. PAID HOLIDAYS. A nurse entitled to holiday pay hereunder shall not receive sick leave pay to which she or he may otherwise have been entitled unless she or he was scheduled to work that day. A nurse receiving WSIB benefits for the day of the holiday shall, subject to the above provisions, be entitled to the difference between the amount of the Workers' Compensation Benefits and the holiday pay. 15.03 Holiday pay will be computed on the basis of the nurse's regular straight time hourly rate of pay times the number of hours for a normal daily tour as set out in Article 13.01 (a). 15.04 Subject to Article 15.02: (a) Where a holiday falls during a nurse's scheduled vacation period, the nurse's vacation shall be extended by one (1) day unless the nurse and the Hospital agree to schedule a different day off with pay. (b) Where a holiday falls on a nurse's scheduled day off an additional day off with pay will be scheduled. 15.05 A nurse required to work on any of the foregoing holidays shall be paid at the rate of time and one-half (1-1/21 ½) the nurse's ’s regular straight time hourly rate of pay for all hours worked on such holiday subject to Article 14.04holidays. In addition, the nurse will receive a lieu day off with pay in the amount of her or his regular straight time hourly rate of pay times the number of hours in a normal daily tour as set out in Article 13.01 14.01. If a regular part-time nurse works on any of the holidays listed above, she shall be paid at the rate of time and one-half (a)1½) her regular straight time hourly rate for all hours worked on such holiday. 1. The Residence shall also provide to full time employees who have completed their probationary period, two (2) floating holidays. The two (2) floating holidays must be used before the end of fiscal year or be lost. Notwithstanding the previous paragraph, full-time nurses are entitled to only one (1) floating holiday during the first nine (9) months of their employment. 2. The Residence shall also provide to part time employees who have completed their probationary period, one (1) floating holiday. This provision does not apply to casual employees. 16.02 In order to be entitled to a paid day off, the nurse must report in to work for the shift scheduled on the business day preceding and following the statutory holiday in question, unless it is an authorized absence. 16.03 Lieu days off shall be granted within thirty (30) days of the date on which the holiday was observed to be taken on a day to be selected by mutual agreement between the Employer and the nurse. 16.04 When a statutory holiday falls on a scheduled day off, the nurse shall receive a lieu day to be taken in accordance with the terms set out in 16.03. When a statutory holiday falls during the nurse’s scheduled vacation period, the nurse in question shall be paid and shall not use a vacation credit for that day. 16.05 The Residence will endeavour to schedule a holiday designated for a Friday or a Monday to be an off day for a nurse scheduled to be off on the adjacent Saturday and Sunday. Conversely, the Residence will endeavour to schedule a holiday designated for a Friday or a Monday to be a work day for a nurse scheduled to work on the adjacent Saturday and Sunday.

The designation of the additional holiday for an existing holiday shall be subject to local determination and such designation shall not add to the present number of holidays. 15.02 In order to qualify for pay for a holiday, a nurse shall complete her or his full scheduled shift on each of the working days immediately preceding and following the holiday concerned unless excused by the Hospital or the nurse was absent due to: (a) legitimate illness or accident which commenced within a month of the date of the holiday; (b) vacation granted by the Hospital; (c) the nurse's regular scheduled day off; (d) a paid leave of absence provided the nurse is not otherwise compensated for the holiday. A nurse entitled to holiday pay hereunder shall not receive sick leave pay to which she or he may otherwise have been entitled unless she or he was scheduled to work that day. A nurse receiving WSIB benefits for the day of the holiday shall, subject to the above provisions, be entitled to the difference between the amount of the Workers' Compensation Benefits and the holiday pay. 15.03 Holiday pay will be computed on the basis of the nurse's regular straight time hourly rate of pay times the number of hours for a normal daily tour as set out in Article 13.01 (a). 15.04 Subject to Article 15.02: (a) Where a holiday falls during a nurse's scheduled vacation periodpossible, paid holidays will be taken on the nurse's vacation shall days they are observed. Where this is not possible, paid holidays will be extended allowed at such time as requested by one (1) day unless the nurse and approved by the Hospital, and, in any event, will be taken within sixty (60) calendar days before or after the day on which they are due unless otherwise mutually agreed. The Hospital agree will consider such requests having regard to schedule a different day off with paythe staffing requirements. Such requests will be responded to within three (3) weeks from the date of submission provided such nurse requests the paid holiday at least four (4) weeks prior to the requested time off. Such requests will not be unreasonably denied. (b) Where a paid holiday falls on a day scheduled as a day off, time off in lieu of such paid holiday will be allowed at such time as the Hospital may approve. Where this is not possible, paid holidays will be allowed at such time as requested by the nurse and approved by the Hospital, provided however, that such time off must be granted within sixty (60) calendar days of return to duty. The Hospital will consider such requests having regard to the staffing requirements. Such requests will be responded to within three (3) weeks from the date of submission provide such nurse requests the paid holiday at least four (4) weeks prior to the requested time off. Such requests will not be unreasonably denied. (c) Where one (1) or more paid holidays falls during an nurse's scheduled annual vacation, another day off an additional day off with pay or days appropriate will be scheduledadded prior to or following the annual vacation period. 15.05 A nurse required to (d) It is understood that nurses who work shifts commencing on any a holiday will receive a lieu day, and that there will not be a claim for more than one lieu day in respect of the foregoing holidays shall be paid at the rate a given holiday, or for both a lieu day and a holiday with pay. J-3 The premium pay of time and one-half (1-1/21 ½) the nurse's regular straight time hourly rate of pay provided in accordance with Article 15.05 will be paid for all hours worked between 0001 hours and midnight on such holiday subject to Article 14.04. In addition, the nurse will receive a lieu day off with pay in the amount of her or his regular straight time hourly rate of pay times the number of hours in a normal daily tour as set out paid holidays listed in Article 13.01 (a)J-1.
