Paid Leave Days. A. Employees will receive eight (8) sick and two (2) personal days per year. Once an employee has at least five (5) full years of service at the beginning of the contract year, the employee will receive ten (10) sick and two (2) personal days per year. Employees working the summer months will be awarded two (2) additional paid leave days at the beginning of each contract year. For payroll purposes, a day for purposes of this Article, shall refer to the number of hours the employee is regularly scheduled to work. Leave days may be utilized for the following purposes: 1. Illness or disability of the employee. 2. Medical or dental appointments of the employee, provided the employee cannot schedule the appointment outside of work hours. 3. Two (2) days may be utilized as personal days, subject to the following restrictions: a. Such days will not be approved on the workday immediately preceeding or immediately following a holiday or vacation period or for the first or last day of work calendar. Bargaining unit members may not use more than three (3) personal days consecutively. Friday and Monday are considered consecutive days. (b) If a bargaining unit member is entitled to worker’s compensation and is penalized by reaching the cap imposed by worker’s compensation guidelines, the District shall allow the employee to make up the salary difference using sick leave time so that his/her pay is 66 2/3 percent of gross or 80 percent of his/her regular net pay for a period of up to one year or 12 months.
5. Bargaining unit members shall be required to call their supervisor or designee at least two (2) hours prior to the start of their day when reporting ill, unless due to the circumstances, two hours notice cannot be given.
B. The bargaining unit member may use up to five (5) days for any death in the immediate family. Immediate family shall be defined as spouse, children, grandchildren and parents. This also includes step-children, step-parents and corresponding in-laws. The bargaining unit member may use up to three (3) days for the death of siblings, grandparents, aunts and uncles. This also includes corresponding step-siblings, grandparents, aunts, uncles and in-laws. The superintendent may, at his/her discretion, extend the funeral leave period provided that such extension shall not exceed the amount of accrued sick leave.
C. Leave with pay will be granted for an employee who is called for jury duty. The employee shall be compensated at his/her regular rate of pay, provided the employee remits any compensation (excluding mileage) received as a juror to the District.
D. An employee who is called as a witness in any case connected with the bargaining unit member's employment, shall be granted leave without loss of salary and/or paid leave time. Whenever an employee is subpoenaed to attend any other proceeding, the employee shall be granted one (1) day's pay if the employee is eligible for paid leave time under section A above, and has paid leave available. Employees shall not be eligible for pay to attend hearings where the employee is testifying against the District.

Paid Leave Days. A. Employees will receive eight 5.1 Bargaining unit members, as of the first instructional day of the school year, shall be credited with ten (8) 10) paid personal/family sick and leave days. Family is defined as the spouse of a staff member, his/her children, the parents of the staff member or of his/her spouse or any relative living within the staff member’s household. If any other situation arises with family members not defined above, the Superintendent may grant family illness days. The District may require a doctor’s note for use of personal illness days that exceed three (3) consecutive days.
5.2 Unused days shall accumulate up to a maximum of:
5.2.1 for those bargaining unit members whose accumulated leave totals exceed 167 days as of June 30, 1992, to 250 days.
5.2.2 for those bargaining unit members whose accumulated leave total is less than 167 days as of June 30, 1992, to 186 days.
5.2.3 bargaining unit members in category (b) above who use two (2) personal or less leave days per in any year may add that year. Once an employee has at least five (5) full 's unused days to their cumulative totals, without limit.
5.3 By October 1 each bargaining unit member shall be furnished with a report of his/her to- date earned accumulated days.
5.4 Days used shall be treated as days of service for purposes where days/years of service at the beginning of the contract yearhave application including, but not limited to: increment, seniority and retirement.
5.5 When schools are in session for only a half day, the employee will receive ten absence for that half day shall be charged as a half day of absence.
5.6 Any bargaining unit member whose personal illness extends beyond the period of accumulated sick leave may request a leave of absence, and such request shall be considered by the Board of Education. Such leaves of absence shall not exceed one (101) sick year and two (2) personal days per yearshall be without pay. Such days will not be approved on the workday immediately preceeding or immediately following a holiday or vacation period or for the first or last day of work calendar. 5.7 Bargaining unit members may on unpaid leave of absence shall retain their rights to health insurance (non-contributing by the Board). Upon the bargaining unit member's return, (s)he shall be placed upon the step (s)he would have been on had such sick leave not use been taken and shall be assigned to a comparable position to the one previously held. Under no circumstances shall the bargaining unit member be advanced more than three one step beyond that which (3s)he held when such leave was taken. Teacher bargaining unit members on unpaid leave will not lose tenure and the years toward sabbatical shall be stayed until such time as the teacher returns to active duties.
5.8 In the case of bargaining unit member's exclusion from school or hospitalization because of illness or contagious disease (including such maladies/illnesses as pink eye and lice, and excluding such maladies/illnesses as colds and influenza) personal caused by contact with a student or bargaining unit member in the school, accumulative leave shall not be charged and salary deductions shall not be made for the duration of the exclusion or such other period as the School Doctor shall certify as requisite or prudent.
5.9 The Board shall establish a sick bank of one (1) day for each employee, with said days consecutively. Friday and Monday are considered consecutive daysbeing placed in the sick bank on September 1st of each school year. The Superintendentpurpose of the Sick Leave Bank is to provide for extended sick leave for the tenured (Tenured status applies to new hires as of 7/1/06) bargaining unit member who suffers a non-work related serious illness, serious accident or serious disability thereby exhausting his/her agentsick leave. Disability which arises from pregnancy and childbirth shall be treated in the same manner as any other illness or injury. However, mayin no case shall the sick bank be used for family sickness or child care purposes. The sick leave bank shall be administered by a committee of trustees consisting of two teachers appointed by the HTA, at his/her discretion, make exceptions to and the above should an emergency arise.
