PARK DEDICATION. The Developer shall pay a cash contribution of $96,000 in satisfaction of the City’s park dedication requirements. The charge was calculated in accordance with Section 528 of the City’s subdivision regulations. The cash fee shall be payable prior to the City’s release of the signed final plat mylars.
PARK DEDICATION. Pursuant to State Statute and City Code, the Final Plat requires park dedication via a land dedication and/or a cash equivalent based on the rate approved by the City Council when the 3rd Addition Final Plat is released for recording. Certain land was provided to the City from the Developer as park dedication for Phase 1 of the Preliminary Plat resulting in a reduction in the City’s current park dedication per unit amount from $4,156.00 to $1,455.00, a 65% reduction. Assuming the 3rd Addition Final Plat is released prior to the City Council adjusting the park dedication rate, the park dedication amount to be paid shall be $24,735.00 (17 units times $1,455.00). If the 3rd Addition Final Plat is not released prior to the City Council adjusting the park dedication rate, the above-referenced payment shall be adjusted based upon the formula approved by City for the year in which the 3rd Addition Final Plat is released for filing. The park dedication fee, as set forth above, shall be paid prior to the Final Plat being released for filing at the Hennepin County Government Center. Park dedication for future phases of the Preliminary Plat shall be determined at the time of future phase final plat application and will be based on the then current park dedication rate adopted by the City Council adjusted by the above-described land dedication adjustment.

PARK DEDICATION. The Rush Hollow Project is located north of Highway 81, along Territorial Road bordered by Maple Grove Parkway and lies within the City’s Park Service Area 4. A neighborhood park is planned for this park service area. Pedestrian access to the planned regional trail system and neighborhood park are essential in connecting new residents to the many nearby park amenities. Pursuant to Statue Statute and City Code, the subdivision and development of the Property requires park dedication. Here, the park dedication shall be a combination of land dedication and cash equivalent. There is a need for approximately 3,309 lineal feet of City trail within the Rush Hollow Project that will connect to the planned regional trail system through the creek corridor extending from Elm Creek Park Reserve to the City of Dayton. The regional trail system throughout the creek corridor will have multiple creek crossings connecting to adjacent neighborhoods via City trails and eventually the neighborhood park to the west. The Plans show 1,862 lineal feet of trails built within existing utility easements and 1,447 lineal feet of trails in the new proposed outlots. The Plans identify outlots which include the Maple Grove park trail corridor, the regional trail corridor, and required storm drainage. The creek corridor in the Rush Hollow Project will serve as the future regional trail corridor for Three Rivers Park District (hereinafter referred to as the “TRPD”). The land making up Outlot R will be donated by the Developer to the City via warranty deed prior to release of the Final Plat and ultimately conveyed by the City to the TRPD as part of a land exchange agreement between the City and TRPD. Credit for the land dedication related to the City trails, is accounted for in the cash equivalent dedication calculation. The City’s Territorial Road Master Plan identifies a neighborhood park to the west of the Rush Hollow Project utilizing, in part, land currently owned by TRPD. The balance of the park dedication obligation would be paid in cash. The Rush Hollow Project consists of 447 single-family units for the Residential Project and 80 multi-dwelling units for Senior Project, for a total of 527 units. PARK DEDICATION. The Property is located within City Park Service Area 18. Residents of the Property are served by Hidden Xxxxxxx Park and various trail connections. The 2018 Parks System Plan identifies a future Playlot in City Park Service Xxxx 00. Connections to local and regional trail networks are planned just to the west and a possible playlot to the east of the Property as residential development continues. A roadside walking path along Xxxxxxx Xxxx will connect residents to the future park to the north and County Road 30 to the south.
