Part-Time Employees. ‌ 14.01 Subject to the limitations set out in this Article, the City has the right to grant a current or former employee’s request to work a part-time schedule. An employee will only be allowed to work a part-time schedule upon the approval of the Chief. A part-time employee in good standing whose position is to be filled with a full-time employee shall have the right to return to full-time status. 14.05 No employee working a part-time schedule may hold the rank of Sergeant. 14.06 Any request for a part-time schedule shall be made in writing to the Chief. Prior to making a request for a part-time schedule, a current or former employee must have completed a minimum of three and one-half (3½) years as a sworn officer with the Rapid City Police Department. 14.07 While working a part-time schedule, the employee shall attend all training required of full-time officers. 14.08 A current employee who requests and is approved for a part-time schedule shall have their seniority frozen as of the commencement of the part-time schedule. No seniority shall be earned as a part-time employee. A part-time employee whose employment is terminated shall lose his seniority. A part-time employee who returns to a full-time schedule shall have his seniority reinstated as the same level as it was when frozen.

(1) By agreement between employer and employee, the specified number of hours may be balanced over a week, fortnight and/or 4 weekly period, provided that the average weekly hours shall have be deemed to be the right specified number of hours for the purposes of accrual of annual leave, long service leave and sick leave. Provided further that there shall be no interruption to return the continuity of employment merely by reason of an employee working on a “week on, week off” basis in accordance with this subclause. 27.2 Permanent part time employees shall be paid an hourly rate calculated on the basis of one thirty-eighth of the appropriate rate prescribed by Clause 17, Salaries, of this Agreement and, where applicable, one thirty-eighth of the appropriate allowance or allowances prescribed by Clause 19, Special Allowances, of this Agreement, and one thirty-eighth of the appropriate allowances prescribed by Clause 23, Uniform and Laundry Allowances of this Agreement, but shall not be entitled to an additional day off or part thereof, as prescribed by subclauses 12(3) and 12(4)of Clause 12, Hours of Work and Free Time of Employees Other Than Directors of Nursing. 27.3 Where the employee is regularly working more than their specified contract hours they may request that their contracted hours are reviewed by their Manager. The Manager will formally respond to the request by the employee stating the reasons if the request is not agreed to. 27.4 Four weeks' annual leave applies to all permanent employees, unless they are deemed a shift worker as per Clause (8)- Definitions. Annual leave accrues progressively on a pro-rata basis and is paid on the ordinary hours. 27.5 Employees engaged under Part I of this clause shall be entitled to all other benefits of this Agreement not otherwise expressly provided for herein in the same proportion as their ordinary hours of work bear to full-time statushours. 14.05 No employee working a part-time schedule may hold the rank of Sergeant. 14.06 Any request for a part-time schedule shall be made in writing to the Chief. Part-Time Employees. ‌ 14.01 Subject 7.8.1 The Department Director or designee, subject to the limitations set out in this Article, regulation and control by the City has Manager or designee, shall determine the right to grant a current number of hours of work per work day and work week for part-time employees. The City will develop a process to distribute the hours of work among those existing part-time employees. Nothing herein contained, however, shall be construed to limit the right of the Department Director or designee, to determine the days of the week and hours of each day when such part- time employee shall be required to work. Further, nothing herein contained, shall limit the right of the Department Director or designee to determine the days of the week and hours of each day when any such part-time non-benefited employee shall be required to work, or whether such part-time non-benefited employee shall work at all. This section shall not be construed to require the City to offer a part-time schedule upon the approval employee any additional hours of the Chief. Section 4 Part-time employees will not be permitted to do delivery driving, feeder driving, or tractor-trailer driving work. Part-time employees will be permitted to move vehicles other than tractor trailers within the confines of the Employer’s property, only for the purpose of avoiding a delay in their work, except when drivers are available and not working. The movement of tractor-trailers in outlying centers shall be covered by past practice. When part-time employees are used in the car wash classification, they will be permitted to drive equipment to and from the car wash. Where there are full-time employees or combination full- time employees in the car wash classification, part-time employees will not drive. In Preload operations, having multiple starting times, when frozena starting time has been permanently vacated or a permanent new starting time created, the following procedure shall apply: The vacated starting time shall be assigned to the senior employee in the classification and work area who is qualified and has indicated in writing a desire for a different starting time. Any payments made to parttime employees under Article 7 31.04 Part-time employees shall not be hired for the purpose of eliminating full-time employees. The Employer may discharge a part-time employee for any reason and that discharge shall not be made the subject of a grievance. 31.05 Notwithstanding the provisions of Article 31.04, the following applies to part-time employees who have worked a total of five hundred (500) hours without any termination of employment other than a layoff and recall within six months. Except when work is not available or in circumstances beyond the control of the Employer, these part-time employees shall not be discharged by the Employer except for just cause. 31.06 The minimum basic salary under Schedule “A” for a part-time employee will, where applicable, take into consideration accumulated service on a pro-rated basis. The Employer shall keep records of hours worked by part-time employees and such records shall be made available to the Guild on request. When a part-time employee has worked 1,750 hours in a salary level, they will be filled notified by the Employer and moved to the next salary level in the classification. By February 1 of each year, the Employer will advise each part-time employee, who is not at the top salary level in their classification, in writing of the total number of hours worked from the date of the last salary upgrade (or, in the case of a new employee, from the date of hire) to December 31 of the previous year. If the employee does not agree with the total, the employee, upon their request, and the Employer will meet to review the documentation within thirty (30) days of receiving notification. 31.07 If a part-time employee is taken on by the Employer as a full-time employee shall have in a similar job in the right to return to full-time status. 14.05 No employee working a part-time schedule may hold the rank of Sergeant. 14.06 Any request for a part-time schedule shall be made in writing to the Chief. For such part-time employees, the company will pay a pro-rated portion of the required premium cost paid by the part-time employee. 31.10 In filling a full-time vacancy, any part-time employee who returns applicant shall be considered and shall be granted an interview unless the employee has had an interview in the past six (6) months. 31.11 In cases where the Employer plans to create a fullnew parttime position, the Employer shall notify the Guild in writing of the reasons for the new position at least 21 days prior to the filling of the position. 31.12 Part-time schedule employees who have worked 1,000 hours or more without any termination of employment will have seniority based on hours worked for the purpose of any layoff or recall of parttime employees. 31.13 For the purposes of recall, the Employer shall have his maintain a rehiring list of laid-off part- time employees and when hiring for part-time jobs shall first rehire persons from the list to their previous classification and location. Such persons shall be rehired in order of their seniority reinstated as except in cases where the same level as it was when frozenEmployer determines that the requirements, the efficiency and economy of operations and the qualifications, knowledge, training, skill and ability of the individuals to fill the requirements of the jobs available require otherwise. A laid-off part-timer remains on the list for six months from the date of layoff.

Any decision of the Chief regarding part-time scheduling shall be final and non-grievable, except that non-compliance with the limitations contained in the Article may be subject to a grievance. 14.02 For purposes of this Article, a part-time schedule is a regularly scheduled shift that is at least eight (8) hours per week but less than forty (40) hours per week. 14.03 The Chief may authorize up to implement four (4) employees hour shifts. Such persons shall be rehired in order of their seniority except in cases where the Employer determines that the requirements, the efficiency and economy of operations and the qualifications, knowledge, training, skill and ability of the individuals to fill the requirements of the jobs available require otherwise. A laid-off part-timer remains on the list for six months from the date of layoff. 31.14 The layoff and recall provisions of Articles 31.12 and 31.13 do not supersede the rights of full-time schedule employees under Article 6. 31.15 The Guild and a part-time employee with seniority will receive four weeks’ notice of layoff. A layoff occurs when a part-time employee with seniority is given a Record of Employment and is advised that no future work is anticipated for the employee. Part-Time Employees. ‌ Notwithstanding the other provisions of this Agreement, the category of part-time employee is established based on the following: 14.01 16.01 Subject to the limitations set out in this Article, the City has the right to grant a current or former employee’s request to work a part-time schedule. Part-Time Employees. Additional Shifts* 14.01 Subject (a) The provisions of overtime and call back shall not apply to the limitations set out in this Article, the City has the right to grant a current casual employee or former employee’s request to work a part-time schedule. Part-Time Employees. ‌ 14.01 Subject to the limitations set out in provisions of this Article, the City has the right terms of this Collective Agreement shall apply to grant a current or former employee’s request Part-Time Employees. 8.01 A part-time employee shall be assigned and committed to work for the number of hours as agreed to in writing at the time of employment or as subsequently revised by mutual agreement between the Centre and the employee.
