Deductions for other pro- grams may be filed by BTU-ESP with the Payroll Department. Employees who desire to become members of the BTU-ESP shall file their authorization form with the BTU-ESP. Pursuant to such authorization, the Board shall deduct such annual sum as authorized in equal payments according to a schedule mutually agreed to by the parties parties. 2. The State agrees to deduct FOP/MSLES membership dues and insurance premiums from the pay of those employees regular salary check, beginning with the first pay check who individually request in the pay period following date writing that such deductions be made. New employees eligible upon completion of six (6) months service may also have such payroll deduction during their initial six (6) month period. The employee's written authorization for new memberspayroll deductions shall contain the employee's name, agency in which employed, and work location. Such authorization shall continue be transmitted by an authorized representative of FOP/MSLES or the employee to the State Controller through the applicable agency payroll clerk. When such authorization is transmitted directly from the employee to the agency payroll clerk, a copy of the authorization shall be sent to FOP/MSLES. 3. Employees who have already authorized such deductions shall not be required to submit new authorizations upon the execution of this Agreement. 4. A validly executed authorization for payroll deduction is an agreement between the employee and FOP/MSLES. The State agrees that is shall rely solely upon FOP/MSLES for notice of such authorizations or cancellations or changes thereto. 5. FOP/MSLES shall notify the State Controller, through the applicable agency payroll clerk, or any such authorizations, cancellations or changes thereto. 6. It may take up to four (4) weeks to process a validly executed authorization for payroll deduction or cancellations or changes thereto. 7. Any change in effect from month the amounts to month, thereafter unless revoked be deducted shall be certified to the Director of the Bureau of Human Resources by the employees in writing to the BTU-ESP and to the Payroll Department, not less than Treasurer of FOP/MSLES at least thirty (30) days prior to in advance of the next payroll cutoff datechange. The aggregate deductions of all employees shall be remitted not less frequently than monthly submitted to the BTU-ESP, FOP/MSLES together with a list of members and the amount deducted year-to-date. Collection of dues missed because the Flight Attendant's earnings were not less frequently than sufficient to cover the payment of dues for a particular pay period, will be the responsibility of the Union and will not be the subject of payroll deductions. 8. Deductions of membership dues/service charge shall be made semi- monthly provided there is a balance in the paycheck sufficient to cover the amount after all other deductions authorized by the Flight Attendant or required by law have been satisfied. The deductions shall be remitted not less frequently than monthly to the BTU-ESP, with a list of members and the amount deducted year-to-date. The right to such dues deduction shall be granted exclusively to the BTU-ESP and shall not be granted to any other employee organization seeking to represent employees in the bargaining unit. The BTU-ESP shall notify the Payroll Department of the amount of any change in annual dues to be deducted not later than the last workday of the month prior to the month in which such change becomes effective. The BTU- ESP agrees to indemnify and hold harmless the Board, each individual Board Member and all administrators against any and all claims, costs, suits, or other forms of liability and all court costs arising out of the application of the provisions of this section1. Upon appropriate written authorization from the employee, the Board shall deduct from the salary of the employee employee=s wages and make appropriate remittance for annuities, credit union, savings bondsannuities, charitable donations, insurance, BTU-ESP special services programs, or and any other plans or programs jointly approved by the BTU-ESP Association and the Board. 2. Employees may authorize deduction of monthly membership dues, fees, assessments, and contributions to the Association=s PAC by completing the authorization form furnished by MEA. Nothing in this Article shall be interpreted or applied to require employee contributions to political action or similar funds of the Association or its affiliates. Such contributions shall only be made with annual written consent of the employee, on file with the Board, in accordance with the applicable statutory provisions. 3. During the life of this Agreement the Board agrees to deduct membership dues/fees from the pay of each employee who executes or who has executed the Dues/Fees Deduction Form and filed the same with the Board. The Board shall be entitled to rely solely on the written notice of the Association, as to the amount of dues/fees to be deducted from the employee=s wages and the employees from whom such deductions are to be made provided that the amount to be deducted shall be given to the Business Office at least three (3) weeks prior to the pay day on which deductions are to be made. Deductions for dues/fees shall not supersede any legally required deductions and the Board as shall not be required to make any check-off for dues/fees if the employee=s pay is not sufficient to cover the dues/fees in any pay period. 4. Deductions under all properly executed Dues/Fees Deduction Form shall become effective at the time the authorization is signed by the employee and shall be deducted from the first pay period of the month and each month thereafter unless and until the employee gives written notice of revocation for the deduction to the Board and the Association. 5. An employee shall cease to be subject to check-off dues/fees beginning with the month immediately following the month in which the employee is no longer a part member of this Agreement the bargaining unit or additional programs approved in which revocation is made under & A(4), above. MPSSPA will be notified by the Board that are not a part of this Agreementthe names of such employee(s) following the end of each month in which the termination took place.
