Common use of Personal Holidays Clause in Contracts

Personal Holidays. ‌ An employee may select one (1) workday as a personal holiday during the calendar year if the employee has been or is scheduled to be continuously employed by the state for more than four (4) months. A. An employee who is scheduled to work less than six (6) continuous months over a period covering two (2) calendar years will receive only one (1) personal holiday during this period. B. The Employer will release the employee from work on the day selected as the personal holiday, provided: 1. The employee has given at least fourteen (14) calendar days’ written notice to the supervisor. However, the employee and supervisor may agree upon an earlier date, and 2. The number of employees selecting a particular day off does not prevent the agency from providing continued public service. C. Personal holidays must be taken during the calendar year or the entitlement to the day will lapse, except that the entitlement will carry over to the following year when an otherwise qualified employee has requested a personal holiday and the request has been denied. D. Agencies may establish qualifying policies for determining which of the requests for a particular date will or will not be granted when the number of requests for a personal holiday would impair operational necessity. E. Part-time employees who are employed during the month in which the personal holiday is taken will be compensated for the personal holiday in an amount proportionate to the time in pay status during the month to that required for full-time employment. F. A personal holiday for full-time employees will be equivalent to their work shift on the day selected for personal holiday absence. G. Part or all of a personal holiday may be donated as shared leave, in accordance with Article 13, Shared Leave. A. An employee A nurse who is scheduled to work less than six (6) continuous months over a period covering two (2) calendar years will receive only one (1) personal holiday during this period. B. The Employer will release the employee nurse from work on the day selected as the personal holiday, provided: 1. The employee nurse has given at least fourteen (14) calendar days’ ' written notice to the supervisor. However, the employee nurse and the supervisor may agree upon an earlier date, and 2. The number of employees nurses selecting a particular day off does not prevent the agency from providing continued public service. C. Personal holidays must be taken during the calendar year or the entitlement to the day will lapse, except that the entitlement will carry over to the following year when an otherwise qualified employee nurse has requested a personal holiday and the request has been denied. D. Agencies may establish qualifying policies for determining which of the requests for a particular date will or will not be granted when the number of requests for a personal holiday would impair operational necessity. E. Part-time employees nurses who are employed during the month in which the personal holiday is taken will be compensated for the personal holiday in an amount proportionate to the time in pay status during the month to that required for full-time employment. F. A personal holiday for full-time employees nurses will be equivalent to their work shift on the day selected for personal holiday absence. G. Part or all of a personal holiday may be donated as shared leave, in accordance with Article 13, Shared LeaveWAC 000-00-000. Any portion of a personal holiday that remains or is returned to the employee, nurse will be taken in one (1) absence, not to exceed the work shift on the day of the absence, subject to the request and approval as described above in Subsections 10.3 B, C, and D above.D. H. Upon request, an employee a nurse will be approved to use part or all of their personal holiday for the care of family members as required by the Family Care Act, WAC 296-130. Any portion of a personal holiday that remains will be taken by the employee nurse in one (1) absence, not to exceed the work shift on the day of the absence, subject to the request and approval process as described above in Subsections 10.3 B, C, and D above. I. Upon request, an employee will be approved to use part or all of their personal holiday as provided for by the Military Family Leave Act, RCW 49.77. Any portion of a personal holiday that remains will be taken by the employee in one (1) absence, not to exceed the work shift on the day of the absence, subject to the request and approval as described in Subsections 10.3 B, C, and D above. J. Upon request, an employee will be approved to use part or all of their personal holiday as provided for by the Domestic Violence Leave Act, RCW 49.76. Any portion of a personal holiday that remains will be taken by the employee in one (1) absence, not to exceed the work shift on the day of the absence, subject to the request and approval as described in Subsections 10.3 B, C, and D above.D.

Personal Holidays. ‌ An employee may select one There shall be five (15) workday holidays for seniority employees known as a personal holiday during the calendar year if the employee has been or is scheduled to holidays. Employees presently in progression will continue in progression. Personal holidays shall be awarded by seniority within each classi- fication in each center and the following procedure shall apply: Any employee desiring a personal holiday during this period. B. The Employer will release make a request in writing on a form furnished by the Company. Such a request must be sub- mitted no later than the start of his/her their shift on the eighth (8th) calendar day preceding the day requested. A signed copy of the re- quest form stating approval or disapproval shall be returned to the employee from work on by the end of the next working day. In the event of an emergency, the notification period will be waived provided no other employee in that classification has requested that day selected as off. No personal holiday may be taken after the personal holiday, provided: 1Saturday after Thanks- giving or before December 26 of any year. The employee has given at least fourteen (14) calendar days’ written notice to the supervisor. However, the employee and supervisor may agree upon an earlier date, and 2. The number of employees selecting a particular day off does not prevent the agency from providing continued public service. C. Personal personal holidays must be taken during the calendar year or year. In the entitlement event employees elect not to take their personal holidays by December 31 they shall be paid eight (8) hours (ten (10) hours for four (4) day, ten (10) hour employees and four (4) hours for part-time employees) at their straight time rate for the unused personal holidays. Prior to the day Personal Holiday (PH) pay-out for unused Personals, the Com- pany shall determine those employees with unused PHs. If any such employees wish to utilize the unused PHs between December 26 and December 31, those PHs will lapsebe paid at time of use. If an employee works on an approved personal holiday, except that he/she they shall receive holiday pay plus time and one-half (1-1/2) for all hours worked or at the entitlement will carry over employee’s option he/she they may elect to the following year when an otherwise qualified employee has requested a personal holiday receive time and the request has been denied. D. Agencies may establish qualifying policies one-half (1-1/2) for determining which of the requests for a particular date will or will not be granted when the number of requests for a personal holiday would impair operational necessity. E. Part-time employees who are employed during the month in which all hours worked and retain the personal holiday is taken for future use. The Company will be compensated make available for the personal holiday in an amount proportionate to the time in pay status during the month to that required for full-time employment. F. A personal holiday for full-time employees will be equivalent to their work shift on the day selected for personal holiday absence. G. Part or all of a personal holiday may be donated as shared leave, in accordance with Article 13, Shared Leave. Any portion of a personal holiday that remains or is returned to the employee, will be taken in selection one (1) absencepersonal holiday per day in each center, not or a number equal to exceed the work shift on the day five percent (5%) of the absenceemployees in the center, subject to the request and approval as described in Subsections 10.3 B, C, and D above. H. Upon request, an employee will be approved to use part or all of their personal holiday for the care of family members as required by the Family Care Act, WAC 296-130whichever is greater. Any portion of a personal holiday that remains will be taken by the employee in one (1) absence, not to exceed the work shift on the day of the absence, subject to the request and approval as described in Subsections 10.3 B, C, and D above. I. Upon request, an employee will be approved to use part or all of their personal holiday as provided for by the Military Family Leave Act, RCW 49.77. Any portion of a personal holiday that remains will be taken by the employee in one (1) absence, not to exceed the work shift on the day of the absence, subject to the request and approval as described in Subsections 10.3 B, C, and D above. J. Upon request, an employee will be approved to use part or all of their personal holiday as provided for by the Domestic Violence Leave Act, RCW 49.76. Any portion of a personal holiday that remains will be taken by the employee in one (1) absence, not to exceed the work shift on the day of the absence, subject to the request and approval as described in Subsections 10.3 B, C, and D above.Example:

Personal Holidays. ‌ An employee Scheduling of Personal Holidays (PH): Employees receive their allotted PH(s) on January 1st of each year. Personal Holidays may select be scheduled through May 31st of the current calendar year. Once all vacation for the upcoming vacation year is scheduled and approved for all employees, then Personal Holidays may be scheduled through the rest of the year (June 1 – December 31) The Scheduling of Personal Holidays (PH) section shall be modified as follows: Employees may take their annual personal holiday(s) in either full day or half-day increments. The following conditions must be satisfied in order to use a personal holiday under this section. • The two (2) Personal Holidays are to be scheduled each year on an individual basis and will normally be approved one (1) workday as week in advance. In the event of an emergency, a personal holiday during the calendar year if the employee has been or is scheduled to request must be continuously employed by the state for more than four (4) months. A. An employee who is scheduled to work less than six (6) continuous months over made a period covering minimum of two (2) calendar years hours prior to the beginning of the employee’s shift. • Under normal circumstances partial personal holidays must be requested by the employee and submitted to the supervisor in writing, at least one (1) day in advance. • Requests for personal holiday time off must be approved by the Team Leader or his/her designee (subject to limitations defined under Article 21). • Partial personal holidays may be taken at the beginning or end of the scheduled shift as long as the employee works the remaining hours of his/her scheduled shift (any tardiness or partial day absence on the same day of a partial personal holiday shall automatically cause this scheduled personal holiday to be denied and charged as an absence under the Attendance Program) Personal Holidays will receive only be pro-rated for all employees as outlined below: • January through June hire date – two (2) personal holidays • July through October hire date – one (1) personal holiday during this period. B. The Employer will release the employee from work on the day selected as the • November through December hire date – zero (0) personal holiday, provided: 1. The employee has given at least fourteen (14) calendar days’ written notice to the supervisor. E. Part-time employees who are employed during the month in which the personal holiday is taken September will be compensated for the personal holiday in an amount proportionate eligible to the time in pay status during the month to that required for full-time employment. F. A personal holiday for full-time employees will be equivalent to use their work shift on the day selected for personal holiday absence. G. Part or all of a personal holiday may be donated as shared leave, in accordance with Article 13, Shared Leave. Any portion of a personal holiday that remains or is returned to the employee, will be taken in one (1) absence, not to exceed the work shift on the personal holiday upon successful completion of their 60th calendar day of employment with the absence, subject to Company. This does not negate the request and approval as described in Subsections 10.3 B, C, and D above. H. Upon request, an employee will be approved to use part or all probationary status of their personal holiday for the care of family members as required by the Family Care Act, WAC 296-130. Any portion of a personal holiday that remains will be taken by the employee in any way. The employee shall be required to complete the 120-day probationary period outlined in Article 10 of this Agreement. Employees who are hired in October will be eligible to use their one (1) absence, not to exceed personal holiday upon the work shift on the successful completion of their 60th calendar day of employment with the absenceCompany, subject as long as the 60 calendar days was completed prior to the request and approval as described in Subsections 10.3 B, C, and D above. Any portion of a personal holiday that remains will be taken by the employee in one (1) absence, not to exceed the work shift on the day of the absence, subject to the request and approval Leave as described in Subsections 10.3 B, C, and D above. I. Upon request, an employee will be approved to use part or all of their personal holiday as provided for required by the Military Family Leave Act, RCW 49.7749.77 and in accordance with Article 18.14; Military Family Leave or 3. Any portion of a personal holiday that remains will be taken by the employee in one (1) absence, not to exceed the work shift on the day of the absence, subject to the request and approval Leave as described in Subsections 10.3 B, C, and D above. J. Upon request, an employee will be approved to use part or all of their personal holiday as provided for required by the Domestic Violence Leave Act, RCW 49.76. Any portion of a personal holiday that remains will be taken by the employee in one (1) absence, not to exceed the work shift on the day of the absence, subject to the request and approval as described in Subsections 10.3 B, C, and D above.
