Phase-Out. Notwithstanding the restrictions set forth in Section 2.3(a)(ii), in order to facilitate the orderly transition from use in the P&M Technologies Business of CRANE-Formative Marks that incorporate a design comprising the word CRANE in a rectangular box (as depicted in Part 1 of Schedule 3) or any design similar thereto (the “Box Design”), Xxxxx Company agrees that Crane NXT and its Affiliates shall, for a period of five (5) years after the Effective Date (subject to Section 3.2), have the right to use the Box Design in any Trademarks containing or comprising the Box Design that are used in the P&M Technologies Business as of immediately prior to the Effective Date, solely in the P&M Technologies business, in substantially the same manner as so used as of immediately prior to the Effective Date. For clarity, Crane NXT and its Affiliates shall use the Box Design solely in accordance with the requirements set forth in Section 3.1. As soon as reasonably practicable after the Effective Date, and in no event later than the end of the foregoing five (5) year period, Crane NXT shall, and shall cause its Affiliates to, phase-out and cease use of the Box Design. All goodwill generated by Crane NXT or its Affiliates’ use of the Box Design pursuant to this Section 2.7 shall inure to the benefit of Crane Company and its Affiliates. Without limiting the foregoing or any other provisions of this Agreement, Crane NXT shall not, and shall cause its Affiliates not to, use the Box Design in any manner that reflects negatively on Crane Company or its Affiliates, or any of its or their Trademarks. Crane Company shall have the right to terminate Crane NXT’s and its Affiliates’ rights to use the Box Design under this Section 2.7, effective immediately upon notice to Crane NXT, if Crane NXT or its Affiliates use the Box Design in violation of this Section 2.7 in any material respect and does not cure such violation within sixty (60) days of written notice thereof.
Phase-Out. Prior to the completion of this contract, an observation period shall occur, at which time team management personnel of the incoming Contractor may observe operations. This will allow for orderly turnover of facilities, equipment, and records and will help to ensure continuity of services. The outgoing Contractor is ultimately responsible for performing full services IAW the contract, during the phase-out period, and shall not defer any requirements for the purpose of avoiding responsibility or of transferring, such responsibility to the succeeding Contractor. The outgoing Contractor shall fully cooperate with the succeeding Contractor and the Government, so as not to interfere with their work or duties.

Phase-Out. During the 60-day period immediately prior to the end of this contract, including options, if exercised, if the incumbent Contractor is not awarded the subsequent contract for these services, the incumbent Contractor shall permit its successor to observe and become familiar with all operations under this contract. The incumbent Contractor shall remain responsible and liable for all requirements of this contract to the final day of this contract. The Contractor shall not defer any requirements for the purpose of avoiding responsibility and transferring such responsibility to the successor Contractor or the Government. The incumbent Contractor shall fully cooperate with the successor Contractor and the Government, and shall not interfere with their work or duties to ensure a smooth transition.
Phase-Out. Germany, Belgium still on phase-out path – Germany and Belgium were both on phase-out paths, then changed plans, and then changed again. Germany had originally planned on phase-out after a government change in 1998, then cancelled the policy with a new government in 2009, but reinstated it in 2011. Germany has shut down 10 reactors since 2003. Belgium’s strategy has swung with changes of government to consider extension of current plants to retaining the 40 year limitation originally passed in 2003. The prohibition against new plants passed in 2003 has remained in force throughout the other changes. However, unlike Germany no plants have actually been retired since the policy was put in place. More recently, an additional operating life of 10 years was granted for the Belgian plants given underperformance in renewable energy deployment. A recent International Energy Agency review of Belgium critiqued the lack of a long-term energy policy, specifically siting the impact of the nuclear phase-out [48]. Both countries have also imposed new taxes on nuclear production to help pay for expansion of renewable energy. Sweden policy mostly negative, public opinion mostly positive – Sweden is currently operating nine reactors (9 GWe). After Three Mile Island, Sweden had a referendum on phase out of nuclear energy that resulted in a policy of operating current and under construction plants through end-of-life with no new construction. In 2010, this was modified to allow replacement construction at existing sites, but in October 2014 phase-out was again being implemented, even though less than a quarter of the population supports the position. On June 10, this position was again reversed when the government struck a deal with the opposition to allow replacement of existing reactors as they reach the end of their economic lifespans while abolishing the energy tax paid by nuclear energy producers [49]. The government imposes significant taxes and regulations on nuclear energy while providing significant incentives for renewables. Italy remains phased-out – Italy closed out its 4 reactor nuclear fleet following Chernobyl, with the last two plants shut down in 1990. There was considerable interest in reversing this decision due to high electricity costs, and a referendum was scheduled for June, 2011. Phase-Out. The annual contribution limit described in Sections I.B.1 and I.C is gradually reduced to $0 for higher income levels. In 2021, for a single Depositor, the annual contribution is phased out between adjusted gross income (AGI) of $125,000 and $140,000; for a married Depositor filing jointly, between AGI of $198,000 and $208,000; and for a married Depositor filing separately, between AGI of $0 and $10,000. Adjusted gross income is defined in section 408A(c)(3) and does not include XXX Conversion Contributions or any amount included in AGI as a result of a qualified rollover contribution. In the case of a joint return, the AGI limits in this Section I.B.2 apply to the combined AGI of the Depositor and his or her spouse.
