Physical or Mental ExaminationThe Superintendent agrees that, at the request of the Board, he will have a comprehensive physical and\or mental examination performed by one or more licensed physicians or psychologists of the Board's choosing during the term of this Contract. In deference to the requirements of the Americans with Disabilities Act and HIPAA, the physician’s report to the Board must address whether the Superintendent is able to perform the “essential functions” of his position.

The cost of the examination which is not paid for by the Superintendent’s insurance shall be paid by the district.
Physical or Mental Examination. If the request is job related and consistent with business necessity (such as a reasonable belief based on objective evidence that the Superintendent’s ability to perform the essential functions of his position may be impaired by a medical condition), the Board may require the Superintendent to undergo a physical or mental examination by a health care provider of the Board’s choosing. The health care provider will be asked to report to the Board whether the Superintendent is able to perform the essential functions of his position with or without reasonable accommodation.
Physical or Mental Examination. The Board may require Superintendent Xxxxxxxx to undergo a physical or mental examination by a physician and/or psychologist of its choosing. Any physician’s or psychologist’s report to the Board must address whether Superintendent Xxxxxxxx is able to perform the “essential functions” of his position.

Related to Physical or Mental Examination

  • Physical Examination The Employer, at its own expense, shall have the right and be given the opportunity to have a medical doctor appointed by the Employer examine, as often as it may reasonably require, any employee whose injury, sickness, mental or nervous disorder is the basis of claim upon this Plan.

  • Physical Examinations Where the Employer requires an employee to take a physical examination, doctor's fees for such examination shall be paid by the Employer. Except prior to commencement of employment and the first four (4) weeks of employment, such examinations shall be taken during the employee's working hours without loss of pay to the employee.

  • Medical Examination Where the Employer requires an employee to submit to a medical examination or medical interview, it shall be at the Employer's expense and on the Employer's time.

  • Physical Exams The Employer agrees to provide without cost to employees, physical examinations and/or other appropriate tests when such tests are deemed necessary by management to determine whether the health of employees is being or has been adversely affected by exposure to potentially harmful physical agents, toxic materials, or infectious agents, or by attacks and assaults. The Employer agrees to provide to each affected employee who requests it a complete and accurate written report of any such medical examination or other appropriate tests related to occupational exposure. Additionally, written results of an industrial hygiene measurements or investigations related to an employee's occupational exposure will also be provided, upon request, to the employee or the employee's authorized representative. The Union and/or members of the applicable Health and Safety Committee will be provided copies of summary reports, but such reports will not contain personally identifying information.

  • Medical Examinations An employee may be required by the Employer, at the request of and at the expense of the Employer, to take a medical examination by a physician of the employee's choice. Employees may be required to take skin tests, x-ray examination, vaccination, inoculation and other immunization (with the exception of a rubella vaccination when the employee is of the opinion that a pregnancy is possible), unless the employee's physician has advised in writing that such a procedure may have an adverse affect on the employee's health.

  • Examinations The Company has not received any notice that any Employee Benefit Plan is currently the subject of an audit, investigation, enforcement action or other similar proceeding conducted by any state or federal agency or authority.
