Police and Fire Protection. PERMITTEE shall fully reimburse the CITY at overtime and fringe benefit rates for all additional police and/or fire department officers who are assigned to the premises, or the vicinity thereof, because of the use or occupancy thereof by PERMITTEE.

The Fire 9 Station Sites shall be deeded to the City free of charge, in a 10 form acceptable to the City, and shall be free and clear of 11 liens or encumbrances. The Developer shall convey title to 12 the first Fire Station Site to the City within 180 days 13 following a request by the City. 14 (b) Prior to the construction of any development 15 exceeding 3 stories in height, one of the following scenarios 16 must occur within the 3-mile service delivery area: 17 (i) The operation of an aerial apparatus 18 available on a 24-hour, 7 days a week basis; or 19 (ii) The Developer has contributed a 20 proportionate share of the cost of an aerial apparatus based 21 upon approved non-residential development square footage and 22 residential units in excess of 3 stories within the service 23 delivery area (fire station within 3 miles). An agreement for 24 provision of service reached between the Developer and the 1 City with regard to proportionate share contributions may 2 supercede this condition at the City's election.

(b) The Developer shall reserve one (1) Fire Station Site acceptable to the City and County, containing up to four (4) upland acres in total, or 2.5 acres if the Developer provides for stormwater treatment, which shall be located within the Project. Prior to the commencement of Phase 2, the Developer shall work with the City and County to complete a station capacity and response time analysis. If the study determines a station is needed, the Developer shall then deed the reserved Fire Station Site to the City free of charge in a form acceptable to the City, and shall be free and clear of liens or encumbrances, following a request by the City. The Developer shall receive impact fee credit against Fire and Rescue Impact Fees for the donation of land as described herein, calculated in accordance with City Code. (c) The Developer, County and City shall use their best efforts to co- locate the Flagler County Sheriff’s Office sub-station and City of Palm Coast Fire Services.

Police and Fire Protection. The Government will provide routine police and fire services to the Contractor during normal dining facility operating hours. The Government will provide the Contractor with the available telephone numbers, addresses and procedures for respective military installation and local civilian sources.
Police and Fire Protection. 25.1 The Licensor shall not be responsible for providing fire protection nor for policing the Licensed Lands. The Licensee shall, at its sole cost, take all precautions to prevent fire from occurring in or about the Licensed Lands and shall observe and comply with all laws and regulations in force respecting fires at the Airport and with all instructions given from time to time by the Licensor with respect to the fires and the extinguishing of fires.
