Position Classified Downward. Until an incumbent appointed to a new classification with a lower rate of pay, is appointed to a position in her/his former classification or in a classification within the same Pay Band as her/his former classification, the Employee’s rate of pay will be as follows: i. If the Employee’s rate of pay is above the maximum of the Pay Band for the new classification, the Employee’s rate of pay shall be frozen until the rate of pay for the new lower classification equals or exceeds the Employee’s rate of pay; ii. If the Employee’s rate of pay is below the maximum of the Pay Band for the new classification, the Employee’s rate of pay shall be frozen until the Employee’s next increment at which time the rate of pay shall be adjusted to the next higher step in the scale for the new classification. The Employee would be eligible for further increments up to but not beyond the maximum. If, within two (2) years subsequent to the downward reclassification, an Employee is appointed to a position in her/his former classification or in a classification similar to and within the same Pay Band as her/his former classification, such Employee shall be placed at the step in the scale being paid before the reclassification, subject to any increments the Employee would have received had the Employee remained in that position.

  • Industry Classification Groups For purposes of this Agreement, the Borrower shall assign each Portfolio Investment to an Industry Classification Group. To the extent that any Portfolio Investment is not correlated with the risks of other Portfolio Investments in an Industry Classification Group, such Portfolio Investment may be assigned by the Borrower to an Industry Classification Group that is more closely correlated to such Portfolio Investment. In the absence of any correlation, the Borrower shall be permitted, upon prior notice to the Administrative Agent and each Lender, to create up to three additional industry classification groups for purposes of this Agreement.

  • New Classifications If a new classification is created within the bargaining unit, the Employer agrees to meet with the Union and negotiate a rate of pay for this new classification.
