Downward Reclassification a. When a position is reclassified to another class at the same pay level or to a class that carries a lower salary range, the incumbent trial service or regular employee shall be accorded corresponding status in the new class.
b. The Agency shall notify an employee in writing of a downward reclassification of the employee's position, and the specific reasons for doing so within thirty (30) days prior to the effective date.
c. When an employee is reclassified downward, the employee's rate of pay shall be the last salary rate earned in the salary range of the previous classification. It shall remain at that rate until a rate in the salary range of the new classification exceeds it, at which time the employee's salary shall be adjusted to that step and the salary review and eligibility date shall be established one (1) year from that date, provided the employee is not at the maximum of the salary range to which the employee was reclassified.

C. If an employee is reclassified downward and his/her rate of pay is above the maximum of the new classification, his/her rate of pay will remain the same until a rate in the salary range of the new classification exceeds it, at which time the employee's salary shall be adjusted to that step.
D. Employees who are reclassified downward will be eligible to apply for reemployment to the classification from which they were reclassified downward.

If the employee’s rate of pay is within the new salary range but not at a corresponding salary step, the employee’s salary shall be maintained at the current rate until the next eligibility date. At the employee’s next eligibility date, if qualified, the employee shall be granted a salary rate increase of one (1) full step within the new salary range plus that amount that his/her current salary rate is below the next higher rate in the salary range. This increase shall not exceed the highest step in the new salary range.
Downward Reclassification. Section 1. The Agency Personnel Department shall notify an incumbent employee and the Association in writing sixty (60) days in advance of a downward reclassification of a position and the specific reasons for the action.
Section 2. When an employee is reclassified downward, the employee's rate of pay shall be that of the last salary rate earned in the salary range of the previous classification. It shall remain at that rate until a rate in the salary range of the new classification exceeds it, at which time the employee's salary will be adjusted to that rate and the salary review and eligibility date will be established one (1) year from that date provided the employee is not at the maximum of the salary range to which the employee was reclassified.
Downward Reclassification. A) If a position is reclassified downward, the incumbent, if permanent in the position:
1. and whose salary rate exceeds the maximum of the lower salary range, shall retain the salary range in effect prior to the downward reclassification of their position. The employee shall not be entitled to any economic adjustment until such time as the maximum salary range for the lower classification level overtakes the maximum salary range retained under this subsection;
2. where her salary rate is equal to or less than the maximum of the lower salary range, she shall be placed in the lower salary range and be entitled to increments and economic adjustments;
3. if Permanent Full-Time or Permanent Part-Time, shall have her name placed on the respective service-wide re-employment list.
B) While an employee is on the re-employment list as a result of a downward reclassification, she shall earn increments in the higher salary range she retained.
C) If a position is reclassified downward and the employee is on initial probation or subsequent probation, the rate of pay shall be determined on the basis of the principle set out in Salary Adjustment on Demotion.
D) If, within two (2) years subsequent to the downward reclassification, an employee who retained their higher salary range, promotes into an occupation at the same or a lower classification level than her former occupation, they shall be entitled to return to their former rate in the higher range subject to any increments that they would have received had she remained in the higher position.
Downward Reclassification. No employee shall have his wages reduced as a result of downward reclassification. Such an employee's name shall be placed on a re- employment list for a class of positions similar to and with the same salary range as the position before it was downgraded.

Downward Reclassification. When an employee's classification is adjusted downward the employee will be placed at the highest step in the new range which does not exceed the former salary. If the former salary exceeds the top step in the new range, his/her wage rate shall be red-circled (frozen) for a period of twelve (12) months from the effective date of the reclassification or until such time as negotiated adjustments advance the top step of the range assigned to the lower classification to the point where it equals or exceeds the employee's red-circled rate – whichever occurs first. The employee shall then be placed at the top step of the range. The County and the Union may, by mutual agreement, decide on a different process by which to address red-circled employees.
Downward Reclassification. If a position is reclassified downward, the employee will be maintained at their current wage range until the wage rate for the reclassified position reaches the rate being paid to the reclassified employee.
