(h) Employees will be eligible to apply for jobs not coming within the scope of this Agreement and will receive consideration in accordance with their qualifications, experience and seniority. Posting and Filling Vacancies. The hiring supervisor will contact each of the unsuccessful internal applicants who were interviewed and offer to provide information as to the reasons they were unsuccessful and the knowledge, behavioural and technical skills, and experience that could be improved for future selection processes. 12.09. Any unsuccessful applicant may request a meeting with the hiring supervisor to identify the reasons for non-selection to a job. The unsuccessful applicant(s) may also have a Union representative at this meeting with the hiring supervisor. 12.10. Appointments from within the bargaining unit will be eligible made within three (3) weeks of the selection of a candidate unless otherwise mutually agreed by the parties. 12.11. Appointments may be made by mutual agreement between the Union and the Company without posting. 12.12. Where the estimated duration of a temporary position is ninety (90) calendar days or less, no posting will be required. Where the estimated duration of the temporary position exceeds ninety (90) calendar days, the temporary position will be posted. The duration of a posted temporary position will be set out in the posting and will be subject to apply the provisions of Clause 3.10. 12.13. In instances where a permanent employee is appointed to temporarily act in a managerial position for jobs not coming a period of twelve (12) months or less and the employee is reverted to their former position or an equivalent position within the scope of this Agreement and will receive consideration in accordance with their qualificationsagreement, experience and seniority. Seniority 13.01. When an employee achieves permanent status, their length of unbroken employment as a probationary, permanent, full-time temporary, and full-time provisional employee in positions coming within the jurisdiction of this agreement will determine their seniority standing. (i) Positions becoming vacant 13.02. When an employee achieves provisional status in accordance with the definition of provisional status, their length of unbroken employment as a result provisional employee in positions coming within the jurisdiction of foreseen retirement this agreement will determine their seniority standing relative to other provisional employees. In no event will a provisional employee have any seniority over a permanent or probationary employee; however, a provisional employee may be given a general priority over temporary employees. 13.03. Temporary employees will not have seniority standing. 13.04. If a permanent employee, has assumed a position outside the scope of this agreement and in accordance with Clauses 12.13. and 12.14. is reverted, their seniority will be posted thirty (30) days prior deemed uninterrupted including the period they were out of scope. It is understood that appropriate Union dues are to such vacancy occurringbe paid by the employee for the period they held an out of scope position. 13.05. Lists showing the seniority of permanent and provisional employees will be provided annually by the Company to the Union.

Vacancy postings at other times shall be available on the district’s electronic web page and can be accessed via email accounts, and/or the school messenger. 2. During the posting time employees may bid for a description vacancy by presenting to the Employer a written, signed notification of the position functionsdesire to apply for such job or vacancy. In filling the vacancy between equally qualified applicants who possess the appropriate qualifications, the Board agrees to give preference to current employees. When two (2) or more bargaining unit employees are equally qualified (considering merit, capacity and ability) for the position, preference will be given to the secretary with the greater seniority. This procedure shall not be required with respect to transfers or changes in work schedules, employee status, etc. 3. In order to be interviewed for a vacancy that is being filled through the posting and bidding process rather than through the transfer process a secretary must meet the minimum core qualifications as written in the job description and job posting. The Personnel Manager will notify a secretary not selected for an interview prior to the interviews. The affected secretary may meet with the Personnel Manager to discuss why an interview was not granted. 4. The Board agrees to make reasonable effort to complete the job interviews and job placements for vacancies within twenty (20) working days but in no event more than forty-five (45) working days after bid is closed. Employees will have a trial period of not more than thirty (30) work days in which to demonstrate the knowledge, skills and qualifications ability in the new position. At the end of such time the employee must have achieved efficiency. Employees who cannot meet the standards for the position, hours of work for the position, and the wage rate for the position. The Company position may include other information on the posting. (e) All applications will be addressed to the Company as indicated on the posting and will include the return address of the applicant. Internal applicants will also forward a copy of have their application to the Union office. (f) Appointments may be made trial period extended by mutual Agreement between the Union and the Company without a posting. (g) The Company will have the right to fill vacancies which result from reversions or terminations of employment during normal probationary periods or trial terms from among the original applicants without posting such vacancies. (h) Employees will be eligible to apply for jobs not coming within the scope of this Agreement and will receive consideration in accordance with their qualifications, experience and seniority. However, nothing in this Agreement will be deemed to bind the Company to appoint an employee to a job which does not come within the scope of this Agreement. (i) Positions becoming vacant as a result of foreseen retirement will be posted additional thirty (30) days prior work days. If during the trial period the Employer or the employee determines that the employee cannot qualify within such stated time, the employee shall be reassigned. The Board agrees to such vacancy occurringmeet with the Association to review the reason for the reassignment. Placement of the employee to another assignment will occur as follows: 1) Return the employee to the previous position, without prejudice; 2) Assign the employee to an existing vacant position provided the employee is qualified; 3) Assign the employee to cover a long-term leave of absence of a bargaining unit member; or 4) Displace the employee.

Posting and Filling Vacancies. For the purposes of this section “working days”, will be consecutive days, exclusive of Saturdays, Sundays or holidays observed by the Company. 12.01. Permanent Postings14:01 Posted Vacancies (a) Any Where a permanent or temporary vacancy required occurs, or a new permanent or temporary position is established, the Employer shall post a vacancy notice for a minimum period of eight (8) working days. The notice shall show a closing date for accepting applications and shall include information relevant to be filled the position (nature of position, wage rate, whether testing will be immediately and conspicuously posted for seven conducted). The job description relevant to the posting shall be available on the intranet, with a copy provided to any employee upon request. All vacancies advertised externally shall include a note indicating that the vacancy is a CUPE Local 2011 position. Only applications received before midnight on the closing date shall be accepted. If an appointment has not been made within sixty (760) calendar days, days from the closing date of the posting the Union shall be advised in a standard form provided by writing of the Companyreason for the delay. (ii) A temporary vacancy shall be defined as any vacancy that is greater than four (4) calendar months and less than three (3) years. (iii) Incumbents of such temporary appointments who have permanent status prior to the appointment will retain benefits; incumbents who have casual status prior to the appointment will continue to receive a percentage of wages in lieu of benefits as a result casual employee. (iv) If the temporary vacancy of foreseen retirement less than one (1) year, is encumbered by a casual employee, and is to be extended beyond one (1) year, it will be posted thirty extended without reposting and the incumbent will be deemed a Term Certain employee as per Article 1:05 effective the date of extension. All associated benefits will be effective on the adjustment date, in accordance with Articles 13 (30Seniority) days and 30 (Benefit Plans). (v) An employee in a temporary position that ends prior to such the posted end date will be provided two (2) weeks’ notice. If the employee is not given an opportunity to work the notice period they shall be paid for that portion of the notice period during which work was not made available. (vi) At the end of the term, internal staff posting into a temporary vacancy occurringbetween one (1) and three (3) years in duration, will return to their former status or position. (vii) At the end of the term, external staff hired into a temporary vacancy of between one (1) and three (3) years in duration shall be placed on the recall list for a period of not longer than twelve (12) consecutive months during which time they may make application, on the same basis as active employees, for vacant positions posted under Article 14. In the event that the effective date of the term certain position is terminated early, two (2) weeks written notice will be provided to the incumbent in the position. (viii) External staff hired into a temporary vacancy of less than one (1) year shall have casual status and be covered under Article 1:09
