Price Match. If at any time during the Term, NVE provides documentation of same goods currently available at a price lower than Supplier’s price to NVE then Supplier shall honor such lower price. Price comparisons will be based on final prices after all discounts and promotions have been applied. Shipping/delivery charges will not be included in the price comparison.
Price Match. If it is discovered that a product can be purchased from xxx.xxxxxxxx.xxx or from a Grainger Retail Store for a price lower than its current contracted pricing, Contractor shall match the lower price for all products that are an exact item match. Price match purchase must have the approval of the State Vendor Contract Manager, as a special request purchase shall be required.
Price Match. Anything contained in this Agreement to the contrary notwithstanding, if between the date of this Agreement and March 15, 2003, (i) any Purchaser, the Company and/or any designee of the Company, as applicable, consummate a transaction, subject to the limitation set forth in the last line of this Section 8.3, whereby any of them purchase Perficient Stock (a "Sale") and (ii) the aggregate proceeds per share to the seller in the Sale exceeds $.375 per share sold (as appropriately adjusted to take into account any stock splits, stock dividends or similar recapitalizations) (the highest such excess per share resulting from any Sale being referred to herein as the "Excess Amount"), then, on March 17, 2003, Seller shall be paid by each Purchaser by check or wire transfer (at Seller's option) cash in the amount equal to the product of the Excess Amount multiplied by the number of Perficient Shares purchased by such Purchaser from Seller under this Agreement. Notwithstanding the above, a Sale as defined herein shall only include transaction that result in the purchase of up to 600,000 additional shares of Perficient Stock, in the aggregate. Accordingly, the Seller shall only be entitled to receive the payment of any Excess Amount as a result of the purchase by the Purchaser, in one or more transactions, of the first 600,000 shares of Perficient Stock (if any) purchased after the date of the Closing.
Price Match. If the Program Price to Compare is set below both the combined Pricing for a multi-family, non-space heating class Member utilizing 5,000 kWh annually and the combined Pricing for a single family, non-space heating class Member utilizing 11,500 kWh annually during the Term of this Agreement only, Seller shall either (i) reduce the Pricing to match the Program Price to Compare or (ii) terminate this Agreement. In the event Seller has indicated to the City that Seller elects to terminate rather than matching the Program Price to Compare, then the City may request that the Seller continue to serve Buyer at the then-current Pricing and, if Seller agrees, Buyer shall continue to be served at the then-current Pricing described in 3(a) above. “Program Price to Compare” shall mean (1) the Utility’s “Price to Compare” for the residential non-space heating class, as posted on the ICC website (xxx.
Price Match. 11.3.1 If your welcome pack says that we will consider matching a competitor’s offer:
a. you may make a request to us under this clause 11.3; and
b. we will consider your request in accordance with this clause 11.3,.
11.3.2 You may ask us to match a competitor’s offer that is made to you for the premises covered by this agreement. When making this request you must give us the evidence of the competitor’s offer by providing us with a copy of the competitor’s written offer to you or full details of where the offer may be found online.
11.3.3 Once you have provided the details of the competitor’s offer that you are required to provide under clause 11.3.2, we will assess whether that offer is more favourable to you than the tariffs and charges and discounts applicable under this agreement at the time you request the comparison. We will conduct this comparison using your electricity usage at your premises covered by this agreement over the preceding 12 months (or if this agreement commenced less than 12 months ago and we have less than 12 months usage data for you, over the period that we have electricity usage data for you). For the purposes of the comparison, we will also assume that you receive all discounts for which you are eligible under this agreement and under the competitor’s offer.
11.3.4 If, after our assessment:
a. we determine that the competitor’s offer would have resulted in you paying less for electricity at the premises covered by this agreement over the period of the comparison; and
b. we do not agree to match the competitor’s offer for the relevant premises for the remainder of the fixed term of this agreement, then you may end this agreement without having to pay the early termination fee under clause 4.5.

Price Match. If it is discovered that a Guard Type can be provided from a competitor at a User Agency location for a price lower than its current contracted pricing, the Contractor shall match the lower price or the discounted margin when there is a cost savings to the User Agency (meaning the difference between the amount the competitor offers to bill to the agency and the wage rate they pay their employee shall be applied to the bill rate listed in Exhibit B), for all products and services that are an exact Guard Type match. Contractor must agree to the price match. When the User Agency is a State Agency a price match must have the approval of the State Contract Manager, as a special request purchase shall be required.
Price Match. If it is discovered that a product or service can be purchased from a competitor for a price lower than its current contracted pricing, the Contractor shall match the lower price for all products and services that are an exact match. For any pricing errors or overcharges discovered by either party, the Contractor shall reimburse the State in full for all overcharges. Additionally, the Contractor shall pay to the State an administrative fee of 15% of total purchase price for all items invoiced at incorrect pricing. The State shall pay Contract Price less 15% if any Contract items or services are removed without notification forcing substitutes to be purchased. Any pricing errors shall be corrected by the next business day of notification to the Contractor of the error. The Contractor shall provide a credit to the User Agency for pricing errors or penalty fees.
Price Match. If Kaival Labs locates Raw Materials for the Covered Products from a third party of an equal or greater quality at a cheaper price and/or on commercial terms more favorable than the Raw Materials offered to Kaival Labs by NGL (the “Favorable Raw Materials Terms”), then, NGL must match the Favorable Raw Materials Terms and deliver and sell the Raw Materials to Kaival Labs at the Favorable Raw Materials Terms.
