PROCEDURES FOR NEGOTIATING A MASTER AGREEMENT. ‌ The Board and the Association shall negotiate, per the requirements and pursuant to the process and procedure established by the Idaho Code, as to matters of Compensation to include salaries, benefits (insurance, leave time, and sick leave), description of the professional educator and what is expected including areas such as hours of work and parent contacts, RIF policy, Grievance policy, input into Board policy development for areas such as the calendar process, and committee participation.

PROCEDURES FOR NEGOTIATING A MASTER AGREEMENT. The Board and the Association shall negotiate, per the requirements and pursuant to the process and procedure established by the Idaho Code, as to matters of Compensation to include salaries, benefits (insurance, leave time, and sick leave), description of the professional teacher and what is expected including areas such as hours of work and parent contacts, RIF policy, Grievance policy, input into Board policy development for areas such as the calendar process, and committee participation. Negotiating sessions will be open and will be held on a regular basis at times and places mutually agreed to. The first order of business at each meeting will be to establish the date and time of the next meeting. Each negotiating team will consist of no more than four (4) persons at one time. Each team shall have the right to utilize the service of consultants during the negotiation, such consultants not to exceed four (4) in number. It is recognized that no final agreement between the parties may be executed without ratification by a majority of the Board and ratification by the Association, but the parties mutually pledge that representatives selected by each shall be endowed with all necessary power and authority to make a proposal, consider proposals, and make concessions in the course of negotiations in an attempt to reach agreement. In the event that the Board and Association are not able to come to an agreement in negotiations the issue or issues in dispute shall be submitted to mediation to resolve the conflict as per Idaho Code 33-1274. A mediator will be jointly selected by the Board and Association within 7 days of either party requesting mediation. Expenses related to the mediator shall be divided evenly between the Board and Association. The Board and Association agree to resolve the disputed item(s) through mediation.

  • PROCEDURES FOR CONDUCTING NEGOTIATIONS Either party may request negotiations for a successor Agreement by issuing a notice to negotiate to the other party between one hundred twenty (120) and ninety (90) days prior to the expiration of this Agreement. The State Employment Relations Board will also be notified of the intent to open negotiations at this time. Within fifteen (15) days of receipt of said notice, representatives of the parties shall meet and submit proposals for the successor Agreement. Said proposals shall be comprehensive in nature and no additional issues shall be introduced after the first session without mutual agreement. Subsequent bargaining sessions shall be set at times and dates as are mutually agreed to by the teams. Negotiation teams will be limited to five (5) members each. Both sides may agree to change this size by mutual agreement. Negotiation sessions shall be conducted in executive session; however, this does not prohibit the flow of information to either party’s constituency. The style of bargaining shall be mutually decided by the parties prior to negotiations. Upon request of either bargaining team, a bargaining session may be recessed to permit a caucus. When negotiations are conducted during regular school hours, release time shall be provided for the Association’s bargaining team. (Reference: Article 18) There shall be three (3) signed copies of the final agreement. One (1) copy shall be retained by the Board, one (1) by the Association, and one (1) shall be submitted to the State Employment Relations Board. As tentative agreement is reached on each issue, it shall be so noted and initialed by each party. When consensus is reached covering the areas under discussion, the proposed Agreement shall be reduced to writing as a tentative agreement and submitted to the Association and the Board for approval. Following approval by the Association and Board, a contract shall be entered into by both parties. The Association and the Board agree to abide by the terms of the Agreement. The final Agreement, as adopted by the Board and ratified by the Association, will be printed and presented within thirty (30) days. The cost of such printing, including labor and material shall be borne by the Board In the event an agreement is not reached after forty-five (45) days from the first bargaining session, either of the parties shall have the option of requesting the assistance of a federal mediator under the guidelines of the Federal Mediation and Conciliation Service. In the event that the services of a mediator are called upon, the mediation process will last twenty-one

  • NEGOTIATING PROCEDURE The Board agrees to make available to the Association when available to the Board information concerning the financial resources of the District, including but not limited to: annual financial reports and audits; register of Certificated personnel; tentative budgetary requirements and allocations; agendas and minutes of Board meetings; census data; names and addresses of all certificated employees; and public information available to the Board that will assist the Association in developing intelligent, accurate, informed, and constructive programs on behalf of certificated employees and their students. The District and the Association agree to meet prior to the setting of the district budget for the ensuing year in order to provide the Association with an opportunity to provide input on budgeting priorities.

  • NEGOTIATING PROCEDURES 4.01 A request for professional negotiations shall be submitted in writing by the SHTA to the Board or its designated representative or by the Board’s designated representative to SHTA before April 1 of the year (approximately 90 calendar days) of the expiration of the existing Agreement. A copy of the notice shall be filed with the State Employment Relations Board. A mutually convenient meeting shall be held by April 15th in which both parties shall exchange negotiation packages which shall include additions to, deletions from or revisions of the existing agreement.   • Negotiation; Alternative Dispute Resolution The Parties will attempt in good faith to resolve any dispute or controversy arising out of or relating to the performance of services under this Agreement. If the Parties are unable to resolve the dispute, then, pursuant to San Francisco Administrative Code Section 21.36, Contractor may submit to the Contracting Officer a written request for administrative review and documentation of the Contractor's claim(s). Upon such request, the Contracting Officer shall promptly issue an administrative decision in writing, stating the reasons for the action taken and informing the Contractor of its right to judicial review. If agreed by both Parties in writing, disputes may be resolved by a mutually agreed-upon alternative dispute resolution process. If the parties do not mutually agree to an alternative dispute resolution process or such efforts do not resolve the dispute, then either Party may pursue any remedy available under California law. The status of any dispute or controversy notwithstanding, Contractor shall proceed diligently with the performance of its obligations under this Agreement in accordance with the Agreement and the written directions of the City. Neither Party will be entitled to legal fees or costs for matters resolved under this section.
