Recognition and Negotiation. 3.01 The respective Employers recognizes the Canadian Union of Public Employees, respective Locals [ie. 835, 1933, 2525 and 4150] as the sole collective bargaining agent for the Employees of the Bargaining Unit. The Employer shall meet the representatives of the Union for the purpose of carrying out the terms of this Agreement.

Recognition and Negotiation. A. The employer hereby recognizes the Union as the sole and exclusive bargaining agent of the employees covered by this agreement for the purpose of collective bargaining with respect to rates of pay, wages, hours of employment and other conditions of employment. B. The term "Employee" as used herein shall include all paraprofessionals, employed or to be employed, excluding supervisors, student help, substitutes, crossing guards and volunteers.
Recognition and Negotiation. 3.01 The Division recognizes the Canadian Union of Public Employees and its Local 110 as the sole and exclusive bargaining agent for all employees of the Division set forth in the Manitoba Labour Board Certificate No. MLB 2627 dated the 4th day of January, 1974, and for those employees for whom the Division and the Union from time to time mutually agree upon. 3.02 No employee shall be required or permitted to make a written or verbal Agreement with the Employer or their representative which may conflict with the terms of this Collective Agreement. 3.03 The Division agrees that the bargaining unit shall have the right to assistance from representatives of the Canadian Union of Public Employees when negotiating or dealing with matters concerning the Agreement. Such representatives shall, with the prior approval of the Division, be given access to the Division's premises at a time mutually agreed upon. (a) Union representatives shall be granted necessary time off with basic pay to meet with the Division for the purpose of conducting negotiations subject to a maximum cost to the Division of maintaining salaries for up to seven (7) employees so engaged. (b) Union representatives shall be granted necessary time off with basic pay to meet with the Division for the purpose of processing grievances subject to a maximum cost to the Division of maintaining salaries for: (i) one (1) shop xxxxxxx so engaged when meeting with management in accordance with the grievance procedure (Article 13) and, should it be required, one Union executive member may attend provided that the cost of salary and benefits is paid by the Union for the Union executive member. (ii) six (6) employees so engaged when meeting with the Board of Trustees. (c) Time off for employees under Article 3.04(a) and (b) will be in addition to time specified in Article 22.01.

(a) Temporary employees are those individuals employed by the Corporation: 1. to replace a person transferred or seconded from the bargaining unit in accordance with Article 12.06; 2. to replace an employee absent: i. on a statutory leave of absence (vacation, parental, pregnancy leave, etc.), ii. due to illness/injury (including workplace-related illnesses and injuries), iii. on any other Employer-approved leave of absence, or 3. to perform special projects of up to twelve (12) months duration (or such other greater period agreed to by the Union); or 4. to provide additional assistance during periods of heavy workload for up to twelve (12) months duration (or such other greater period agreed to by the Union). (b) A temporary employee who remains in the employ of the Corporation for a period longer than those stipulated in 3.02 (a) above without the prior written approval of the Union, or who has been accepted by the Corporation as a regular full-time employee, shall thereupon cease to be considered a temporary employee. Should this occur, continuous service since the last day of hire, as a temporary employee shall be included in the computation of the employee's probationary period. (c) A temporary employee will be covered by Articles 1, 2, 3, 4, 5, 6, 7, 8, 12, 13.01(a), 13.01(c), 13.02, 13.03 (a), 13.03 (c), 13.04 (a), 13.04 (b), 13.04 (c), 14.01, 16.01, 20.01, 21.01, 23, 24, 25, 26, 27, 28, and Schedule “A” of the Collective Agreement. (d) A temporary employee will accumulate overtime when they work greater than 7 hours in a day or 35 hours in a work ...
