Professional Certification and Records. The Superintendent shall maintain at all times during the term of this Agreement valid and appropriate certification to act as a Superintendent of Schools in the State of Texas as prescribed by the laws of the State of Texas and the rules and regulations of the Central Education Agency and shall provide evidence of such certification to the Board upon request at any time. The Superintendent shall also provide evidence of educational attainment, degrees earned, previous professional experience and other records required for the personnel files of the District. Failure to maintain valid and appropriate certification shall render this Agreement void, and any material misrepresentation in any records provided to the District shall be grounds for termination.

Professional Certification and Records. The Board and District do hereby acknowledge that the Superintendent, as of the signing of this Contract, is not currently certified as a superintendent in Texas. The Superintendent does hereby agree to immediately pursue a valid certificate required to act as a superintendent as prescribed by the laws of the State of Texas and the rules and regulations of the Texas Education Agency and/or the State Board of Educator Certification and all other certificates required by law. The Superintendent shall have one (1) year from the original execution date of this contract to obtain a valid superintendent certificate. Pending the issuance of said certificate, Superintendent shall obtain and maintain a temporary permit to act as a superintendent. Subject to the above, the Superintendent shall at all times during the term of this Contract, and any renewal or extension thereof, hold and maintain valid and appropriate certifications or permits required to act as a superintendent as prescribed by the laws of the State of Texas and the rules and regulations of the Texas Education Agency and/or the State Board for Educator Certification and all other certificates required by law. The Superintendent shall provide evidence of such certifications or permits to the Board upon request at any time. The Superintendent is currently pursuing a valid certificate required to act as a superintendent as prescribed by the laws of the State of Texas and the rules and regulations of the Texas Education Agency and/or the State Board of Educator Certification and all other certificates required by law. Pending the issuance of said certificate, the District shall obtain a waiver from the Texas Commissioner of Education for the Superintendent to act as a superintendent in accordance with Sections 7.056 and 21.003 of the Texas Education Code. Within the time period of the superintendent certification waiver granted by Commissioner of Education, and in any event no later than twelve (12) months following execution of this Contract, the Superintendent shall complete the requirements necessary for standard certification and provide proof of standard certification to the District. Subject to this paragraph, this Contract, including any renewal or extension thereof, is conditioned on the Superintendent's obtaining and providing valid and appropriate certification, or other waiver, permit or authorization to act as a superintendent in the state of Texas as prescribed by the laws of the state of Texas and the rules and regulations of the Texas Education Agency and/or the State Board for Educator Certification. The Superintendent must also file any other records required for personnel files and payroll purposes. Failure to provide necessary certification or other required records shall render this Contract void. Any intentional material misrepresentation may be grounds for dismissal.
