Prohibited Waste Sample Clauses

Prohibited Waste. Customer warrants that, unless otherwise agreed under separate written agreement, no controlled, hazardous, toxic, or radioactive wastes or substances, as defined by applicable federal, state or local laws or regulations, will be placed in waste disposal containers. Prohibited wastes include, but are not limited to: paint; tires; batteries; free liquids, sludges, industrial process and pollution control process wastes; residue, contaminated residue and residuals from chemical spills or cleanups; liquids and sludges from septic tanks, food service grease traps and commercial laundries and car washes; biomedical waste; friable asbestos; non-friable asbestos; oil filters, cathode ray tubes, acetylene tanks, and other chemical equipment; and, waste produced from dismantling or demolition of industrial process equipment contaminated with chemicals. Customer agrees to indemnify, defend and hold Pot-O-Gold harmless from any and all claims, suits, damages, penalties, citations, fines, and liabilities for injury or death to persons or damages to property or the environment, arising out of a breach of this warranty or caused by Customer's waste containing hazardous or other prohibited waste.

Prohibited Waste. “Customer” agrees not to put any haz- ardous or toxic waste in the dumpster as it is against the law. All hazardous or toxic waste found in the dumpster will become the responsibility of the “Customer”. At Red Truck Recycling, Inc.’s discretion, Red Truck Recycling, Inc. may return the hazardous or toxic waste found in the dumpster and charge the “Customer” a $100 “Dry Run” fee. At Red Truck Recycling, Inc.’s discretion, Red Truck Recycling, Inc. may charge “Customer” a disposal fee for the hazardous or toxic waste found in the dumpster as detailed below in “Item Hazardous or toxic waste includes industrial waste, waste containing asbestos, septic tanks and waste, paint, cleaning solutions, biomedical waste, pesticides, solvents, automobiles, propane tanks, batteries of any kind, appliances with Freon (air conditioners, refrigerators, etc.), Freon aerosol cans, foam aerosol cans, electronics (TV’s, computers, monitors, com- puter parts, radios, etc.), hazardous waste (ballasts with PCB’s poles, railroad ties, clothing of any kind and household garbage. In Collier County, you cannot mix yard debris in a dumpster with any other waste.
Prohibited Waste. The Customer acknowledges and agrees that the following materials are strictly prohibited from being disposed of in the wheelie bins: • Hazardous waste, including but not limited to chemicals, paints, solvents, batteries, and asbestos. • Biohazardous waste, including medical waste, sharps, and infectious materials. • Electronic waste (e-waste), such as computers, monitors, vapes and other electronic devices. • Liquids, oils, flammable materials, explosives, and other dangerous substances. • The Customer shall be solely responsible for the proper disposal of any prohibited waste materials and shall indemnify the Provider against any claims, damages, or liabilities arising from the Customer's failure to comply with this provision.
Prohibited Waste. Charges apply for 5280’s response to Prohibited Waste and charges will be added for all 3rd parties that are engaged to properly and legally deal with any Prohibited Waste.
Prohibited Waste. “Prohibited waste” includes all products and materials which are banned from mixed waste disposal in California by one or more State agencies with legislative authority to make such determination, or which have been banned from disposal at the landfill receiving materials disposed at the Del Norte County Transfer Station. Prohibited wastes include, but are not limited to, hazardous wastes, untreated medical wastes, sharps, universal wastes, electronic wastes, and consumer electronic devices.
Prohibited Waste. Carts or bins containing Prohibited Wastes may be tagged for non-collection whenever such banned materials are discovered in a cart, bin, or debris box placed for Collection. If a cart, bin, or debris box is tagged for non-Collection, Contractor will clearly indicate on that tag what the customer must do (such as removing Prohibited Wastes from the cart or bin) to enable and arrange for the Collection of the acceptable materials placed in that cart or bin.

Nothing in this Contract shall be construed as a waiver of any provision of §00-000-000 C.R.S. Any term included in this Contract that limits Contractor’s liability that is not void under this section shall apply only in excess of any insurance to be maintained under this Contract, and no insurance policy shall be interpreted as being subject to any limitations of liability of this Contract.
