Pulling of Regular Days Off a. The Employer shall comply with this provision in any case in which it wishes to schedule a full-time employee to work on a regularly scheduled day off in order to meet business needs. b. In any such case, the Employer may not substitute the regular day off being pulled with another day off, unless the employee requests a substitution, in accordance with the process laid out in this sub-section. In all other cases, an employee who has a regular day off pulled shall be scheduled for a 6th day. c. Before pulling a full-time employee’s regular day off and assigning him/her a 6th day, the Employer will first seek qualified volunteers from the 6th Day volunteer list. d. The Employer will not pull the regular day off of any full-time dealer unless: i. All qualified part-time employees (excluding those who have signed the guaranteed vacation book) are scheduled to work the shift; ii. All qualified less senior employees with the same regular day off have been scheduled to work the shift (excluding those who have signed the guaranteed vacation book). e. Any full-time employee scheduled for a 6th day will be given the option of selecting a second day off (for a total of two) from the pool of available days off as identified by the Employer. Any full-time employee who wants to exercise this option of selecting a second day off will be required to do so by contacting the scheduling office, or in the case of a poker sub-department employee by completing and submitting a time-stamped general purpose form, and making his/her selection within seventy-two (72) hours of the posting of the schedule for any given week. The failure to do so acts as a forfeiture of this option. In all cases, available days off shall be offered on a first-come, first-serve basis. ―Available days off‖ shall mean any day on which the Employer has another qualified bargaining unit member who is available to be assigned to the 6th shift being declined by the full-time employee.

  • Processing of a Grievance It is recognized and accepted by the Union and the Employer that the processing of grievances as hereinafter provided is limited by the job duties and responsibilities of the employees and shall therefore be accomplished during normal working hours only when consistent with such employee duties and responsibilities. The aggrieved employee and a Union representative shall be allowed a reasonable amount of time without loss of pay when a grievance is investigated and presented to the Employer during normal working hours provided that the employee and the Union representative have notified and received the approval of the designated supervisor who has determined that such absence is reasonable and would not be detrimental to the work programs of the Employer.
