Purpose of the Agency. Each Member to this Agreement has in common the power to study, plan, develop, finance, acquire, construct, maintain, repair, manage, operate, control, and govern water supply projects and/or exercise groundwater management authority within the Basin either alone or in cooperation with other public or private non-member entities, and each is a local agency eligible to serve as the GSA in the Basin, either alone or jointly through a joint powers agreement as provided for by SGMA. This Agreement is being entered into in order to jointly exercise some or all of the foregoing common powers, as appropriate, and for the exercise of such additional powers as may be authorized by law in the manner herein set forth, in order to effectuate the purposes of this Agreement. The purpose of the Agency is to form a GSA to manage groundwater in the Basin and to develop, adopt, and implement the GSP for the Basin pursuant to SGMA and other applicable provisions of law.

The Agency is also formed for the purpose of pooled financing or borrowing and the establishment of a pooled loan project to be utilized by the Agency and the undersigned parties and other governmental entities for all costs incurred or to be incurred by the Agency and the undersigned parties and other governmental entities, including any costs relating to any project designed or intended to decrease the costs of the utility system of the Agency, the undersigned parties or other governmental agencies or to increase the capacity or reliability of such utility system, including, without limitation, costs incurred in connection with the planning, engineering, designing, acquiring, leasing, constructing, installing, financing, operating, maintaining, retiring, decommissioning or disposing of (A) any part of the Agency’s or the undersigned parties' or other governmental entities’ electric, water, wastewater, waste or refuse disposal, telecommunications, resource recovery or gas systems or any other utility system of the Agency or the undersigned parties or other governmental entities permitted by law, (B) any part of an electric, water, wastewater, waste or refuse disposal, telecommunications, resources recovery or gas facility or of any other utility facility in which the Agency or the undersigned party or other governmental entity has a joint ownership interest, or (C) any project entered into by the Agency permitted by law. Purpose of the Agency. 8.2.1 The purposes of the Agency will be to: a. implement the purpose of this Agreement as set out in clauses 2.1.1.b and 2.1.1.c; b. monitor performance of the commitments made by the Parties under this Agreement, provide recommendations to the Parties and comment on socio- economic impacts arising from the Project; c. provide an ongoing forum for meaningful participation and involvement by the Parties; d. monitor the success of mitigation measures and commitments by: i reviewing monitoring reports submitted pursuant to this Agreement; ii considering comment and observations of socio-economic impacts from the Aboriginal Authorities and the public; iii considering the results reported in i) and ii) in the context of information relating to employment practices, human resource development, business development, social well-being and cultural well-being, and other related matters contemplated by this Agreement; e. make recommendations to the Parties respecting adaptive mitigation measures for achieving the purposes and commitments of this Agreement; f. issue an annual report on the results of the Agency’s work set out in this clause 8 and in clauses 9 and 10 and present the report at an annual public meeting.
