Re-alignment of Duties and Establishment of New Position. When the duties of a position covered by this Agreement are changed or when a new position appropriately covered by this Agreement is established, notification of the change and the job description will be forwarded to the Union and the salary shall be negotiated. If the parties are unable to agree, such a dispute may be submitted to arbitration. The salary shall be retroactive to the time the position was first filled by the nurse.

(a) The employer will schedule sixteen (16) hours off between shifts on the master schedule, should the employer schedule with less than sixteen (16) hours off between shifts the employee will receive one and a half times the nurse’s regular rate of pay for the short shifting.
(b) The employee has the right to refuse any shifts with less than sixteen (16) hours off between shifts. Should a nurse accept a call-in for 7.5 hour shift which results in him/her having less than sixteen (16) hours off between shifts the premium pay identified in paragraph (a) above does not apply.
(c) Where the nurse works with fourteen (14) hours, or less between shifts as a result of working approved overtime, or having been called-in prior to the normal start time of a shift the nurse will receive one and one half times their regular rate of pay.

(b) The Employer agrees to cooperate with the recommendations of the physicians and the Workplace Safety and Insurance Board in order to accommodate internal measures for nurses who were recovering from compensation.
