– Record keeping and approval process (a) The employer and employees shall discuss any proposed majority flexibility in the ECC prior to seeking the approval of the affected employees. (b) The Union, as the bargaining representative covered by this agreement, must be given a reasonable opportunity to participate in negotiations or discussions regarding the proposed making, variation or termination of a majority flexibility arrangement which results in a variation to the application of this agreement. Participation by the Union or any other representative does not mean that their consent is required prior to reaching agreement in relation to a majority flexibility arrangement. (c) Any proposed majority flexibility arrangement must be recorded in writing before being offered to the affected employees for consideration. (d) If a proposed majority flexibility arrangement is approved by a majority of affected employees, a copy of the arrangement must be provided to each affected employee, and a record of the arrangement and the method of its approval must be retained in the time and wages records of the affected employees. 10(1) 11(1)(a) 11(3)(f) 11(4) 11A(1)(b) Compliant with implementation feedback Whilst this clause, on its face, is not inconsistent with section 11, its implementation may result in conduct that is a breach of the Building Code 2016. The implementation of the clause may result in conduct which is not compliant with the Building Code if the clause is applied in such a way: • As to provide for terms, conditions or benefits of employment of employees of the employer; • That are not contained in an agreement that is registered, and applies to the employer and its employees; or • As to provide for such terms in an agreement that is not a common law agreement made between an employer and an individual employee. 401 Flexible application of agreement provisions by majority consent – Provisions which may be subject to a majority flexibility arrangement (a) Any provision of this agreement which specifies that its application may be varied by a majority agreement may be the subject of a majority flexibility arrangement in respect of all, or part, of the workplace.   • Submission and Approval The Contractor’s Submittals must comply with the Contract Documents. The Contractor shall review and approve all Submittals prior to submission. The Contract Documents shall specify when shop drawings or submittals require the seal of a specialty consultant. The Contractor shall submit copies of Submittals as required by the Contract Documents for the Work of the various trades. The Design Professional shall review, approve, or take other appropriate action with respect to shop drawings, samples, or other submissions of the Contractor, including, but not limited to, confirming conformance with the design concept of the Project and with the Contract Documents. The Design Professional shall respond to and return said items to the Contractor within fourteen calendar days from receipt provided that the Submittals are submitted by the Contractor in accordance with the required Submittal schedule. The Design Professional shall review and give comment or approval to Submittal schedule within fourteen calendar days from receipt. Large submittal documents may require longer review times, e.g., submittals with over fifty sheets of drawings. If, because of events beyond its reasonable control, the Design Professional is not able to meet the specified time period, then it is entitled to ask for additional time from the Owner. The Contractor shall make all corrections required by the Design Professional and furnish such corrected copies as may be needed. If the Contractor believes that any corrections required by the Design Professional constitute a change to the contract, the Contractor shall immediately notify the Design Professional and Owner and request instructions. By forwarding the approved Submittals to the Design Professional, the Contractor represents that the Contractor has determined and verified materials, field measurements, and field construction criteria related thereto, or will do so, and has checked and coordinated the information contained within such Submittals with the requirements of the Work and of the Contract Documents. The Design Professional’s approval of Submittals shall not relieve the Contractor from the responsibility for errors of any sort in Submittals or schedules. The Contractor shall perform no portion of the Work for which the Contract Documents require Submittals until the Design Professional has approved the respective Submittal. The Contractor shall maintain at the Site one copy of all approved Submittals.

  • Cloud Computing State Risk and Authorization Management Program In accordance with Senate Bill 475, Acts 2021, 87th Leg., R.S., pursuant to Texas Government Code, Section 2054.0593, Contractor acknowledges and agrees that, if providing cloud computing services for System Agency, Contractor must comply with the requirements of the state risk and authorization management program and that System Agency may not enter or renew a contract with Contractor to purchase cloud computing services for the agency that are subject to the state risk and authorization management program unless Contractor demonstrates compliance with program requirements. If providing cloud computing services for System Agency that are subject to the state risk and authorization management program, Contractor certifies it will maintain program compliance and certification throughout the term of the Contract.

  • Review and Approval Documents specified above must be submitted for review and approval by CITY Purchasing and Contracts prior to the commencement of work by CONTRACTOR. Neither approval by CITY nor failure to disapprove the insurance furnished by CONTRACTOR shall relieve CONTRACTOR of CONTRACTOR’S full responsibility to provide the insurance required by this Contract. Compliance with the insurance requirements of this Contract shall not limit the liability of CONTRACTOR or its sub-contractors, employees or agents to CITY or others, and shall be in addition to and not in lieu of any other remedy available to CITY under this Contract or otherwise. CITY reserves the right to request and review a copy of any required insurance policy or endorsement to assure compliance with these requirements.
