Registration and Inspection. All collection vehicles used by Contractor to provide service within the City are to be registered with the California Department of Motor Vehicles and shall be subject to an annual California Heavy Duty Vehicle Inspection, smog check certifications, and such other safety inspections as may be required under the California Vehicle Code. Contractor shall keep and maintain a vehicle maintenance and inspection log for each collection vehicle. Upon request of the City but not more frequently than annually, Contractor shall provide the City with a copy of the vehicle maintenance log, smog check certifications, and any safety compliance report issued pursuant to California Vehicle Code § 34500, within five (5) business days of the request.
Registration and Inspection. The provision of the Services shall, as it is required, be registered in accordance with the Care Standards Xxx 0000 to provide the Services to Service Users for the Agreement Period and the Service Provider shall at all times hold a full current valid registration certificate under the Care Standards Xxx 0000. The Service Provider shall promptly inform the Authority of any inspection, evaluation or assessment whatsoever in relation to the Service Provider or the Services including any risk evaluation by the Care Quality Commission and its successor bodies. For the avoidance of doubt, the costs associated with registration, inspection and regulatory compliance under this clause 5 shall be borne by the Service Provider; The Service Provider shall make available to the Authority a copy of inspection reports and complaints reports as soon as reasonably practicable after they are available to the Service Provider. The Service Provider will authorise the appropriate Registration Authority in writing to send to the Authority copies of any notices sent to the Service Provider under the Care Standards Xxx 0000 or letters concerning any matters deemed by the Registration Authority to be breaches of the relevant Regulations. In the event that a formal warning is received by the Service Provider from the Registration Authority in respect of the Services, then the Service Provider shall forthwith provide to the Authority a copy of such formal warning and any other relevant documentation which the Authority may reasonably require. The Service Provider shall in addition prepare an action plan to be approved by the Authority setting out the steps it intends taking to ensure that the deficiencies referred to in the formal warning are remedied. The Service Provider shall make any amendments to the action plan reasonably required by the Authority and shall be responsible for the implementation of the action plan in consultation with the Authority.
Registration and Inspection. It is a requirement of keeping bees on an allotment that the tenant belongs to The British Beekeepers Association (xxx.xxxxxxxxxx.xxx.xx) or local registered association, which is affiliated to the BBKA. Proof of membership (which should include insurance) and training course(s) undertaken will be required. All hive equipment must have contact information prominently displayed. Representatives of Bishops Stortford Town Council or Bishops Stortford Allotment & Garden Association have the right to inspect the bees at any time. If the Council has cause to investigate complaints of nuisance, costs of official inspections will be passed to the tenant for payment. BEE ENVIRONMENT Bees must only be kept in the designated area. Beekeepers must liaise with a representative of Bishops Stortford Town Council to ensure that sufficient screening (eg at least 6’ high netting, natural hedging, wooden fencing etc.) is in place to allow the bees a high enough flight path. It is the beekeepers responsibility to provide this if necessary. The hives should be sited sheltered from wind. Hives should not be placed under trees, which could cause damp conditions. Beekeepers should not put colonies of bees known to be of an aggressive temperament on allotments. HEALTH Protective beekeeping clothing must be worn. NUSIANCE TO NEIGHBOURS AND CLEANLINESS Beekeepers should not use the designated allotment area as storage space for keeping equipment that does not contain bees. No wax comb should be left exposed in an apiary, it must be stored in a bee proof way. Allotment tenants have a duty as part of the Allotment Tenancy Conditions not to cause a nuisance to others. In the keeping of bees on an allotment site, tenants should take all reasonable measures to minimise potential nuisances. BEES FOR PROFIT Allotment tenants are not permitted to profit from the sale of produce on the allotment site. NOTE

  • Visitation and Inspection The Borrower will, and will cause each of its Subsidiaries to, permit any representative of the Administrative Agent or any Lender to visit and inspect its properties, to examine its books and records and to make copies and take extracts therefrom, and to discuss its affairs, finances and accounts with any of its officers and with its independent certified public accountants, all at such reasonable times as the Administrative Agent or any Lender may reasonably request after reasonable prior notice to the Borrower; provided that (a) so long as no Event of Default shall have occurred and be continuing, the Administrative Agent and the Lenders shall not make more than one (1) such visit and inspection in any Fiscal Year; (b) if an Event of Default has occurred and is continuing, no prior notice shall be required and the limitation on the number of visits and inspections shall no longer apply; (c) any such inspection and examination, copies and discussions shall not be permitted to the extent it would violate confidentiality agreements or result in a loss of attorney-client privilege or claim of attorney work product so long as the Borrower notifies the Administrative Agent of such limitation and the reason therefor; and (d) any such inspection and examination, copies and discussions shall be subject to the terms of any applicable Master Lease and the accompanying Collateral Access Agreement.

Each of the foregoing inspections shall be made subject to compliance with applicable safety standards and the same conditions applicable to any Restricted Person in respect of property of that Restricted Person on the premises of Persons other than a Restricted Person or an Affiliate of a Restricted Person, and all information, books and records furnished or requested to be furnished, or of which copies, photocopies or photographs are made or requested to be made, all information to be investigated or verified and all discussions conducted with any officer, employee or representative of any Restricted Person shall be subject to any applicable attorney-client privilege exceptions which the Restricted Person determines is reasonably necessary and compliance with conditions to disclosures under non-disclosure agreements between any Restricted Person and Persons other than a Restricted Person or an Affiliate of a Restricted Person and the express undertaking of each Person acting at the direction of or on behalf of any Lender Party to be bound by the confidentiality provisions of Section 10.6 of this Agreement.

  • Audits and Inspections At any time during normal business hours and as often as the CITY may deem necessary, there shall be made available to the CITY for examination all of CONTRACTOR’S records with respect to all matters covered by this Agreement.
