Reimbursement of Lost Time. Any Settlement Class Member may submit one or more Claims for reimbursement for Lost Time related to the Data Security Incident, up to an aggregate total of $1000.00 per Settlement Class Member. A Settlement Class Member may submit a Claim regardless of whether the Settlement Class Member takes advantage of the Settlement Offer and regardless of whether the Settlement Class Member submits a claim for documented Economic Losses. A Settlement Class Member is eligible for the payment provided in this section in addition to, and on top of, any payment for documented Economic Losses. Reimbursement of Lost Time. All Settlement Class Members may submit a claim for reimbursement of Lost Time up to five (5) hours at thirty- five dollars ($35) per hour. Settlement Class Members can receive reimbursement of Lost Time with an attestation that the time spent was in response to the Data Security Incident. A claim for Lost Time may be combined with a claim for reimbursement for Out-of-Pocket Losses, but in no circumstance will a Settlement Class Member be eligible to receive more than the $7,500.00 individual cap.

Settlement Class Members may receive up to three (3) hours of lost time if the Settlement Class Member (i) attests that claimed lost time was spent responding to issues raised by the Data Incident; and (ii) provides a checkbox style description, or written description if no checkbox is applicable, of how the claimed lost time was spent related to the Data Incident. Claims for reimbursement of lost time may be combined with claims for documented out-of-pocket expenses and documented fees for credit reports, credit monitoring, or other identity theft insurance products and are subject to the same $300 cap.

  • Reimbursement of Costs Incurred The Contractor agrees to reimburse the Authorized User promptly for any and all additional costs and expenses incurred for acquiring acceptable services, and/or replacement Product.
