Reports and Documents. Upon Lessor’s written request, Lessee shall furnish Lessor copies of all title opinions covering the Leased Premises and promptly upon receipt by Lessee, notify Lessor of any judicial proceedings brought to the attention of Lessee affecting its possession under the Lease or the interest of Lessor in the Leased Premises as well as copies of all filings, statements, and reports made by Lessee with the Ohio Department of Natural Resources or other government agency pertinent to drilling, completing and equipping xxxxx. Upon Lessor’s written request, Lessee shall provide to the Lessor in the routine course of Lessee’s daily business, full information as to the production, use, transfer, disposal and sale from xxxxx on the Leased Premises or lands pooled or unitized therewith. Such production information shall be strictly confidential and Lessor agrees to not provide any such information to any p arty without written consent of Lessee. Lessor shall have the right to inspect, audit (under Article III, Section 4) and copy all records of Lessee pertaining to the production and sale of oil and gas from the Leased Premises and the calculation and payment of Lessor’s royalty hereunder. A single written request for the information referred to in this paragraph will cause the information to be supplied on continuing basis until such time as Lessee receives a written request from the Lessor to stop providing such information.

Such documents are specific to Client, the Project, and the Project Location, and Client shall, to the fullest extent permitted by law, indemnify and hold harmless Surveyor from and against any action, claim, damage (including defense costs), or loss arising out of or in connection with Client’s assignment to a third party, re-use, modification, or misuse of Surveyor’s Documents without Surveyor’s prior written consent.
