Restrictions of Use. 3.1. You will not do (nor will You allow any of Your Users and any other third party to do) any of the following:
3.1.1. License, sublicense, sell, resell, transfer, assign, distribute, copy, outsource, or otherwise commercially exploit or make available to any third party the Service or the Content in any way;
3.1.2. Modify or make derivative works based upon the Services or the Content;
3.1.3. Create Internet “links” to the Service, “frame”, or “mirror” any Content on any other server or wireless or Internet-based device.
3.1.4. Use the Service to send "spam" or otherwise duplicative or unsolicited messages in violation of applicable law to the Company or otherwise;
3.1.5. User the Service to send or store infringing, obscene, threatening, libelous, or otherwise unlawful material, including material harmful to children;
3.1.6. Use the Service to send or store material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs;
3.1.7. Interfere with or disrupt the integrity or performance of the Service or the data contained therein;
3.1.8. Work around any technical limitations in the Service, or decompile, disassemble or otherwise reverse engineer the Service or make any attempt to ascertain, derive or obtain the source code for the any software which is used to provide the Service;
3.1.9. Use the Service to take any action that infringes on any third party’s copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; or violates any applicable law, statute, ordinance or regulation (including those regarding export control);
3.1.10. Attempt to gain or gain unauthorized access to the Service or its related systems or networks; or
3.1.11. Use personal information (as defined in the GDPR) in violation of the applicable law or without receiving data subject necessary consents.
3.1.12. Access or use the Services to build or support, directly or indirectly, products or services competitive to the Company.
3.2. Company shall be entitled to monitor Customer's compliance with the terms of this Agreement.
Restrictions of Use. Subject to paragraphs 2.3 and 9, RfL(I) shall, in respect of each RfL(I) Restriction of Use, pay to the Train Operator the Direct Losses incurred by the Train Operator as a consequence of such RfL(I) Restriction of Use.
Restrictions of Use. We may deny you access to all or part of the Databases or any Data without notice if you engage in any conduct or activities not for the Purpose or that We believes violates any term of this ULA. In particular, You may not:
Restrictions of Use. Customer agrees not to:
(i) use the Development Platform to (1) process production data or for any other production purposes, including but not limited to publishing digital applications, or (2) distribute applications;
(ii) use the Development Platform with data or information that has not been backed up; or
(iii) modify, delete or remove any ownership, title, trademark, patent or copyright notices.
Restrictions of Use. 6.1 The Customer shall not, and shall take all reasonable steps to ensure that any User does not, upload, access, store, distribute or transmit any viruses, or any material during the course of its use of the Purchased Service that:
(a) is unlawful, harmful, threatening, defamatory, obscene, infringing, harassing or racially or ethnically offensive; (b) facilitates illegal activity; (c) is in breach of applicable legislation in respect to obscenity or indecency; (d) promotes violence; (e) is discriminatory based on race, gender, colour, religious belief, sexual orientation, disability, or any other illegal activity; or (f) causes damage or injury to any person or property. Element reserves the right, without liability to the Customer, to disable the Customer’s access to the Purchased Service as a result of a breach of the provisions of this clause, or where there has been unauthorised or suspected fraudulent or otherwise suspicious activity related to the Customer’s use of the Purchased Service.
6.2 Except to the extent expressly permitted under this Agreement and to the maximum extent permitted by law, the Customer shall not: (a) (i) attempt to copy, reproduce, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit, or distribute all or any portion of the Purchased Service whether the same constitute Element Proprietary Materials (as applicable) in any form or media or by any means; or (ii) attempt to reverse compile, disassemble, reverse engineer or otherwise reduce to human-perceivable form all or any part of the Element Proprietary Materials; or (b) access all or any part of the Element Proprietary Materials in order to build a product or service which competes with the Element Proprietary Materials; or (c) use the Element Proprietary Materials to provide services to third parties or offer any part of the Element Proprietary Materials for sale or distribution over any other medium; or (d) license, sell, rent, lease, transfer, assign, distribute, display, disclose, or otherwise commercially exploit, or otherwise make the Element Proprietary Materials and/or Documentation available to anyone except the Users; or (e) attempt to obtain, or assist third parties in obtaining, access to the Element Proprietary Materials; or (f) permit any third party to benefit from the use or functionality of the Element Proprietary Materials.
Restrictions of Use. 1.a. The use of a single-user licence is connected and limited to one identified person.
1.b. The use of a multi-user licence is connected and limited to a corresponding number of identified persons.
1.c. The use of an educational licence is connected to one clearly defined educational institution. The right to use an educational licence may be transferred to employees and students of the Licensee without further approval of the Licensor. Adequate measures must be taken by Licensee to ensure that all the employees and students involved understand the limits on the rights to use and that the educational licence is for non-commercial personal and educational use only.
Restrictions of Use. Unless the Owner has authorized you to distribute the App, you shall not make or distribute copies of the App or transfer the App from one device to another. You shall not decompile, reverse engineer, disassemble, include in other software, or translate the App, or use the App for any commercial purposes. You shall not modify, alter, change or otherwise make any modification to the App or create derivative works based upon the App. You shall not rent, lease, resell, sub-license, assign, distribute or otherwise transfer the App or this license. Any attempt to do so shall be void and of no effect.
Restrictions of Use. Unless otherwise authorized under this Agreement, Customer may not (and will not allow any third party to): (i) sell, rent, lease, license, sublicense, distribute, pledge, assign or otherwise transfer in whole or in part the Software or the Professional Services or any interest in them to another party; (ii) provide, disclose, divulge or make available to, or permit use of the Subscription in whole or in part by any third party without OutSystems’ prior written consent; (iii) sell, rent, lease, license, sublicense, offer as a paid or free subscription, distribute, pledge, assign or otherwise transfer in whole or in part the Applications built with the Software, when such Applications will be used by a single third party; (iv) install or use the Software in a manner that circumvents or interferes with the operation of the technological measure that controls the access to the Software (v) modify, translate, adapt or create derivative works based on the Software; (vi) export or re-export the Software or any derivative work thereof; (vii) remove or modify any Software markings or any notice of OutSystems’ proprietary rights; (viii) use the Software to develop, test, host, or run and operate applications on behalf of third-parties to this Agreement, without OutSystems’ prior written consent; (ix) use the Software to provide third party training; (x) disclose results of any Subscription benchmark tests to any third party without OutSystems’ prior written consent; (xi) use the Software in any way that is contrary to the terms and conditions of this Agreement; or (xii) use the Software for any unlawful purposes. Except to the extent expressly permitted by this Agreement or applicable law, and to the extent that OutSystems is not permitted by that applicable law to exclude or limit the following rights, Customer may not decompile, disassemble, reverse engineer, or otherwise attempt to derive source code from the Software, in whole or in part.
Restrictions of Use. 1. The use of a Yearly Licence is bound and limited to one workstation (i.e. workstation-bound license).
2. End User is granted unlimited access to the ecoinvent Database only through the Reseller Software. After the Term the End User undertakes to irrevocably delete the ecoinvent Database from the workstation(s).
3. Guest User is only granted limited access to the ecoinvent Database through the ecoinvent website.
4. Licensee is not entitled to publish or make available to others derivative databases or datasets or database-like products using all or any portion of the ecoinvent Database or ecoinvent Dataset, or any derivation thereof. Publication of individual datasets and results are permitted within the scope of Studies and Reports provided that this does not violate the legitimate business interests of the Licenser.
5. Licensee is not entitled to reproduce, disseminate or publicly display any significant portions of the ecoinvent Database or the ecoinvent Datasets.
6. Licensee is not entitled to sell, rent, lease, loan, distribute, export, import, act as an intermediary or provider, or grant any kind of licence rights to third parties with regard to the ecoinvent Database, the ecoinvent Dataset or any portions thereof. Studies and Reports are exempted from this sub-section 6.
7. Licensee is not entitled to undertake, cause, permit or authorize the modification, translation, reverse engineering, decompiling, disassembling or hacking of the ecoinvent Database, the ecoinvent Dataset or any part thereof except to the extent required by mandatory law.
8. Licensee is not entitled to assign the ecoinvent Database or the ecoinvent Dataset as a whole or any portions thereof to any third party.
